Book excerpt: Depuis les procès de Nuremberg qui avaient mis en évidence des abus et atrocités commis dans le cadre de l'expérimentation humaine, l'obligation d'obtenir le consentement des sujets de recherche a été considérée comme l'obligation première à laquelle doit se soumettre toute recherche. Ceci s'est vu édicté par des textes internationaux fondateurs tels que le Code de Nuremberg et la éclaration d'Helsinki. En France, ces règles d'éthique, élaborées par des organisations non gouvernementales et dépourvues, à l'époque, de toute force juridique et de tout caractère contraignant, ont permis la création de comités d'éthique. Ces comités ont pour objectif de formuler des avis sur les problèmes éthiques, sociaux et juridiques fondamentaux, qui apparaissent avec le progrès des sciences médicales et biologiques. Cependant, il n'est pas facile de savoir quel rôle incombe ici au droit. Est-ce qu'il peut, par ses règles précises et concrètes, faciliter la solution de dilemmes moraux compliqués qui se posent à chaque médecin en particulier au cours des essais cliniques ? La sécurité des sujets qui se livrent aux recherches biomédicales a été l'ambition essentielle de la loi HURIET-SERUSCLAT du 20 Décembre 1988. Le législateur a placé le respect et la protection des personnes au cœur de ses préoccupations en instaurant un cadre clair et précis pour la recherche biomédicale. Néanmoins, l'évolution de la loi de 1988 était souhaitable, indépendamment de la nécessité de transposer la directive européenne 2001/20/CE sur les essais de médicaments. Reconstruite autour de la logique de l'évaluation de la balance bénéfice/risque, la loi n° 2004-806 marque ainsi la fin des régimes différents de protection des personnes participant aux recherches biomédicales, renforce cette protection et harmonise les formalités administratives. Les règles d'éthique concernant la protection des personnes dans la recherche biomédicale ont fait place à une législation et une réglementation qui aujourd'hui ne sont plus centrées sur la protection des personnes mais qui s'attachent à définir comment conduire un essai clinique et les relations administratives avec les autorités compétentes. La question qui se pose est de savoir si la protection des personnes a gagné à passer de l'éthique au mode opératoire, puis du mode opératoire à la loi.

Le promoteur a des obligations de gestion des évènements indésirables. Cette discipline est la pharmacovigilance des essais cliniques. Des structures comme les comités de protection des personnes (CPP) et les comités de sécurité indépendants (CSI) sont mis en place pour aider le pharmacovigilant dans ses prises de décision en termes de sécurité. Le patient étant au cœur de toutes les problématiques rencontrées dans les diverses activités nous avons décidé de nous intéresser au rôle de l'éthique dans les différentes activités d'un pharmacovigilant. Dans un premier temps, ce travail présente les principes éthiques fondamentaux régissant les activités médicales et la réglementation de la pharmacovigilance des essais cliniques. Sont aussi présentées les réglementations et activités du pharmacovigilant, des CPP et des CSI. Puis, l'importance de l'éthique dans les différentes activités du pharmacovigilant est discutée à la fois pour ses activités réalisées en amont de l'étude et celles réalisées en cours d'étude comme la collecte et l'évaluation des évènements indésirables ainsi que la rédaction de rapports de sécurité. Les différentes questions auxquelles peut être confronté le pharmacovigilant au cours de son activité sont décrites. La suite du travail contient des résultats plus pratiques. Deux CPP ont été interrogés afin de comprendre et comparer leur mode de fonctionnement. Notamment la gestion de la sécurité des essais cliniques et l'évaluation de la balance bénéfices/risques. Trois études promues par le CHU de Nantes et pour lesquelles des problématiques d'éthique ont été soulevées sont détaillées à titre d'exemple. Ce travail met en évidence les difficultés auxquelles peuvent être confrontées les pharmacovigilants en milieu institutionnel. Les activités sont guidées par des textes réglementaires mais aussi des principes éthiques. On peut remarquer au travers de ce travail qu'il existe une grande différence entre la théorie et la pratique et que les moyens alloués sont souvent insuffisants compte tenu des compétences exigées et résultats attendus.
