Download or read book Droit au travail et politiques d activation des personnes sans emploi written by Elise Dermine and published by Emile Bruylant. This book was released on 2017-05-24 with total page 521 pages. Available in PDF, EPUB and Kindle.

This book was released on 2019 with total page 0 pages. Available in PDF, EPUB and Kindle.

Download or read book International Labour Law written by Jean-Michel Servais and published by Kluwer Law International B.V.. This book was released on 2017-04-24 with total page 433 pages. Available in PDF, EPUB and Kindle. Book excerpt: No one will deny that labour standards comprise a necessary framework for balanced economic and social development. Yet on a global level such balanced development has not occurred, despite the existence of a rigorous body of international labour law that has been active and growing for almost one hundred years. The implementation of this law devolves upon states; yet many states have failed to honour it. If we are to take serious steps toward a remedy for this situation, there is no better place to start than a thorough, well-researched survey and analysis of existing international labour law - its sources, its content, its historical development, and an informed consideration of the barriers to its full effectiveness. This book is exactly such a resource. It provides in-depth interpretation of the crucial International Labour Organisation (ILO) instruments - Constitution, conventions, declarations, resolutions, and recommendations - as well as such other sources of law as the OECD Guidelines for Multinational Enterprises and various model and actual corporate codes of conduct. Among the substantive areas of labour law covered in this book are the following: • the relationship between international labour law and economic competition • standards on industrial relations • collective bargaining and dispute settlement procedures • protection of trade unions • prohibitions on enforced and child labour • promotion of equal opportunity and treatment • time and rest provisions • wage determination and protection • occupational health and safety provisions • special issues on non-standard forms of employment • foreign and migrant workers • social security provisions • privacy protection The presentation demonstrates that these rules and standards offer invaluable benchmarks to governments, judiciaries, employers, and trade unions. The book's combination of detailed commentary and an overarching social policy will make it especially valuable to legislators, human resources managers, employers ́ organizations, trade unions, jurists, and academics concerned with the role of work in our globalized social system. This fifth edition of the book by Jean-Michel Servais analyses the potential of those standards in a globalized world, and the necessary evolution. It examines the actual implementation of those rules in the national context, comparing different experiences. It integrates the latest instruments. It examines the most recent public debates on labour regulation (dealing with health and security at work, personal data, minimum wages, social security, strikes, etc.), updates the bibliography and opens some perspectives for the future work of the global institutions.

Book Democratic Work

Download or read book Democratic Work written by Alexis Cukier and published by Springer Nature. This book was released on 2023-05-08 with total page 198 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book proposes a radical transformation of labour institutions, in order to lay the foundation for the democratization of society rather than capitalist accumulation. Using an empirical analysis of the contemporary world of work, Alexis Cukier examines the democratic meaning of today’s critique of work organization and questions the theoretical models (linked to class struggles and to industrial democracy) to conceive of a "democratic work." Considering particular historical experiments (such as cooperatives, self-management, worker’s councils) that try to realize democracy at work, this book also analyzes the political issue of "democratic work" in relation to issues such as labour law, feminist struggles and political ecology. Ultimately, this book proposes some institutional paths that could overtake the divide between the rights of the citizens and the rights of the workers, arguing finally: if we really want to radicalize democracy, we should begin with democratizing work.

Book Travail critique du travail mancipation

Download or read book Travail critique du travail mancipation written by Michel Husson and published by Editions Syllepse. This book was released on 2006 with total page 126 pages. Available in PDF, EPUB and Kindle.

Book Injustice at Work

Download or read book Injustice at Work written by Francois Dubet and published by Routledge. This book was released on 2015-12-03 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Though it is difficult to describe what a just world should be, everyone is able to denounce injustice when he/she is a victim or a witness of it. Based on a long-term study of workers, this new book tests and expands upon prevailing theories of justice by Rawls, Nozick, Taylor, Walzer, and other important philosophers. Injustice at Work describes the way workers perceive social injustice. It reveals why they so often feel unequal, scorned, dominated, and alienated at work. The book develops three principles of justice-equality, merit, and autonomy-showing how individuals combine them in singular moral and social experiences that constitute people's relation to society. Dubet also shows, in a liberal and globalized society, why it has become more and more difficult to denounce the social causes of injustice and fight them.

