The Strategy affirms the vital national interest of the United States in maritime security, and recognizes that nations have a common interest in achieving two complementary objectives: to facilitate the vibrant maritime commerce that underpins economic security, and to protect against ocean-related criminal and dangerous acts, including piracy. Our Policy provides that we shall '[c]ontinue to lead and support international efforts to repress piracy ... and urge other states to take decisive action both individually and through international efforts.' Accordingly, this Plan seeks to involve all nations, international organizations, industry, and other entities that have an interest in maritime security to take steps to repress piracy off the Horn of Africa. This Plan's objective is to repress piracy off the Horn of Africa in the interest of the global economy, freedom of navigation, Somalia, and the regional states. Accordingly, this Plan focuses on immediate operational measures to prevent, disrupt, and punish acts of Somali pirate organizations. We intend this Plan to respond to the growing threat and to be mutually supportive of longer-term initiatives aimed at establishing governance, rule of law, security, and economic development in Somalia."

The United States will not tolerate a haven where pirates can act with impunity; it is therefore in our national interests to work with all States to repress piracy off the Horn of Africa. In addition to placing the lives and safety of seafarers in jeopardy, a single piratical attack affects the interests of numerous countries, including the flag State of the vessel, various States of nationality of the seafarers taken hostage, regional coastal States, owners' States, and cargo destination and transshipment States. In the case of Somalia-based piracy, increasingly brazen attacks in 2.5 million square miles of ocean from land-based enclaves along an undergoverned and economically devastated 2,300-mile coast pose a threat to global shipping. This combination of illicit activity and nonexistent rule of law offer a potential breeding ground for other transnational threats. Book excerpt: Recent attacks, including those on U.S.-flagged vessels, in the waters off the Horn of Africa have brought new U.S. and international attention to the long-standing problem of piracy in the region. The increase in pirate attacks off the Horn of Africa is directly linked to continuing insecurity and the absence of the rule of law in war-torn Somalia. The absence of a functioning government in Somalia remains the single greatest challenge to regional security and provides freedom of action for those engaged in piracy along the Somali coast. Some observers also have alleged that the absence of coastal security authorities in Somalia has allowed illegal international fishing and maritime dumping to occur in Somali waters, which in turn has undermined the economic prospects of some Somalis and may be providing economic or political motivation to some groups engaged in piracy. The apparent motive of many active Somali pirate groups is profit, and piracy has proven to be a lucrative activity for many thus far. Most experts believe that the reestablishment of government authority in Somalia is the only guarantee that piracy will not persist or reemerge as a threat. Congress may seek to influence U.S. policy through oversight of U.S. military operations and diplomacy and through foreign assistance appropriations and authorizations.

The seizing of cargo ships and ransom demands have harmful economic impacts to companies and countries. Piracy operations directly threaten U.S. interests and citizens, as displayed during a recent kidnap for ransom action that led to the deaths of four Americans. In addition, piracy affects global trade. Despite significant multinational counter piracy efforts, which has included U.S. agencies and military forces, merchant vessels continue to be pirated regularly. Piracy off the coast of Somalia exists largely because Somalia is a failed state with little to no rule of law or domestic law enforcement capability. The economic situation of the people living in Somalia is dire. A lack of viable employment opportunities, a shortage of arable land, continuing drought, and increasing competition from other nations fishing off the coast, have all affected the standard of living. The conventional wisdom is that the solution lies ashore; meaning the establishment of good governance and economic development in Somalia, but the international community has displayed no interest to engage in nation building. This thesis will describe the challenges and ineffectiveness of current multi-national counter piracy operations and discuss how the international community can best combat piracy in the HOA region from a maritime perspective. By reviewing how states have historically responded to piracy and examining international legal approaches, the author will propose a multi-tiered coalition-based naval force solution, which uses all the traditional advantages of naval power to eliminate piracy without resorting to nation building."--Abstract.

The reason behind this is the failure of the international community to focus on the hub of the region's piracy: the failed state of Somalia. The current maritime effort, though costly compared to the United Nations' and the African Union's mission in Somalia, have produced no significant result so far and may even worsen the situation if expanded with hostage rescue operations and strikes against pirate assets on Somali territory, as this will trigger an escalation in piracy violence, while pushing the piracy organizations into the hand of terrorist groupings like the Al-Shabaab that are increasing their influence on the mainland. The solution remains a comprehensive approach including an extensive stabilization, capacity building, development, and state building effort in Somalia, and though the political will to embark on such a mission may be unattainable at the moment, such an effort is none the less necessary if piracy off the Horn of Africa is to be stopped.

The outbreak of Somali piracy that started in 2008 has prompted a similar revolution in maritime security. Private security companies began operating armed escort vessels to protect merchant shipping against pirates off the Horn of Africa. Private Anti-Piracy Navies is intended to provide a contextualized understanding of the historical origins, current state, and future prospects of this fast-changing sector. Centuries ago, the British East India Company used a private navy against piracy in the same waters with much success. Yet since then, international law has evolved to more tightly regulate the use of force by civilians, and to afford greater protections to suspected pirates. Thus, the development of what are in effect private warships has presented numerous legal and regulatory problems. How can the companies that operate these vessels be effectively licensed? Under what circumstances should they be allowed to use lethal force? This book explains how regulators in industry and government have attempted to answer such questions, and highlights the remaining areas of uncertainty. It also addresses the economic factors that drive the struggle between pirates and anti-piracy forces. Of equal concern are operational considerations such as defensive tactics, logistics, and rules of engagement. Security companies must carefully balance rights concerns against the need to defend ships effectively. Partly due to the contribution of private security, piracy in the Indian Ocean has dropped significantly over the past two years, leading to widespread overconfidence. Governments under severe budget pressure may withdraw their naval task forces from the region prematurely, leading to a resurgence of Somali piracy. At the same time, pirates are wreaking havoc in the Gulf of Guinea off West Africa. The book concludes with an assessment of private naval forces’ prospects in these conflicts over the short term, as well as the implications for wider naval privatization in the long run.
