Book The Legal Theory of Carl Schmitt

Download or read book The Legal Theory of Carl Schmitt written by Mariano Croce and published by Routledge. This book was released on 2013-10-11 with total page 213 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Legal Theory of Carl Schmitt provides a detailed analysis of Schmitt’s institutional theory of law, mainly developed in the books published between the end of the 1920s and the beginning of the 1930s. By reading Schmitt’s overall work through the lens of his institutional turn, the authors offer a strikingly different interpretation of Schmitt’s theory of politics, law and the relation between these two domains. The book argues that Schmitt’s adhesion to legal institutionalism was a key theoretical achievement, based on serious reconsideration of the main flaws of his own decisionist paradigm, in the light of the French and Italian institutional theories of law. In so doing, the authors elucidate how Schmitt was able to unravel many of the impasses that affected his previous conceptual framework. The authors also make comparisons between Schmitt and other leading legal theorists (H. Kelsen, M. Hauriou, S. Romano and C. Mortati) and explain why the current legal debate should take into serious account his legacy.

Book Citizens and Subjects of the Italian Colonies

Download or read book Citizens and Subjects of the Italian Colonies written by Simona Berhe and published by Routledge. This book was released on 2021-12-31 with total page 202 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book on Italian colonialism that specifically deals with the question of citizenship/subjecthood. Such a topic is crucial for understanding both Italian imperial rule and the complex dynamics of the different colonial societies where several actors, like notables, political leaders, minorities, etc., were involved. The chapters gathered in the book constitute an unprecedented account of a heterogeneous geographical area. The cases of Eritrea, Libya, Dodecanese, Ethiopia, and Albania confirm that citizenship and subjecthood in the colonial context were ductile political tools, which were structured according to the orientations of the Metropole and the challenges that came from the colonial societies, often swinging between submission, cooptation to the colonial power, and resistance. On one hand, the book offers an account of the different policies of citizenship implemented in the Italian colonies, in particular the construction of gradated forms of citizenship, the repression and expulsion of dissidents, the systems of endearment of local people and cooptation of the elites, and the racialization of legal status. On the other, it deals with the various answers coming from the local populations in terms of resistance, negotiation, and construction of social identity.

Book Juridical Perspectives between Islam and the West

Download or read book Juridical Perspectives between Islam and the West written by Federico Lorenzo Ramaioli and published by Springer Nature. This book was released on 2024-01-01 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comparative philosophy of law book aims at formulating a new analytical approach to the Islamic legal tradition based on ‘juridical categories’, a concept that facilitates comprehension and understanding of juridical phenomena. Building upon legal comparativism and legal pluralism, this project intends to avoid bias caused by universalizing Western categories when analyzing foreign juridical notions, which inevitably results in the miscomprehension of non-Western ideas and institutions. Unlike existing literature, this project will not focus on substantive comparisons between normative contents, but on the ‘juridical perspectives’ that helped to shape the Islamic and Western legal orders. The book focuses on the most relevant juridical questions regarding the Islamic and Western legal perspectives, such as the different visions regarding juridical spatiality, the role of human reason and the relationship between law, man and the divinity. While contributing to legal philosophy, this work intends also to develop and define a new interdisciplinary approach, aiming to provide a starting point for novel analyses in research fields such as legal comparativism, legal pluralism, and constitutional law. Finally, by formulating a new interdisciplinary approach, it will provide a foundational discussion of a continuously evolving subject that will never be exhaustively explored. As such, it aims at broadening scholarly reflections on the relationship between the West and Islam, eventually placing these concepts within a suitably comprehensive and contextualized framework. Book The Ecosystem Approach in International Environmental Law