Book The Capability Approach to Labour Law

Download or read book The Capability Approach to Labour Law written by Brian Langille and published by Oxford University Press. This book was released on 2019-04-04 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: Forty years ago Amartya Sen introduced to the world a novel approach to the idea of equality: the notion of 'basic capability' as 'a morally relevant dimension' and the claim that we should focus upon equality of basic capabilities ('a person being able to do certain basic things'). These ideas, as developed by Sen and Martha C. Nussbaum, have launched an academic armada now proceeding under the flag of the 'capability approach' (CA). While that flag has ventured far and wide and engaged many areas of inquiry, this volume of essays is the first to explore how CA might shed light upon labour law. The capabilities approach can illuminate our understanding of labour law across three dimensions. Part I looks at the nature of the basic relationship between CA and labour law-do they share common ground or disagree about what is important? Can the CA provide a normative 'foundation' for labour law? Part II goes further by examining the relationship of the CA and other well-established perspectives on labour law, including economics, history, critical theory, restorative justice, and human rights. Part III examines the possible relevance of the CA to a range of specific labour law issues, such as freedom of association, age discrimination in the workplace, trade, employment policy, and sweatshop goods.

Available in PDF, EPUB and Kindle. Book excerpt: Studies in Employment and Social Policy Volume 56 Digitalization, far from being solely a technological issue, has broad implications in the social, labour, and economic spheres. It leads to dangers as well as to new chances for the workforce, and thus labour law must develop effective ways to both protect workers and allow them to profit from new technological developments. The most thorough book of its kind, this collection of expert essays provides an abundance of well-thought-out material for understanding the consequences of digitalization for the labour market and industrial relations. Recognizing that only an international perspective can make it possible to face the challenges of the present (and the future), renowned authorities from the International Labour Organization and the International Society for Labour and Social Security Law, as well as outstanding labour law professors, examine in depth such salient issues as the following: transformation of production systems; the spread of artificial intelligence; precariousness and exploitation in the gig economy; lessons learned from COVID-19; employment status of platform workers; new cross-border issues; rights to trade union association and collective bargaining; role of the State in the new digital labour market; and blurred lines between work and private life. Thanks to the international team of contributors, the issues are dealt with from a variety of overlapping perspectives and points of view, combining aspects of labour law, commercial law, corporate governance, and international law. Highlighting the need to adapt, especially through the right to training, work, and professionalism with respect to the new technological landscape, the book draws on legislative, judicial, and theoretical initiatives suggesting ways of responding positively to the requests for protection that arise in the new forms of production. A uniquely valuable tool for study and reflection for policymakers and academics, the book is also sure to be valued by entrepreneurs, managers, consultants, corporate lawyers, judges, human rights experts, and trade unionists who are interested in the issues of labour, industrial relations, and social rights in European and international contexts.

Book From Manual Workers to Wage Laborers

Download or read book From Manual Workers to Wage Laborers written by Robert Castel and published by Routledge. This book was released on 2017-07-05 with total page 497 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this monumental book, sociologist Robert Castel reconstructs the history of what he calls "the social question," or the ways in which both labor and social welfare have been organized from the Middle Ages onward to contemporary industrial society. Throughout, the author identifies two constants bearing directly on the question of who is entitled to relief and who can be excluded: the degree of embeddedness in any given community and the ability to work. Along this dual axis the author locates virtually the entire history of social welfare in early-modern and contemporary Europe. This work is a systematic defense of the meaningfulness of the category of "the social," written in the tradition of Foucault, Durkheim, and Marx. Castel imaginatively builds on Durkheim's insight into the essentially social basis of work and welfare. Castel populates his sociological framework with vivid characterizations of the transient lives of the "disaffiliated": those colorful itinerants whose very existence proved such a threat to the social fabric of early-modern Europe. Not surprisingly, he discovers that the cruel and punitive measures often directed against these marginal figures are deeply implicated in the techniques and institutions of power and social control. The author also treats the flipside of the problem of social assistance: namely, matters of work and wage-labor. Castel brilliantly reveals how the seemingly objective line of demarcation between able-bodied beggars those who are capable of work but who chose not to do so and those who are truly disabled becomes stretched in modernity to make room for the category of the "working poor." It is the novel crisis posed by those masses of population who are unable to maintain themselves by their labor alone that most deeply challenges modern societies and forges recognizably modern policies of social assistance. The author's gloss on the social question also offers us valuable perspectives on contempo
