Book excerpt: La regulación de las crisis matrimoniales internacionales en el DIPr. español se ha visto alterada en los últimos años y son previsibles aún cambios en el futuro. En el sector de la competencia judicial internacional, la entrada en vigor de los Reglamentos comunitarios 1347/2000 y 2201/2003 ha implicado transformaciones en el sistema a las que tendremos que añadir las que se deriven de la previsible entrada en vigor del Convenio de La Haya de 1996 en materia de protección de menores. En el ámbito del Derecho aplicable, la reforma en el año 2003 del art. 107 del C.c. ha alterado elementos de la regulación en aquellos puntos que la jurisprudencia había mostrado como problemáticos en los últimos años. Finalmente, en el sector de la eficacia extraterritorial de decisiones nos encontramos, de nuevo, con la necesidad de considerar la incidencia de los Reglamentos comunitarios 1347/2000 y 2201/2003, además de la reciente reforma de la LEC de 1881.

Book excerpt: El mundo actual, globalizado y altamente comunicado, ha traído entre otras consecuencias el aumento del número de matrimonios y familias conectadas a ordenamientos de distintos Estados. Estudiamos aquí, desde la perspectiva jurídica, el universo de las crisis matrimoniales internacionales y sus efectos derivados. Se trata de clarificar el enfoque teórico al que habrá que recurrir ante supuestos de Derecho Internacional Privado, muy frecuentes en la actualidad, que involucran variados instrumentos normativos en su resolución. Instrumentos con origen en la Unión Europea; otros, en organizaciones internacionales; y, cada vez menos, en nuestras normas internas. Es un tema, con un cierto nivel de complejidad, que operadores jurídicos y órganos jurisdiccionales tienen que manejar para dar respuesta a los conflictos matrimoniales y post-matrimoniales con elemento extranjero. De ahí, el interés por conocer las reglas de competencia judicial internacional, reconocimiento y ejecución de resoluciones y la ley aplicable a la crisis matrimonial y a sus cuestiones accesorias: responsabilidad parental, alimentos o régimen económico matrimonial.

Book excerpt: El aumento de la ruptura de los matrimonios transfronterizos en el seno de la UE, así corno la existencia de normas heterogéneas en los Estados miembros obliga al legislador europeo a dictar una serie de Reglamentos encaminados a resolver los problemas que puedan surgir a la hora de determinar el tribunal competente, la ley aplicable al supuesto concreto y al régimen económico matrimonial de los cónyuges en materia de crisis matrimoniales. A la vista de la situación descrita y al objeto de dar certeza y seguridad jurídica a sus ciudadanos, el legislador europeo, desde 2003 hasta 2016, dicta varios Reglamentos, entre los que merece destacar: el Reglamento (CE) 2201/2003, competencia de crisis matrimonial, (UE) 1259/2010, divorcio y separación judicial, ley aplicable, (UE) 2016/1103, régimen económico matrimonial, que favorecen la libre circulación de matrimonios por el territorio comunitario, corrigen las desventajas del cónyuge más débil económicamente para elegir el tribunal y la ley más favorables para evitar el denominado "forurn shopping". En este trabajo de investigación se plasma un estudio pormenorizado sobre dichos Reglamentos.