Download or read book The Ecosystem Approach in International Environmental Law written by Vito De Lucia and published by Routledge. This book was released on 2019-03-28 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: The ecosystem approach, broadly understood as a legal and governance strategy for integrated environmental and biodiversity management, has been adopted within a wide variety of international environmental legal regimes and provides a narrative, a policy approach and in some cases legally binding obligations for States to implement what has been called a ‘new paradigm’ of environmental management. In this last respect, the ecosystem approach is also often considered to offer an opportunity to move beyond the outdated anthropocentric framework underpinning much of international environmental law, thus helping re-think law in the Anthropocene. Against this background, this book addresses the question of whether the ecosystem approach represents a paradigm shift in international environmental law and governance, or whether it is in conceptual and operative continuity with legal modernity. This central question is explored through a combined genealogical and biopolitical framework, which reveals how the ecosystem approach is the result of multiple contingencies and contestations, and of the interplay of divergent and sometimes irreconcilable ideological projects. The ecosystem approach, this books shows, does not have a univocal identity, and must be understood as both signalling the potential for a decisive shift in the philosophical orientation of law and the operationalisation of a biopolitical framework of control that is in continuity with, and even intensifies, the eco-destructive tendencies of legal modernity. It is, however, in revealing this disjunction that the book opens up the possibility of moving beyond the already tired assessment of environmental law through the binary of anthropocentrism and ecocentrism.

Book Rosmini s Suspended Middle

Download or read book Rosmini s Suspended Middle written by Fernando Bellelli and published by Wipf and Stock Publishers. This book was released on 2024-01-10 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: Antonio Rosmini (1797–1855) was a genius who combined science and sanctity. His contribution turns on the theory of the suspended middle of the original relationship between the natural and the supernatural, which he experienced and elaborated. The device of the relationship between the original metaphysical-affective-symbolic structure of the believing conscience and the affective turn in metaphysics, intrinsically linked to his trinitarian ontology, allowed Rosmini to elaborate theories and epistemologies from a unitary perspective in various fields of knowledge. This volume indicates the implications of the unbreakable bond between Rosmini’s philosophy and theology in disciplines such as pedagogical science, political science, and juridical science. Following the favorable resolution of the “Rosminian question” the Catholic Church beatified Rosmini in 2007 and in 2018 indicated his theoretical-practical approach as a universal education model to be followed. Through essays by major experts in Rosmini’s thought, this curatorship offers an international public a brief, reasoned overview of Rosmini’s thinking on these disciplines, finally translated into English, so that this perspective can be understood and explored with particular regard to the possibility of encouraging ecumenical comparison between Rosmini’s suspended middle and, for example, that of Radical Orthodoxy.

Book Minorities and Populism Critical Perspectives from South Asia and Europe

Download or read book Minorities and Populism Critical Perspectives from South Asia and Europe written by Volker Kaul and published by Springer Nature. This book was released on 2020-02-28 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume assembles renowned scholars to address, for the first time, the relationship between minorities and populism in South Asia and Europe from a critical perspective. Despite the very different and to some extent opposite historical and political trajectories, there is today a convergence on nationalist affirmation and on majoritarian politics between South Asia and Europe. In India, the Hindu majority rebels against wide-ranging minority rights anchored in the Constitution. In Europe, the refugee crisis and Islamic radicalization bring to the forefront the postcolonial legacy. Despite all rhetoric, there are obvious dangers of majoritarianism. Populist parties are divisive, partisan, disregard minority rights, engage in lynching, social division, stigmatization and exclusion, turning minorities into second-class citizens. There is a profound structural connection between minorities and the current rise of populism in India and Europe. But there remains a deep perplexity and also anxiety: Does the presence of minorities necessarily have to trigger majoritarian policies? Are there no solutions to this dilemma? Many observers considered multicultural policies and affirmative action programs in India as a possible model for Europe to adopt in order to achieve greater integration. But eventually they seem to have failed. Why so? Are multiculturalism and the recognition of differences still options today? On the other hand, most scholars in India typically reject the European model of liberal democracy and secularism as impracticable in India and locate the reason for the current malaise in the west. But is liberal democracy really so bad in dealing with pluralism? This volume, collecting a selection of the Reset DOC Venice-Padua-Delhi dialogue series, is going to answer two fundamental questions. First, what precisely is the nexus between minorities and populism in South Asia and Europe? Starting from those case studies, the authors will also draw some general theoretical inferences about the nature of populism. Secondly, given the dangers of populism for minorities, the volume will look for the most adequate and feasible solutions.
