Book Civil Procedure

Download or read book Civil Procedure written by A. Benjamin Spencer and published by Ingram. This book was released on 2015 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Revised 4th Edition of Civil Procedure: A Contemporary Approach is updated with references to the 2015 amendments to the Federal Rules of Civil Procedure, as well as case law developments since the 2014 publication date of the Fourth Edition. Major recent case law developments included in this revised edition consist of decisions from the Supreme Court addressing personal jurisdiction (Goodyear Dunlop Tires Operations, S.A. v. Brown, 131 S. Ct. 2846 (2011), J. McIntyre Machinery, Ltd. v. Nicastro, 131 S. Ct. 2780 (2011), and Daimler AG v. Bauman, 134 S. Ct. 746 (2014)), federal question jurisdiction (Gunn v. Minton, 133 S. Ct. 1059 (2013)), removal of class actions (Standard Fire Ins. Co. v. Knowles, 133 S. Ct. 1345 (2013)), change of venue and forum-selection clauses (Atl. Marine Constr. Co., Inc. v. U.S. Dist. Court for W. Dist. of Texas, 134 S. Ct. 568 (2013) [now a principal case]), class certification (Wal-Mart Stores, Inc. v. Dukes, 131 S. Ct. 2541 (2011), Comcast Corp. v. Behrend, 133 S. Ct. 1426 (2013), Amgen Inc. v. Conn. Ret. Plans & Trust Funds, 133 S. Ct. 1184 (2013)), class arbitration waivers (AT&T Mobility LLC v. Concepcion, 131 S. Ct. 1740 (2011) and American Express Co. v. Italian Colors Restaurant, 133 S. Ct. 2304 (2013)), and offers of judgment (Genesis HealthCare Corp. v. Symczyk, 133 S. Ct. 1523 (2013)). Regarding the 2015 amendments to the Federal Rules of Civil Procedure, this revised edition makes reference to them in the text where appropriate. The changes include the "Duke Rules" package, which alters Rules 1, 4, 16, 26, 30, 31, 33 and 34 to make proportionality a main component of the scope of discovery, to eliminate access to subject matter discovery, require early discussions regarding preservation and privilege protection, permit early document requests, and shorten the time permitted to issue scheduling orders and to achieve service of process. The amendment to Rule 37 codifies an approach to preservation and spoliation that favors curative measures unless there is intentional spoliation, in which case more severe sanctions such as adverse inference instructions or dismissal become available. This edition also fully incorporates recent amendments to the Federal Rules of Civil Procedure and to Title 28 of the U.S. Code, including the Federal Courts Jurisdiction and Venue Clarification Act of 2011 and the 2013 amendment to Rule 45 (subpoenas). Finally, the Revised Fourth Edition integrates references to online assessment tools in the Casebook Plus platform. These consist of a bank of 200 multiple-choice questions that provide comprehensive assessment of the topics covered in this book, with detailed feedback consisting of explanations for both correct and incorrect responses. This feature provides an unparalleled opportunity to engage with the material actively as the course progresses and permits students and professors to determine the extent to which the material is being learned.

Book Corporation Nation

Download or read book Corporation Nation written by Charles Derber and published by St. Martin's Press. This book was released on 2014-09-09 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foreword by Ralph Nader. In Corporation Nation Derber addresses the unchecked power of today's corporations to shape the way we work, earn, buy, sell, and think—the very way we live. Huge, far-reaching mergers are now commonplace, downsizing is rampant, and our lines of communication, news and entertainment media, jobs, and savings are increasingly controlled by a handful of global—and unaccountable—conglomerates. We are, in effect, losing our financial and emotional security, depending more than ever on the whim of these corporations. But it doesn't have to be this way, as this book makes clear. Just as the original Populist movement of the nineteenth century helped dethrone the robber barons, Derber contends that a new, positive populism can help the U.S. workforce regain its self-control. Drawing on core sociological concepts and demonstrating the power of the sociological imagination, he calls for revisions in our corporate system, changes designed to keep corporations healthy while also making them answerable to the people. From rewriting corporate charters to altering consumer habits, Derber offers new aims for businesses and empowering strategies by which we all can make a difference.

