When in need of medical treatment, patients increasingly act as informed consumers who claim the right to choose their own providers, including those beyond borders. This book explores such trends and also looks at the legal framework for cross-border care as well as examining some of the uncertainties surrounding it. After the adoption of the Directive on the application of patient rights in cross-border care, Member States will now have to start implementing these provisions. One of the challenges will be to see how various national practices related to access, benefits and tariffs, quality and safety, patient rights, cooperation etc. will be affected by these new rules. The information and analysis presented in the study can be of considerable use to policy-makers and those with an interest in key aspects of cross-border health care to accompany or follow this process.

Book excerpt: Patient mobility across Europe is markedly increasing and new generations will actively ask to be treated by the health-care system that best meets their needs. At a political level, the EU issued the EU Directive no. 24/2011/CE of 9th March 2011 concerning the application of patients’ rights in cross-border health care and has contributed to improving the level of freedom of choice for the European citizen, but it does not seem to have increased actual patient mobility across Europe. Freedom to choose is necessary to grant the people of Europe the same access to public-sector health-care services. The latter is a key instrument for an efficiently functioning “single market” ensuring real mobility within the EU. The aim of this book is to study the current European health care market and discuss the hypothesis of a European right of citizenship with reference to health-care services. It examines patients' mobility from several perspectives: determinants of patient mobility, governance of cross-border mobility at EU level as concerns patients and health-care professionals, policy implications, and case studies. It is intended for health researchers, decision-makers and professionals concerned with health-care provision and patient mobility. The goal is to provide, through scientific and methodological rigor, new informative tools useful for the implementation of new policies in the health-care sector in order to implement effective health-care integration in the European Union.

Book excerpt: Despite existence of several routes allowing access to cross-border healthcare, within the Maltese context, actual access to such care is de facto limited to the possibilities provided for by the cooperation agreement between Malta and the United Kingdom. Nevertheless, in light of its membership to the European Union, Malta must reassess its state of play to ensure compliance with EU legislation, particularly the Directive on the Application of Patients' Rights in Cross-Border Healthcare as adopted on 9 March 2011. As the Daniel James Cassar case and the alleged abuses of the Permanent Residency Scheme have highlighted, Malta must move towards a comprehensive Healthcare Act that would give legal certainty to patients and healthcare providers alike. It shall be argued that a shift from the current modus operandi, based primarily on ad hoc internal policy within the Ministry for Health, Elderly and Community Care, will lead to increased expenses for the Maltese healthcare system. Aside from compliance costs, Malta must address endemic de facto and perceived waiting lists for treatment within the public healthcare system. Failing to do so will perpetuate a situation whereby patients in Malta continue to seek treatment abroad that is quicker and more conveniently obtained, resulting in Maltese authorities being burdened with ever increasing reimbursements costs for financial care obtained abroad that regularly exceed budgetary allocations for health expenditure, running the risk of serious cumulative financial imbalance. This paper attempts to outline the various obligations of EU legislation on the Maltese public healthcare system, highlighting the different responsibilities on Malta, both as the state of treatment and as the state of insurance.

This book examines the different ways in which the concept of reference networks has been implemented in European countries and what kind of medical conditions or interventions it covers in various countries. It also looks at the motivations behind the establishment of such networks the regulatory and administrative processes for identifying and designating them as well as the financial arrangements needed for their proper functioning. This study outlines the key policy implications and challenges for developing the concept of reference networks at national and European levels. Ultimately we aim to provide a better understanding of the issues that may be encountered when implementing the Directive.

Book excerpt: The 2011 Cross‐border Healthcare Directive seeks to ensure EU patients’ rights to access safe and high‐quality healthcare, including across national borders within the EU. These rights are also intended to facilitate closer cooperation between Member States on eHealth and the treatment of rare diseases. We concluded that although EU actions in cross-border healthcare enhance Member States’ collaboration, the benefits for patients were limited. We found that despite the progress made on providing EU citizens with information on cross-border healthcare, in some areas this information remains difficult to access. We identified weaknesses in the Commission’s strategic planning and project management. We make recommendations focusing on the Commission’s support for national contact points, the deployment of cross-border exchanges of health data, and EU’s actions in the field of rare diseases.
