Download or read book Prohibition of Abuse of Law written by Rita de la Feria and published by Bloomsbury Publishing. This book was released on 2011-06-09 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Court of Justice has been alluding to 'abuse and abusive practices' for more than thirty years, but for a long time the significance of these references has been unclear. Few lawyers examined the case law, and those who did doubted whether it had led to the development of a legal principle. Within the last few years there has been a radical change of attitude, largely due to the development by the Court of an abuse test and its application within the field of taxation. In this book, academics and practitioners from all over Europe discuss the development of the Court's approach to abuse of law across the whole spectrum of European Union law, analysing the case-law from the 1970s to the present day and exploring the consequences of the introduction of the newly designated 'principle of prohibition of abuse of law' for the development of the laws of the EU and those of the Member States.

Download or read book Foreigners and Their Food written by David M. Freidenreich and published by Univ of California Press. This book was released on 2011-07-02 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foreigners and Their Food explores how Jews, Christians, and Muslims conceptualize “us” and “them” through rules about the preparation of food by adherents of other religions and the act of eating with such outsiders. David M. Freidenreich analyzes the significance of food to religious formation, elucidating the ways ancient and medieval scholars use food restrictions to think about the “other.” Freidenreich illuminates the subtly different ways Jews, Christians, and Muslims perceive themselves, and he demonstrates how these distinctive self-conceptions shape ideas about religious foreigners and communal boundaries. This work, the first to analyze change over time across the legal literatures of Judaism, Christianity, and Islam, makes pathbreaking contributions to the history of interreligious intolerance and to the comparative study of religion.

Book excerpt: Following each Member State's need to rebuild a strong and stable economy after the 2007 financial crisis, the European Union (EU) has developed a robust new transparency framework with binding anti-abuse measures and stronger instruments to challenge external threats of base erosion. This is the first and only book to provide a complete detailed analysis of the Anti-Tax Avoidance Package and other recent and ongoing European actions taken in direct taxation. With contributions from both prominent tax academics and Spain's delegates to the European meetings where these rules are debated and promulgated, the book covers such issues and topics as the following: – the development of the EU Strategy towards Aggressive Tax Planning; – recent tax-related jurisprudence of the European Court of Justice; – the Anti-Tax Avoidance Directive; – tax treaties and non-tax treaties with tax consequences both between Member States and between Member States and third countries; – code of conduct for business taxation; – automatic exchange of information; – country-by-country reporting; – arbitration in tax matters; – external strategy for effective taxation regarding non-EU countries; – competition and state aid developments in direct taxation; – the Common Consolidated Tax Base; and – digital significant presence and permanent establishment. As the EU pursues its ambitious tax agenda, taxation's contribution to EU growth and competitiveness and its part in relations with the rest of the world will come into ever clearer focus. In addition to its insights into these trends, the book's unparalleled practical information and analysis will be of great value to tax practitioners dealing with investment analysis, tax planning schemes, and other features of the current international tax landscape.

Book Living Together Living Apart

Download or read book Living Together Living Apart written by Jonathan Elukin and published by Princeton University Press. This book was released on 2013-12-08 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book challenges the standard conception of the Middle Ages as a time of persecution for Jews. Jonathan Elukin traces the experience of Jews in Europe from late antiquity through the Renaissance and Reformation, revealing how the pluralism of medieval society allowed Jews to feel part of their local communities despite recurrent expressions of hatred against them. Elukin shows that Jews and Christians coexisted more or less peacefully for much of the Middle Ages, and that the violence directed at Jews was largely isolated and did not undermine their participation in the daily rhythms of European society. The extraordinary picture that emerges is one of Jews living comfortably among their Christian neighbors, working with Christians, and occasionally cultivating lasting friendships even as Christian culture often demonized Jews. As Elukin makes clear, the expulsions of Jews from England, France, Spain, and elsewhere were not the inevitable culmination of persecution, but arose from the religious and political expediencies of particular rulers. He demonstrates that the history of successful Jewish-Christian interaction in the Middle Ages in fact laid the social foundations that gave rise to the Jewish communities of modern Europe. Elukin compels us to rethink our assumptions about this fascinating period in history, offering us a new lens through which to appreciate the rich complexities of the Jewish experience in medieval Christendom.
