Available in PDF, EPUB and Kindle. Book excerpt: National borders do little to prevent trafficking in illegal goods, but often hamper the efforts of the authorities in pursuit. In this new edition Boister examines whether too much focus on suppressing criminality, and not enough on protecting human rights and the rule of law, has prevented efforts to create an effective transnational legal space.

This book was released on with total page 97 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a groundbreaking book that offers key stakeholders, policy makers and professionals a much needed resource to understand the need to provide effective and humane treatment of drug users with drug addiction problems (drug dependants) who fall within the criminal justice system in Malaysia. This book begins with a narrative description of the historical evolution of drug abuse in Malaysia: beginning from the opium trade in the 18th century, with the exodus of the Chinese immigrants to Southeast Asia and Malaysia as labourers in the late 19th century which brought along the problem of opium addiction to the Malay Peninsula, to the 1970s which saw a transitional change from opium addiction to heroin and the rise in amphetamine-type-stimulant (ATS) abuse in Malaysia as the 21st century drug problem. It then provides an overview of Malaysia’s prohibition approach by waging the rhetorical War on Drugs, including the development of Malaysia’s punitive drug laws and the recent paradigm shift towards a more rehabilitative approach in drug treatment. Over the years, a considerable number of High Court cases have challenged the legality of the detention of drug dependants for treatment at Puspen via a court-mandated order. This book further presents a commentary that is founded upon the legal challenges brought about by such unlawful detention, illustrated by judicial decisions of Malaysian judges regarding the constitutional rights of the drug dependants enshrined under Article 5 of the Federal Constitution.
Download or read book Penal Aspects of the UN Drug Conventions written by Neil Boister and published by BRILL. This book was released on 2021-07-26 with total page 636 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UN Drug Conventions - the 1961 Single Convention on Narcotic Drugs, the 1971 Psychotropic Convention, the 1972 Protocol to the Single Convention and the 1988 UN Drug Trafficking Convention - regulate the global suppression of illicit drugs. This volume examines the provisions of these conventions that require states to adopt penal measures against drugs in their domestic law. Its introductory chapters explore the controversial application of drug prohibition by international society and the historical development of this policy through the penal provisions of the drug conventions. The substantive chapters investigate the various facets of the illicit drug control system created by these penal provisions: crimes and penalties; jurisdiction and extradition; general and specific forms of drug law enforcement co-operation; and the supervision of the system by the UN drug control organs. The conclusion offers a general critique of the system and makes suggestions about its future development.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.
