This book is concerned with various ideas of what childhood consists of where the child is involved with the legal system. An identification of legal concepts of childhood can offer many insights into our treatment of children,the capacities which we expect them (possibly unfairly) to possess and the extent of any protection which they deserve or can expect from those charged with the responsibility for their welfare. Each essay in this collection focuses on a particular legal discipline which centrally involves children whether as litigants, victims or perpetrators of crimes, owners of property, recipients of welfare services etc. The object of the analysis is to assess how children are regarded by lawyers in each discipline; for example, as objects of concern, requiring protection; as autonomous possessors of rights; as lacking in moral consciousness or full mental capacity; or as fully aware of and accountable for their actions. In order to make comparisons with notions of childhood in other contexts, the substantive part of the book will also include essays on the perspectives on childhood at the core of other disciplines including sociology, psychology, philosophy and literature.

Book excerpt: The benefits system as it stands often provides incentives to stay on benefits rather than take on a job. This paper identifies the key failings of the benefits system and outlines the objectives the Government believes the system should attempt to achieve. The framework being considered looks at the system of state support for the less well off as a whole and is designed to produce positive behavioural effects. The intention is to maximise work incentives while continuing to protect those most in need. This aim is to achieve this through new rules on how much of their earnings people can keep without losing benefit and by withdrawing benefits as earnings rise at a single, reasonable rate. The models being put forward for consultation include: i) a universal credit whereby elements of the current income-related and tax credit systems are combined, bringing out-of-work and in-work support together in a single system and supplement household earnings through credit payments; ii) a single unified taper would retain a set of benefits with a reformed delivery system whereby withdrawal would be through a taper applied to overall benefit eligibility as income increased; and ii) a single working age benefit which would give all working age claimants the same level of replacement income regardless of whether they were jobseekers, lone parents, sick or disabled. The Government is also looking at how to use smart automation to deliver support without the wasteful bureaucratic delays to payment that make the move into work more stressful than necessary

Book excerpt: The social security system of Great Britain has reached a crossroads, following the election of a Labour Government promising a 'New Age' of welfare and seemingly prepared to 'think the unthinkable' on welfare reform, at a time when public expenditure on welfare benefits has reached nearlyL100 billion per annum. In 1985 the Conservative's Green Paper on social security reform announced that the benefits system had 'lost its way'. Attempts were made to curb benefits expenditure and reduce welfare dependency, for example through better 'targeting' of needs, the reinforcement ofpersonal and family responsibility, and tighter administrative controls. The ten years from 1988 to 1998 saw the introduction of many new benefit schemes including income support, family credit, the social fund, disability living allowance, incapacity benefit, and jobseeker's allowance as well asthe increasing influence of European Law. Yet the system 'achieves too little' according to the new Government's Green Paper on welfare reform, which promises ' a new contract between the citizen and the Government, based on responsibilities and rights'. The precise form these responsibilities andrights will take remains unknown, although we already have schemes like the New Deal and proposals for stakeholder pensions. Meanwhile, social security law continues to impact upon the lives of millions of citizens.After ten years of major legislative change, and with the prospect of a new direction, this is a time to take stock and to analyse the social and legal impact of the past decade's legislation, case law, and policy, as well as considering possible reforms. The book's approach is to organise this taskthematically, particularly with regard to the social context to social security, through discrete chapters on, for example, gender and the family, disability, housing, old age, and unemployment. It is also opportune to examine the theoretical framework of state welfare and social security,particularly in the context of social rights. The book aims to provide an authoritative, contextual and critical account of how British social security law has evolved, how it operates, its substance, and its social effects.
