Our aim is twofold: to identify holders of open data who are involved in ongoing data space implementation and to reflect on the role that open data portals (with a special focus on data.europa.eu) could play in this implementation.

Book excerpt: This book explores the emerging economic reality of health data pools from the perspective of European Union policy and law. The contractual sharing of health data for research purposes is giving rise to a free movement of research data, which is strongly encouraged at European policy level within the Digital Single Market Strategy. However, it has also a strong impact on data subjects' fundamental right to data protection and smaller businesses and research entities ability to carry out research and compete in innovation markets. Accordingly the work questions under which conditions health data sharing is lawful under European data protection and competition law. For these purposes, the work addresses the following sub-questions: i) which is the emerging innovation paradigm in digital health research?; ii) how are health data pools addressed at European policy level?; iii) do European data protection and competition law promote health data-driven innovation objectives, and how?; iv) which are the limits posed by the two frameworks to the free pooling of health data? The underlying assumption of the work is that both branches of European Union law are key regulatory tools for the creation of a common European health data space as envisaged in the Commissions 2020 European strategy for data. It thus demonstrates that both European data protection law, as defined under the General Data Protection Regulation, and European competition law and policy set research enabling regimes regarding health data, provided specific normative conditions are met. From a further perspective, both regulatory frameworks place external limits to the freedom to share (or not share) research valuable data.

They helped bring about a paradigm shift in the open data community, namely a shift away from understanding portals primarily as a means to publish and discover data and towards rethinking of portals as sources of added-value content and resources that facilitate data reuse and foster data communities. This report is the first in a series. The series will build on this previous work and focus both on the value of the data and metadata that the data.europa.eu portal holds and on the value of other resources available on the portal (e.g. documentation in the form of reports and publications, tools and data stories). To provide such an analysis, we are developing methods (including computational methods, also known as software prototypes) to: • assess the value of datasets and their related resources by studying their presence on other digital platforms, tools and applications that are commonly used by data communities; • add value to datasets and resources by recommending other related datasets and resources and enriching their content to make it easier to use in downstream applications (e.g. in machine learning).

Book excerpt: Ensuring fair and trustworthy data sharing is at the core of the European Commission's policy agenda for the period 2019-2024 under the priority "A Europe fit for the digital age". Published in 2020, the European strategy for data set the ambitious vision to establish common European data spaces in all strategic societal sectors and domains of public interest. Data spaces are envisioned as sovereign, trustworthy and interoperable data sharing environments where data can flow within and across sectors, in full respect of European ambitions, rules and values. To support the establishment of data spaces while meeting the Digital Decade objectives for Europe's digital transformation by 2030, several cross-sectoral legislative instruments have been adopted or proposed following the publication of the European strategy for data. These include: the Data Governance Act, introducing a set of horizontal measures to boost trustworthy data sharing in the EU; the Data Act, aiming to make more business data available for reuse through the definition of rules on who can access and use what data and for which purposes; the Implementing Act on High Value Datasets, implementing the Open Data Directive by specifying a list of datasets that public sector bodies shall make available for free and under open access licenses, as well as making them accessible in machine-readable formats via application programming interfaces (APIs); and the Digital Markets Act, which sets out some measures on data access and portability to regulate the "gatekeeper power" of digital companies prone to unfair business practices.

Book excerpt: The goal of data.europa.eu is to improve accessibility to and promote the reuse of public sector information. The portal provides access to open data from international, EU, national and regional sources. This is achieved by collecting the metadata of public data made available across Europe in a process called harvesting. Metadata is harvested both from open data portals and from geodata portals and is made available on data.europa.eu. This report discusses the potential of real-time data in conjunction with data.europa.eu. Real-time data allows us to gather up-to-date information about the environment surrounding us (e.g. traffic information, weather data, measurements of environmental pollution, information about natural hazards). Consequently, the European directive on open data and the reuse of public sector information put a specific emphasis on making such real-time data resources available. There is a dedicated field of work in the data.europa.eu project to help users discover open real-time data sources. This comprises not only the inclusion of real-time data sources in its data index, but also the support of data providers to make their data available in a reusable and discoverable way. This report summarises the results and findings of a webinar on real-time data held by the data.europa.eu project on 5 April 2022. On the one hand, the report offers a short summary of the presented information and technologies (e.g. relevant standards/APIs). On the other hand, it summarises the main findings of the questions and feedback from the participants (e.g. data needs, types of data sources and required functionalities). As a result, the report provides a set of recommendations on how to further improve the discoverability of real-time data sources via data.europa.eu.

Book excerpt: This is the second and final report about citizen-generated data (CGD) and open governmental data portals (OGDPs). In the first report (Corcho, Jiménez, Morote, & Simperl, 2022)a literature review was undertaken to define CGD and its main attributes. National and local OGDPs that are in the scope of data.europa.eu were then analysed to see what CGD datasets they already publish. The analysis was summarised in 10 findings, accompanied by 10 recommendations. The current report starts where the previous left off. To add context to the original findings and recommendations, the authors undertook a mixed methods study with three parts: (1) interviews with representatives of key stakeholder groups in the CGD space; (2) a system analysis of five OGDPs that came out on top in the previous report with respect to the number of CGD datasets published; and (3) a system analysis of national citizen-science portals (CSPs) to find additional CGD datasets that OGDPs could consider adding to their catalogues.
