Dans le souci de lutter contre le surendettement, la loi précise la responsabilité des prêteurs et intermédiaires lors de l’octroi du crédit : examen de la solvabilité et des facultés de remboursement du consommateur ou de sa caution, vérification des données d’identification, consultation préalable de la Centrale des crédits aux particuliers, interdiction d’introduire une demande de crédit ou d’accorder le crédit s’il apparaît manifestement qu’il ne pourra pas être honoré ponctuellement, ... La conclusion du contrat de crédit obéit à un formalisme strict : nécessité d’un écrit comportant nombre de mentions obligatoires, le cas échéant, soumises à des normes de présentation, exemplaire pour chacune des parties, mentions manuscrites du consommateur, signature, ... Outre la sanction de ce formalisme, est également abordée la question de son adaptation à l’environnement électronique. Le régime des contrats annexes au contrat de crédit suscite pas mal de questions, qu’il s’agisse des contrats d’assurance solde restant dû ou d’autres contrats, tels les contrats d’assurance du bien financé ou l’obligation d’ouvrir un compte bancaire auprès du prêteur ou d’un banquier désigné par celui-ci. Les ouvertures de crédit aux consommateurs connaissent un développement sans précédent ; elles se trouvent aujourd’hui encadrées par de nouvelles règles, telles l’obligation de prévoir un «délai de zérotage», une information plus détaillée sur les relevés de compte mensuels, ou l’interdiction de principe des dépassements du montant du crédit, ... La dénonciation du crédit et la cession de rémunération sont au coeur de nombre de litiges si bien qu’il s’indique aussi de faire le point sur ces thèmes, à la lueur notamment de la jurisprudence récente de la Cour de cassation.

By the 1970s, however, credit in America had been reimagined as a legitimate tool of household finance that was understood to have broad social and economic benefits. This transformation in the moral economy of credit accompanied a revolution in lending technologies and the regulatory treatment of consumer credit. Ultimately, these changes allowed American households to amass unprecedented debt -- debt that eventually precipitated the worst financial crisis of postwar America. To understand the origins of that crisis, we need to understand not just the shifting habits of consumers, but also what happened to lenders as the public moved from opposing credit to embracing it. Professor Frits J. de J ong gathered material for this book since the very beginning of his professional career in the final years of the forties. Unfortunately, the author himself was not able to see the final result of his labours in book form. A mere few weeks after the completion of the manuscript, in November 1976, Professor De Jong passed away. As Hartog and Hennipman wrote in their memorials, Frits de Jong always devoted much attention to the development of concepts and terminology. Throughout his career, he exhibited great determination and perseverance in trying to achieve a clear and consistent terminology, and its subsequent use, in the science of economics. !' 2 That his efforts were mainly aimed at his native language was due to the fact that a language such as Dutch, which is only practiced in a small geographic area, faces the danger of a large-scale introduction of foreign words, specifically English/American, German and French words in this case. He always strongly resisted such a debasement of the Dutch language and sought instead to construct appropriate Dutch words for the existing English, German and French ones. An early example can be found in an article published in De Economist of 1950, entitled "De economische terminologie in het Nederlands" (The Terminology of Economics in Dutch).
