Book excerpt: This manual is intended to assist federal prosecutors in the preparation and litigation of cases involving the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. §§ 1961 1968. Prosecutors are encouraged to contact the Organized Crime and Racketeering Section (OCRS) early in the preparation of their case for advice and assistance. All pleadings alleging a violation of RICO, including indictments, informations, and criminal and civil complaints, must be submitted to OCRS for review and approval before being filed with the court. Also, all pleadings alleging forfeiture under RICO, as well as pleadings relating to an application for a temporary restraining order pursuant to RICO, must be submitted to OCRS for review and approval prior to filing. Prosecutors must submit to OCRS a prosecution memorandum and a draft of the pleadings to be filed with the court in order to initiate the Criminal Division approval process.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. Book excerpt: Two federal laws, the Racketeering Influenced and Corrupt Organizations Statute (RICO) and the Continuing Criminal Enterprise Statute (CCE), authorize criminal forfeiture of the proceeds of drug trafficking and racketeering activities. Both statutes permit forfeiture not only of property actually held by RICO and CCE defendants, but also may reach assets that these defendants owe or have transferred to third parties. The United States Department of Justice maintains that lawyers fall into this category of third parties, and the Department has sought the forfeiture of fees paid or owed to defense attorneys for professional services rendered on behalf of their clients.In this Article, Professor Morgan Cloud argues that forfeiture of defense attorneys' fees under RICO and CCE would violate a defendant's right to counsel under the sixth amendment. To reach this analysis, Professor Cloud employs a dualistic model that scrutinizes the impact of government conduct both upon the rights of individual defendants and upon the activities of defense counsel as a class. He finds that fee forfeitures would restrict the ability of defense attorneys to perform their institutional role of guaranteeing that the adversary system of justice operates properly. Cloud thus concludes that courts should reject the Justice Department's broad interpretations of the RICO and CCE forfeiture provisions. The right to have the assistance of counsel is too fundamental and absolute to allow the courts to indulge in nice calculations as to the amount of prejudice arising from its denial.
