A theoretical explanation is developed based on the hold-up problem in investments, arguing that corporatist institutions solve the problem by specifying ex ante nominal contracts that remove the necessity of ex post bargaining over the surplus of an employment relationship. The authors also argue that such institutions allow sufficient flexibility to accommodate aggregate shocks, even more so than decentralized systems. Corporatism or Competition? is the first book to bring together the mass of research on comparative wage differences, wage movements and employment behaviour in different countries with different institutional frameworks, in an organized and coherent fashion.

Book excerpt: Rather than viewing the history of American capitalism as the unassailable ascent of large-scale corporations and free competition, American Fair Trade argues that trade associations of independent proprietors lobbied and litigated to reshape competition policy to their benefit. At the turn of the twentieth century, this widespread fair trade movement borrowed from progressive law and economics, demonstrating a persistent concern with market fairness - not only fair prices for consumers but also fair competition among businesses. Proponents of fair trade collaborated with regulators to create codes of fair competition and influenced the administrative state's public-private approach to market regulation. New Deal partnerships in planning borrowed from those efforts to manage competitive markets, yet ultimately discredited the fair trade model by mandating economy-wide trade rules that sharply reduced competition. Laura Phillips Sawyer analyzes how these efforts to reconcile the American tradition of a well-regulated society with the legacy of Gilded Age of laissez-faire capitalism produced the modern American regulatory state.

Book excerpt: This paper outlines a larger planned project on the effect of democracy on corporatism in Mexico. The “state corporatism” by which autocratic governments harnessed major societal interests was common in Latin America during much of the 20th century. As the region democratized, theorists expected these tight state-labor bonds to disappear, and in fact organized labor does appear much more fragile today than before the transition. Yet this weakness is most likely a function of economic, not political, liberalization. Rather, this paper posits that corporatism is likely to survive and possibly thrive in new democracies, all else equal. Yet it has been empirically difficult to isolate the effects of democracy from those of economic opening. Furthermore, the relative distinctiveness of the corporatist experience across countries has hindered systematic comparison. A subnational analysis of the education sector in Mexico reduces these problems. Teachers are largely protected from the international competition associated with mobile capital. And the variation in the level of electoral competition across relatively similar Mexican states facilitates comparative analytic leverage. Nevertheless, the strength of corporatism remains difficult to measure. As such, this paper proposes the use of three education policy areas through which the extent of union-government ties can be seen. Preliminary evidence supports the hypothesis that democratization by itself does not undermine corporatism.

Book excerpt: Corporatism, or private interest government, raises objections both from a democratic and from an economic perspective. This paper examines the application of EU competition law to private rule making that is purportedly in the public interest. Earlier case law holding Member States responsible for anticompetitive delegation (Van Eycke) can be contrasted with case law that focuses on the inherent restrictions of the pursuit of public policy aims and keeps some private arrangements outside the scope of the cartel prohibition altogether (Wouters). More recently we can identify an approach where the public and private activities of entities are considered separately (SELEX). The 2014 ONP Case is an example where the General Court distinguishes private and public interests, and takes a tough line where the limits of the latter are exceeded. Corporatism is therefore, to some extent, contained by EU competition law. However, there is a related trend toward taking account of public interest requirements in antitrust under the directly applicable exemption provision of Article 101(3) TFEU. Alongside the abovementioned Wouters approach that requires balancing under Article 101(1) TFEU, and given the context of the decentralisation of EU antitrust law, this raises a risk of fragmentation that remains to be addressed.

Today the U.S. economy is seen as an archetype of a capitalist system in which securities markets play a central role. Moreover, these markets have had a high profile in some of the most dramatic moments in U.S. history, often in the context of crises. Dividends of Development: Securities Markets in the History of U.S. Capitalism, 1865-1922, explains how U.S. securities markets became central to the institutional fabric of U.S. capitalism. After the Civil War, these markets had a narrowly circumscribed relationship to the country's real economy, being largely dominated by railroad securities. Moreover, their role in the U.S. financial system was of limited significance given the relatively modest resources that financial institutions committed to investment in, and lending on, corporate securities. That situation was to undergo fundamental change from the Civil War through the end of World War 1 but the development of U.S. securities markets did not occur as a result of a smooth, or even, linear process. Instead, the book shows that the transformation of U.S. securities markets occurred through a process that was volatile and time-consuming, unscripted by powerful actors, and driven, above all else, by the dramatic but unstable character of the nation's economic development. These claims about the trajectory, the operation, and the underlying dynamics of the development of U.S. securities markets are brought together in a novel synthesis that portrays the historical evolution of securities markets in the United States as the "dividends" of the country's distinctive trajectory of economic development.