Book The Corporation

Download or read book The Corporation written by Grietje Baars and published by Cambridge University Press. This book was released on 2017-03-24 with total page 1245 pages. Available in PDF, EPUB and Kindle. Book excerpt: The corporation has become an increasingly dominant force in contemporary society. However, comprehensive, in-depth analysis of the concept of the corporation is often restricted, or limited to one disciplinary approach. This handbook brings together the cutting-edge scholarship, expertise and insight of leading scholars in a wide range of disciplines, notably management studies, law, history, political science, anthropology, sociology and criminology, using a critical approach to dissect and understand the corporation. Ten chapters provide overviews of the state of play of critical scholarship on the corporation in each of these disciplines. Further contributors tackle current hot topics, such as corporate social responsibility, corporate crime, global value chains, financialization, and the interaction between corporations and communities. Finally, they consider resistance and alternatives to the corporation. With its interdisciplinary approach, this book is an invaluable resource for all readers studying the past, present and future of the corporation.

Book Reconstructing the Corporation

    Book Details:
  • Author : Grant M. Hayden
  • Publisher : Cambridge University Press
  • Release : 2021-03-11
  • ISBN : 1108916198
  • Pages : 289 pages

Download or read book Reconstructing the Corporation written by Grant M. Hayden and published by Cambridge University Press. This book was released on 2021-03-11 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: Modern corporations contribute to a wide range of contemporary problems, including income inequality, global warming, and the influence of money in politics. Their relentless pursuit of profits, though, is the natural outcome of the doctrine of shareholder primacy. As the consensus around this doctrine crumbles, it has become increasingly clear that the prerogatives of corporate governance have been improperly limited to shareholders. It is time to examine shareholder primacy and its attendant governance features anew, and reorient the literature around the basic purpose of corporations. This book critically examines the current state of corporate governance law and provides decisive rebuttals to longstanding arguments for the exclusive shareholder franchise. Reconstructing the Corporation presents a new model of corporate governance - one that builds on the theory of the firm as well as a novel theory of democratic participation - to support the extension of the corporate franchise to employees.

Book A Christian Approach to Corporate Religious Liberty

Download or read book A Christian Approach to Corporate Religious Liberty written by Edward A. David and published by Springer Nature. This book was released on 2020-09-21 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses one of the most urgent issues in contemporary American law—namely, the logic and limits of extending free exercise rights to corporate entities. Pointing to the polarization that surrounds disputes like Burwell v. Hobby Lobby, David argues that such cases need not involve pitting flesh-and-blood individuals against the rights of so-called “corporate moral persons.” Instead, David proposes that such disputes should be resolved by attending to the moral quality of group actions. This approach shifts attention away from polarizing rights-talk and towards the virtues required for thriving civic communities. More radically, however, this approach suggests that groups themselves should not be viewed as things or “persons” in the first instance, but rather as occasions of coordinated activity. Discerned in the writings of Saint Thomas Aquinas, this reconceptualization helps illuminate the moral stakes of a novel—and controversial—form of religious freedom.

  • Author : Amanda Porterfield
  • Publisher : Oxford University Press

  • ISBN : 0199372675
  • Pages : 240 pages

Download or read book Corporate Spirit written by Amanda Porterfield and published by Oxford University Press. This book was released on 2018-03-01 with total page 240 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this groundbreaking work, Amanda Porterfield explores the long intertwining of religion and commerce in the history of incorporation in the United States. Beginning with the antecedents of that history in western Europe, she focuses on organizations to show how corporate strategies in religion and commerce developed symbiotically, and how religion has influenced the corporate structuring and commercial orientation of American society. Porterfield begins her story in ancient Rome. She traces the development of corporate organization through medieval Europe and Elizabethan England and then to colonial North America, where organizational practices derived from religion infiltrated commerce, and commerce led to political independence. Left more to their own devices than under British law, religious groups in the United States experienced unprecedented autonomy that facilitated new forms of communal governance and new means of broadcasting their messages. As commercial enterprise expanded, religious organizations grew apace, helping many Americans absorb the shocks of economic turbulence, and promoting new conceptions of faith, spirit, and will power that contributed to business. Porterfield highlights the role that American religious institutions played a society increasingly dominated by commercial incorporation and free market ideologies. She also shows how charitable impulses long nurtured by religion continued to stimulate reform and demand for accountability.
