Book excerpt: Just how International and European Community Law is being integrated into domestic legal systems is as yet not too well known. To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.

Book excerpt: The doctrine of international relations (inter-state, indeed), territorial ideologies, the logic of autochthony and its ramifications, ethnic cleansing, are all hinged at different levels upon the same pseudo-fact: to every society a closed and exclusive territory demarcated by fixed and linear borders. This way of thinking, totally foreign to African societies for a long time, has generated today more contradictions than it can ever solve. The authors of this book make a clear distinction between territory formation "from the top" as being a deliberate political project, and its formation "from below" as being a more diffused historical process which is determined by the scheme of antagonisms and compromises between social forces. In lieu of a stark opposition between "the top" and "below", the authors unveil the interdependence and mutual influence which form the basis of a dual system within which legal formation -by the colonial authorities first, then by the postcolonial one- is confronted with a host of subaltern spatial dynamics, neglecting thereby the legitimacy which only them can provide. As an essential read for anyone who is interested in the relationship between knowledge and power, this book offers stimulating perspectives on the issue of African unity and its epistemological and political challenges. Tandis que les entreprises découvrent l'importance d'agir sur le processus de décision en marche, elles se voient attribuer une place dans cette concertation participative. Ce nouveau rôle nécessite l'accumulation de compétences techniques élargies et la multiplication de contacts avec les autres acteurs. Ensemble, ils participent à la délimitation du cadre communautaire (à travers l'élaboration des normes techniques, l'harmonisation de la fiscalité, la régulation des aides d'État, etc.) et entendent y défendre au mieux leurs intérêts. Cela peut être l'occasion d'oppositions frontales, souvent difficiles à contourner. De nouveaux apprentissages sont alors nécessaires pour tâcher d'avancer dans l'harmonisation communautaire. This collection of papers derives from the multidisciplinary workshop of young researchers which took place in Louvain-la-Neuve on 11-13 June 2003. It is based on actual case studies in the sectors of transport, data-processing and telecommunications between the 1950s and the 1980s. It analyses the long and difficult process for those involved in building «expertise» in the new field of an integrated Europe. At the same time as firms discovered the importance of influencing the decision-making process at work, they were given a place in this participative process. This new role implies the accumulation of enlarged technical competencies and the multiplication of contacts with other economic actors. Together, they have taken part in the demarcation of the Community framework, through the elaboration of technical standards, tax harmonisation, state aids regulation, and so on, and have defended their interests in this framework as best they could. This could provoke strong opposition, which was difficult to overcome. In this case, a process of learning and understanding was necessary on both sides in order to advance Community harmonisation.
