Book A Modern History of German Criminal Law

Download or read book A Modern History of German Criminal Law written by Thomas Vormbaum and published by Springer Science & Business Media. This book was released on 2013-10-01 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: Increasingly, international governmental networks and organisations make it necessary to master the legal principles of other jurisdictions. Since the advent of international criminal tribunals this need has fully reached criminal law. A large part of their work is based on comparative research. The legal systems which contribute most to this systemic discussion are common law and civil law, sometimes called continental law. So far this dialogue appears to have been dominated by the former. While there are many reasons for this, one stands out very clearly: Language. English has become the lingua franca of international legal research. The present book addresses this issue. Thomas Vormbaum is one of the foremost German legal historians and the book's original has become a cornerstone of research into the history of German criminal law beyond doctrinal expositions; it allows a look at the system’s genesis, its ideological, political and cultural roots. In the field of comparative research, it is of the utmost importance to have an understanding of the law’s provenance, in other words its historical DNA.

Available in PDF, EPUB and Kindle. Book excerpt: What accounts for the persistence and spread of "commoning," the irrepressible desire of people to collaborate and share to meet everyday needs? How are the more successful projects governed? And why are so many people embracing the commons as a powerful strategy for building a fair, humane and Earth-respecting social order? In more than fifty original essays, Patterns of Commoning addresses these questions and probes the inner complexities of this timeless social paradigm. The book surveys some of the most notable, inspiring commons around the world, from alternative currencies and open design and manufacturing, to centuries-old community forests and co-learning commons - and dozens of others. David Bollier (www.bollier.org) is an American author, activist and independent scholar who has studied the commons for nearly twenty years. Silke Helfrich (commonsblog.wordpress.com) is a German author and independent activist of the commons who blogs at www.commonsblog.de, and cofounder of the Commons-Institut in Germany. Book Modern Architecture

Download or read book Modern Architecture written by Otto Wagner and published by Getty Publications. This book was released on 1988 with total page 202 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1896, Otto Wagner's "Modern Architecture" shocked the European architectural community with its impassioned plea for an end to eclecticism and for a "modern" style suited to contemporary needs and ideals, utilizing the nascent constructional technologies and materials. Through the combined forces of his polemical, pedagogical, and professional efforts, this determined, newly appointed professor at the Vienna Academy of Fine Arts emerged in the late 1890s - along with such contemporaries as Charles Rennie Mackintosh in Glasgow and Louis Sullivan in Chicago - as one of the leaders of the revolution soon to be identified as the "Modern Movement." Wagner's historic manifesto is now presented in a new English translation - the first in almost ninety years - based on the expanded 1902 text and noting emendations made to the 1896, 1898, and 1914 editions. In his introduction, Dr. Harry Mallgrave examines Wagner's tract against the backdrop of nineteenth-century theory, critically exploring the affinities of Wagner's revolutionary élan with the German eclectic debate of the 1840s, the materialistic tendencies of the 1870s and 1880s, and the emerging cultural ideology of modernity. Modern Architecture is one of those rare works in the literature of architecture that not only proclaimed the dawning of a new era, but also perspicaciously and cogently shaped the issues and the course of its development; it defined less the personal aspirations of one individual and more the collective hopes and dreams of a generation facing the sanguine promise of a new century

Book The German Criminal Code

    Book Details:
  • Author :
  • Publisher : Bloomsbury Publishing
  • Release : 2008-07-03
  • ISBN : 1847314384
  • Pages : 226 pages

Download or read book The German Criminal Code written by and published by Bloomsbury Publishing. This book was released on 2008-07-03 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: German substantive criminal law has been influential in many civil law countries, most notably in the Hispanic world. In the common law countries, not surprisingly because of the systemic differences in approach, its impact has been much less, if not negligible. This may be largely explained as a result of the language barrier. An up-to-date and reliable English translation of the German Criminal Code has been conspicuously missing for some time. This book presents a new English translation of the Strafgesetzbuch, (the Criminal Code), in its most recent amended form of August 2007. The Code is the centrepiece of German substantive criminal law and informs the interpretation and application of any other criminal provisions which can be found in specific legislation. The translation thus affords an opportunity to profit from a legal tradition that has had a major influence over history and has a rich experience of doctrinal analysis. The translation adheres as closely as possible to the textual structure of the original, but has been made palatable to an English ear. It is intended as a companion to the author's Principles of German Criminal Law which was published in December 2008. Book excerpt: Including his most famous works, such as “The Gift of the Magi” and “The Furnished Room,” this collection of forty-one O. Henry short stories demonstrates his extraordinary technical genius. “There are stories in everything. I’ve got some of my best yarns from park benches, lampposts, and newspaper stands.”—O. Henry Readers the world over recognize O. Henry as the best short story writer of the early twentieth century—even today a masterful surprise at the end of a story is described as “an O. Henry twist,” and a prominent short fiction award bears his name. Widely known as a master of irony, O. Henry also displayed in his stories dazzling wordplay and a wry combination of pathos and humor. Cunningly arranged according to geographic location, these tales display the wide range of O. Henry’s world, from the streets of his beloved New York City to the heat of Honduras and other exotic locales. With his wonderful plot turns, unexpected climaxes, and deep insights into human nature, O. Henry’s works will live on as prime examples of the well-told tale. These modes include reasoning from binding precedents (prior cases that are binding on the deciding court); reasoning from authoritative although not binding sources, such as leading treatises; reasoning from analogy; reasoning from propositions of morality, policy, and experience; making exceptions; drawing distinctions; and overruling. The book further examines and explains the roles of logic, deduction, and good judgment in legal reasoning.
