When in need of medical treatment, patients increasingly act as informed consumers who claim the right to choose their own providers, including those beyond borders. This book explores such trends and also looks at the legal framework for cross-border care as well as examining some of the uncertainties surrounding it. After the adoption of the Directive on the application of patient rights in cross-border care, Member States will now have to start implementing these provisions. One of the challenges will be to see how various national practices related to access, benefits and tariffs, quality and safety, patient rights, cooperation etc. will be affected by these new rules. The information and analysis presented in the study can be of considerable use to policy-makers and those with an interest in key aspects of cross-border health care to accompany or follow this process.

Book excerpt: The 2011 Cross‐border Healthcare Directive seeks to ensure EU patients’ rights to access safe and high‐quality healthcare, including across national borders within the EU. These rights are also intended to facilitate closer cooperation between Member States on eHealth and the treatment of rare diseases. We concluded that although EU actions in cross-border healthcare enhance Member States’ collaboration, the benefits for patients were limited. We found that despite the progress made on providing EU citizens with information on cross-border healthcare, in some areas this information remains difficult to access. We identified weaknesses in the Commission’s strategic planning and project management. We make recommendations focusing on the Commission’s support for national contact points, the deployment of cross-border exchanges of health data, and EU’s actions in the field of rare diseases.

The Committee is also conducting a web forum to hear the experiences of patients who rely on services on the other side of the border and the views of medical professionals and social care practitioners.

We consider the effect on healthcare quality as well as income redistribution and Public health insurance schemes. We find that the implementation of cross-border healthcare induces governments to increase reimbursements to hospitals, and improves the quality of hospitals. Furthermore, a large reduction in non-monetary friction for cross-border healthcare weakens Income redistribution in the country in which a proportion of patients receive cross-border Healthcare services.

Insured persons have different routes at their disposal to receive cross-border healthcare. They can seek treatment according to the rules and principles set by the Social Security Coordination Regulations; Directive 2011/24/EU; or their own national legislation. The figures reported in this report relate to cross-border healthcare provided under the Coordination Regulations. The report provides figures for 2019 on the number of persons who received cross-border healthcare and the budgetary impact of it by the application of the coordination rules. The report makes it very clear that people are mobile in Europe. For example, in some cases tourists need unplanned necessary healthcare and use their EHIC for this purpose; people go abroad to receive planned care on the basis of a PD S2 and the Cross-Border Healthcare Directive; and finally, people living in a Member State other than the one where they work or have worked are able to use their PD S1 if they need healthcare. Consequently, the number of tourist arrivals is expected to show a strong correlation with the number of healthcare reimbursement claims issued. Furthermore, the number of PDs S1 issued to insured persons of working age will probably show a strong correlation with the number of incoming cross-border workers, and the number of refund claims that Member States receive based on a PD S1. Finally, (Mediterranean) Member States that receive a high number of retired migrants will submit many claims for the reimbursement of cross-border healthcare on the basis of a PD S1.

Book excerpt: The Cross-Border Patients' Rights Directive represents an attempt to resolve the unclear situation that had developed due to 'negative integration' within the field of healthcare. While the adoption of the directive ends the EU-level decision process, it represents the start of the implementation process, where national institutional structures and interests play a key role. This article investigates the role of resources as a key factor shaping transposition within the member states, with a focus on Poland and Bulgaria. The article shows that a multidimensional perspective of resources is important for understanding transposition of EU directives in member states. While previous research has tended to consider resources at the aggregate, national level, the present study shows that specific concerns about the 'adjustment costs' at the sector system level are of key importance.

Book excerpt: Patient mobility across Europe is markedly increasing and new generations will actively ask to be treated by the health-care system that best meets their needs. At a political level, the EU issued the EU Directive no. 24/2011/CE of 9th March 2011 concerning the application of patients’ rights in cross-border health care and has contributed to improving the level of freedom of choice for the European citizen, but it does not seem to have increased actual patient mobility across Europe. Freedom to choose is necessary to grant the people of Europe the same access to public-sector health-care services. The latter is a key instrument for an efficiently functioning “single market” ensuring real mobility within the EU. The aim of this book is to study the current European health care market and discuss the hypothesis of a European right of citizenship with reference to health-care services. It examines patients' mobility from several perspectives: determinants of patient mobility, governance of cross-border mobility at EU level as concerns patients and health-care professionals, policy implications, and case studies. It is intended for health researchers, decision-makers and professionals concerned with health-care provision and patient mobility. The goal is to provide, through scientific and methodological rigor, new informative tools useful for the implementation of new policies in the health-care sector in order to implement effective health-care integration in the European Union.

Book excerpt: This study seeks to identify the different requirements placed on healthcare providers wishing to either establish themselves in another European Member State (MS), or provide cross-border services in one MS whilst being established in another. The focus of the study was on cross-border General Practitioners (GPs) (including provision of online consultations and ePrescriptions), physiotherapists, medical laboratories, and hospitals setting up subsidiaries across borders. The study concludes that the requirements that only apply to cross-border providers (in this study referred to as “additional requirements”) mainly concern requirements relating to individual medical professionals:  Recognition of qualifications (GPs, physiotherapists and professionals running a medical laboratory).  Language requirements (GPs, physiotherapists and professionals running a medical laboratory).  Additional requirements upon registration with regulatory bodies (e.g. additional supporting documents and certified translations). Requirements relating to the place of work and public funding coverage typically apply equally to all providers. For example, legislation on setting up subsidiary hospitals hardly ever distinguishes between national or crossborder providers. Cross-border healthcare providers may face obstacles, partially because of the additional requirements, when they want to provide cross-border services. The three main obstacles identified are:  Language requirements.  High costs associated with providing the required supporting documents – and particularly the certified translations of these documents – in the processes related to recognition of qualifications and/or registration with a regulatory body.  Unfamiliarity with the specifics of the healthcare system in a MS. Cross-border providers may experience more practical obstacles in finding the relevant information and navigating through the system compared to national providers. This potential obstacle is likely to be even bigger in MSs with a decentralised healthcare system.
