Book excerpt: “The public forum doctrine protects a right of access - “First Amendment easements” - to streets and parks and other traditional places for public expression. It is well known that the doctrine was articulated by the Supreme Court in a series of cases in the 1930s and 1940s. Lesser known are the historical circumstances that surrounded its creation. Critics believed that in a modern world where the mass media dominated public discourse - where the soap box orator and pamphleteer had been replaced by the radio and mass circulation newspaper - mass communications had undermined the possibility of widespread participation in politics, public life, and democratic “public discussion.” The public forum doctrine was one response to this concern. This paper describes the development of the public forum doctrine in the context of a larger story about the nation’s efforts in this period to come to terms with its first modern crisis of communication. This crisis was precipitated by a growing public perception of a fundamental contradiction of mass communications. Without the mass media, a culturally diverse and geographically dispersed public could not communicate across social and spatial boundaries. At the same time, the mass media undermined the public’s ability to communicate meaningfully. The street-corner preacher and town square speaker could not compete with the mass media for a public audience. Poor and disfavored groups could not use the media to express their views, and media owners skewed the news to suit their political interests. This crisis of communication spawned a national debate on the meaning of freedom of speech under the new system of modern mass communications - radio, motion pictures, and mass publishing. The rise of media empires in the 1930s demonstrated how an unregulated press could dominate public discourse, distort public opinion and quash the expression of non-media speakers. Intellectuals and activists on the left offered a theory of the First Amendment as an affirmative state obligation to provide the public with the means to carry out public discussion. This “public forum movement” argued that the state must compel privately-owned media to facilitate the speech of non-media speakers and itself provide alternative means of communication to those unable to access the mass media - it must create “public forums” on the radio, in print journalism, and in public space. A broadcast reform effort in the 1930s pressured the Federal Communications Commission to use its licensing authority to compel radio station owners to present diverse views on public affairs and to represent the interests of minority groups. There were similar, ultimately unsuccessful campaigns to turn newspapers into public forums through right of access laws and balanced content requirements enforced by the state. The public forum doctrine similarly reflected an emerging awareness of the link between material and communicative inequalities in the mass media age. Because average citizens could not access the mass media to express their interests and views, the Court concluded, freedom of speech protects a right to reach a public audience in the streets, commons, and parks.”

Book excerpt: Social media have the potential to revolutionize discourse between American citizens and their governments. At present, however, the U.S. Supreme Court's public forum jurisprudence frustrates rather than fosters that potential. This article navigates the notoriously complex body of public forum doctrine to provide guidance for those who must develop or administer government-sponsored social media or adjudicate First Amendment questions concerning them. Next, the article marks out a new path for public forum doctrine that will allow it to realize the potential of Web 2.0 technologies to enhance democratic discourse between the governors and the governed. Along the way, this article diagnoses critical doctrinal and conceptual flaws that block this path. Relying on insights gleaned from communications theory, the article critiques the linear model underlying public forum jurisprudence and offers an alternative. This alternative model will enable courts to adapt First Amendment doctrines to social media forums in ways that further public discourse. Applying the model, the article contends that courts should presume government actors have created public forums whenever they establish interactive social media sites. Nevertheless, to encourage forum creation, governments must retain some power to filter their social media sites to remove profane, defamatory, or abusive speech targeted at private individuals. Although some will contend that ceding editorial control is no more necessary in social media than in physical forums, the characteristic "disorders" of online discourse, and particularly the prevalence of anonymous speech, justify taking this path.

Book excerpt: As the Supreme Court has recognized, social media sites like Facebook and Twitter have become important venues for users to exercise free speech rights protected under the First Amendment. Commentators and legislators, however, have questioned whether these social media platforms are living up to their reputation as digital public forums. Some have expressed concern that these sites are not doing enough to counter violent or false speech. At the same time, many argue that the platforms are unfairly banning and restricting access to potentially valuable speech. Currently, federal law does not offer much recourse for social media users who seek to challenge a social media provider's decision about whether and how to present a user's content. Lawsuits predicated on these sites' decisions to host or remove content have been largely unsuccessful, facing at least two significant barriers under existing federal law. First, while individuals have sometimes alleged that these companies violated their free speech rights by discriminating against users' content, courts have held that the First Amendment, which provides protection against state action, is not implicated by the actions of these private companies. Second, courts have concluded that many non-constitutional claims are barred by Section 230 of the Communications Decency Act, 47 U.S.C. § 230, which provides immunity to providers of interactive computer services, including social media providers, both for certain decisions to host content created by others and for actions taken "voluntarily" and "in good faith" to restrict access to "objectionable" material. Some have argued that Congress should step in to regulate social media sites. Government action regulating internet content would constitute state action that may implicate the First Amendment. In particular, social media providers may argue that government regulations impermissibly infringe on the providers' own constitutional free speech rights. Legal commentators have argued that when social media platforms decide whether and how to post users' content, these publication decisions are themselves protected under the First Amendment. There are few court decisions evaluating whether a social media site, by virtue of publishing, organizing, or even editing protected speech, is itself exercising free speech rights. Consequently, commentators have largely analyzed the question of whether the First Amendment protects a social media site's publication decisions by analogy to other types of First Amendment cases. There are at least three possible frameworks for analyzing governmental restrictions on social media sites' ability to moderate user content. Which of these three frameworks applies will depend largely on the particular action being regulated. Under existing law, social media platforms may be more likely to receive First Amendment protection when they exercise more editorial discretion in presenting user-generated content, rather than if they neutrally transmit all such content. In addition, certain types of speech receive less protection under the First Amendment. Courts may be more likely to uphold regulations targeting certain disfavored categories of speech such as obscenity or speech inciting violence. Finally, if a law targets a social media site's conduct rather than speech, it may not trigger the protections of the First Amendment at all.

The Computer Science and Telecommunications Board was asked to organize one of these forums, a public forum to gather the views of a variety of government and private sector stakeholders about the impact of spectrum policy on their activities. This report presents a summary of those views. Among those included are those representing national defense, homeland security, aviation, science, public safety, amateur radio, cellular voice and data, and terrestrial broadcast uses of the spectrum. Although prepared by the NRC, the report does not present NRC findings or recommendations. A broader study of spectrum policy, including findings and recommendations, will be issued in early 2005.

Government control over the exchange of ideas and information would be inconsistent with citizen autonomy, informed consent, and a balanced and mutually responsive relationship between citizens and their government. Yet the danger of government dominance must be weighed against the necessary role of government in furthering democratic values by proposing and promotion policies and by disseminating information and educating citizens. Restraints on government's ability to control communications processes are desirable, but excessive or inappropriate restrictions threaten democracy. Professor Yudof identifies a number of formal and informal checks on government as disseminator, withholder, and controller of ideas and information. Where more controls are needed, the strengthening of pluralism and legislative oversight is generally the answer. Constitutional redress in the courts should be sought only in extreme instances, he cautions, to avoid judicial interference with legitimate policy objectives.
