Book excerpt: "Over its half-century of public life, Roe v. Wade took on meanings that extended far beyond its original purpose of protecting the privacy of the doctor-patient relationship. At various times, it forced us to confront hard questions about judicial activism and restraint, the believability of science, racial justice, the suppression of religion, and much more. Mary Ziegler explores the transformations of meaning that have kept abortion on the front lines of our political and social battles."--

Book Down Will Come Roe Babies and All

Download or read book Down Will Come Roe Babies and All written by Thomas M. Powers JD and published by WestBow Press. This book was released on 2018-05-03 with total page 126 pages. Available in PDF, EPUB and Kindle. Book excerpt: The abortion line of cases is the most flagrant demonstration of the Supreme Courts using sociological jurisprudence (the legal counterpart of political correctness) to gravely undermine the constitution it is sworn to uphold. From the near hallucinogenic opinion in Griswold vs. Connecticut inventing the right of marital privacy to its extension to include killing by abortion, the court has striven to advance the liberal agenda. Legal scholars knew that the court had gone too far and most expected Roe v. Wade to be overruled in Planned Parenthood v. Casey. Although the Supreme Court actually admitted it was wrong, never underestimate the political cowardice of the Supreme Court! The court refused to overrule its admittedly wrong decision because to do so would disappoint certain groups. The journey down the rabbit hole that passes for constitutional law continues as we learn that the court thinks the authors of the constitution should have been more specific, but at least had the insight to know that more politically correct future supreme court would be on hand to correct these perceived deficiencies. Because the concept of liberty interest is itself a recent Supreme Court invention, the court has now given itself carte blanche to do whatever suits those in whose eyes it wishes to be deemed enlightened. The more absurd quotations are directly from the courts own opinions. This trip down the rabbit hole is not for the faint of heart, but it is one that everyone concerned about life, law and the constitution should gird themselves to take.

Book excerpt: ROBBED discusses health care and estate administration policy that often runs contrary to America's Founding Documents including the Constitution, The Bill of Rights, and The Declaration of Independence. There are stories and solutions to policy that many Americans overlook our lives are transformed though rules, codes, or agendas. It is no surprise that America's health care bill continues to escalate and consume nearly 20 percent of the Gross Domestic Product or a astonishing $3.2 trillion. Just as important, nearly $18 trillion dollars will pass through America's probate tribunals over the next decade. Estate Administration is just as big if not a larger business than health care. The salient point is these tribunals are not monitored for fraud, waste, or abuse that runs rampant in this "confidential arena." The victims of crime have virtually no recourse as they are coerced into signing non-disparagement and non-disclosure contracts, to keep the offenders identity secret. This runs adverse to the First Amendment and the Fourteenth Amendment. Victims are denied the opportunity to present evidence in these tribunals in order to divert assets without recourse. While a fraction of these crimes make headlines, the industry is protected from a back lash by the public. ROBBED is a must read for every American. This is not a partisan issue, and fraud, waste, and abuse in both industries will continue to erode our economic stability. The book provides examples, and in no way over generalizes about these timely issues. There are interviews with Dr. Joseph Postell, and the legal authorities granted Athena Roe permission to use their Law Reviews, research materials, and books, Regulatory Chief Neomi Rao, constitutional scholars, Erwin Chemerinsky, Philip Hamburger, Dr. Kevin Dutton, of Oxford University and Dr. Karin Huffer of John Jay Criminal College, Equal Access Advocates, and more . Several chapters present solutions, and review the language of our Founding Fathers. The Bibliography section contains all research articles for further study if readers are inclined to understand the administrative state.

Book Defenses in Contemporary International Criminal Law

Download or read book Defenses in Contemporary International Criminal Law written by Geert-Jan G. J. Knoops and published by BRILL. This book was released on 2008 with total page 373 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Second Edition of "Defenses in Contemporary International Criminal Law" ventures farther into this uneasy territory than any previous work, offering a meticulous analysis of the case law in the post World War II Military Tribunals and the ad hoc tribunals for Rwanda and the Former Yugoslavia, with particular attention to the defenses developed, their rationales, and their origins in various municipal systems. It analyzes the defense provisions in the charters and statutes underlying these tribunals and the new International Criminal Court, while examining the first judgment in this field rendered by the Special Court for Sierra Leone, on June 20, 2007. The conceptual reach of this work includes not only the defenses recognized in the field's jurisprudence and scholarship (superior orders, duress, self-defense, insanity, necessity, mistake of law and fact, immunity of States), but also presents a strong case for the incorporation of genetic and neurobiological data into the functioning of certain defenses. Procedural mechanisms to invoke these defenses are also addressed.

Book Beyond Roe

    Book Details:
  • Author : David Boonin
  • Publisher : Oxford University Press
  • Release : 2019-02-01
  • ISBN : 0190904860
  • Pages : 304 pages

Download or read book Beyond Roe written by David Boonin and published by Oxford University Press. This book was released on 2019-02-01 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: Most arguments for or against abortion focus on one question: is the fetus a person? In this provocative and important book, David Boonin defends the claim that even if the fetus is a person with the same right to life you and I have, abortion should still be legal, and most current restrictions on abortion should be abolished. Beyond Roe points to a key legal precedent: McFall v. Shimp. In 1978, an ailing Robert McFall sued his cousin, David Shimp, asking the court to order Shimp to provide McFall with the bone marrow he needed. The court ruled in Shimp's favor and McFall soon died. Boonin extracts a compelling lesson from the case of McFall v. Shimp--that having a right to life does not give a person the right to use another person's body even if they need to use that person's body to go on living-and he uses this principle to support his claim that abortion should be legal and far less restricted than it currently is, regardless of whether the fetus is a person. By taking the analysis of the right to life that Judith Jarvis Thomson pioneered in a moral context and applying it in a legal context in this novel way, Boonin offers a fresh perspective that is grounded in assumptions that should be accepted by both sides of the abortion debate. Written in a lively, conversational style, and offering a case study of the value of reason in analyzing complex social issues, Beyond Roe will be of interest to students and scholars in a variety of fields, and to anyone interested in the debate over whether government should restrict or prohibit abortion.

Book Handbook for a Post Roe America

Download or read book Handbook for a Post Roe America written by Robin Marty and published by Seven Stories Press. This book was released on 2019-01-15 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: The end of Roe v. Wade is coming. How will you prepare? Handbook for a Post-Roe America is a comprehensive and user-friendly manual for understanding and preparing for the looming changes to reproductive rights law, and getting the healthcare you need—by any means necessary. Activist and writer Robin Marty guides readers through various worst-case scenarios of a post-Roe America, and offers ways to fight back, including: how to acquire financial support, how to use existing networks and create new ones, and how to, when required, work outside existing legal systems. She details how to plan for your own emergencies, how to start organizing now, what to know about self-managed abortion care with pills and/or herbs, and how to avoid surveillance. The only guidebook of its kind, Handbook for a Post-Roe America includes an extensive, detailed resource guide for all pregnant people (whether cis, trans, or non-binary) of clinics, action groups, abortion funds, and practical support groups in each state, so wherever you live, you can get involved. With a newly right-wing Supreme Court and a Republican Senate, Roe is under threat. Robin Marty observes: "When we say abortion will be illegal in half the states in the nation, we are no longer talking about some hypothetical future—we are talking about just years down the road. We have to act now to secure what access remains, shore up the networks supporting those who need care, and decide what risks we are willing to take to ensure that any person who wants a termination can still end that pregnancy—with or without the government's permission."
