This book was released on 2023-07-18 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the relationship between criminal responsibility and social constraints. McConnell argues that a just system of punishment must take into account the constraints placed upon individuals by their social environment, and that criminal responsibility should be defined accordingly. Drawing on both legal and philosophical perspectives, McConnell offers a compelling case for a more nuanced approach to criminal responsibility. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Criminal Responsibility and Social Constraint Among the most expensive functions of government is that which is concerned with the detection, arrest, trial, and punishment of criminals. The expenditures in connection with police, courts, and prisons exceed in amount the outlay for the conservation and improvement of health, the necessities and conveniences of travel and intercourse, highways, parks, and playgrounds, and about equal the costs of education. When any one begins to philosophize about the raison d'être of this enormously expensive arrangement for dealing with crime and criminals, he naturally asks first for its purpose - What is the object of it all? What kind of return does this investment bring in? Society has schools for the ignorant. It has accident stations, ambulance corps, dispensaries, and hospitals for the injured and diseased. It has special educational institutions for the feeble-minded, the blind, the deaf, and the dumb. It has homes for the aged, the infirm, and the incapacitated. Book Freedom and Criminal Responsibility in American Legal Thought

Download or read book Freedom and Criminal Responsibility in American Legal Thought written by Thomas Andrew Green and published by Cambridge University Press. This book was released on 2014-10-27 with total page 519 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the first full-length study of twentieth-century American legal academics wrestling with the problem of free will versus determinism in the context of criminal responsibility, this book deals with one of the most fundamental problems in criminal law. Thomas Andrew Green chronicles legal academic ideas from the Progressive Era critiques of free will-based (and generally retributive) theories of criminal responsibility to the midcentury acceptance of the idea of free will as necessary to a criminal law conceived of in practical moral-legal terms that need not accord with scientific fact to the late-in-century insistence on the compatibility of scientific determinism with moral and legal responsibility and with a modern version of the retributivism that the Progressives had attacked. Foregrounding scholars' language and ideas, Green invites readers to participate in reconstructing an aspect of the past that is central to attempts to work out bases for moral judgment, legal blame, and criminal punishment.

Book Limited Responsibilities

Download or read book Limited Responsibilities written by Tamar Pitch and published by Routledge. This book was released on 2005-08-02 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: Limited Responsibilities explores the interaction between the criminal justice system and the wider concerns of political and social institutions, including the welfare state, social work and forensic psychiatry. Using the key concept of `responsibility', Tamar Pitch critiques the classical theories of Anglo-American and Italian criminologies, examining the allocation of responsibilities to individuals and society. Looking at the shifting political relationship between criminal justice and the welfare system, Pitch considers the problems which arise in our understandings of responsibility, particularly in relation to the young and the mentally disabled. She also documents the centrality of responsiblity as an issue in women's struggles for legislation on sexual violence, as a paradigm of the politicisation of notions of crime, victimization and criminal responsibility. Limited Responsiblities will be of interest to lecturers, students and professionals in criminology, social policy and women's studies.

Book The Assassination of William McKinley

Download or read book The Assassination of William McKinley written by Cary Federman and published by Lexington Books. This book was released on 2017-12-06 with total page 313 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is an examination of the assassination of President William McKinley by Leon Czolgosz, an American-born purported anarchist. This work offers a new and different way to approach historical crime stories. Rather than accepting the idea that Czolgosz was inherently dangerous because of his ethnic background or his obscure political statements, Federman argues, rather, that political relations, historical events, and the developing discourses in the natural and social sciences toward normal and pathological behaviors structured the meaning of the assassination. Federman proposes there are six ways to view an assassin, each corresponding to a social science. Consequently, each chapter of this manuscript examines a social science and its relation to the assassination. Overall, there are three purposes to this work: One is to examine the rise of the social sciences at the time of the assassination. The second is to explore the historical and political understanding of political violence; and the third is to examine the meaning of legal responsibility.
