In particolare, nell’ottica di coniugare lo studio degli schemi tradizionali del diritto penale con le ineludibili esigenze di un costante aggiornamento, sono stati aggiunti tre nuovi capitoli, uno dedicato ai delitti in tema di terrorismo internazionale, per i quali si impone la necessità di conciliare le istanze di tutela collettiva con il rispetto dei principi di offensività e legalità, un altro in materia di reati-contratto, tema che conferma l’utilità del dialogo del diritto penale con il diritto civile e in generale con gli altri rami dell’ordinamento, e infine un altro avente ad oggetto una prima esegesi della recente legge sul cd. capolarato (n. 199 del 26 ottobre 2016), che ha affrontato con strumenti in parte innovativi un antico problema di grave allarme sociale. Nell’ambito degli originari capitoli, invece, si è tenuto conto delle principali novità registratesi nell’ultimo anno, sia in ambito legislativo, ad esempio con i provvedimenti in tema di depenalizzazione e la legge sull’omicidio stradale, sia in ambito giurisprudenziale, dovendosi richiamare al riguardo, a titolo esemplificativo, i primi interventi della Suprema Corte in tema di autoriciclaggio e di reati ambientali, o ancora il non agevole dialogo tra le Corti in materia di ne bis in idem. L’attenzione, dunque, si focalizza su aspetti speciali delle tre materie (diritto civile, penale e amministrativo), partendo, normalmente, da precedenti giurisprudenziali o legislativi più recenti, per poi ricostruire il complessivo sistema ordinamentale al cui interno si inscrive la peculiare disciplina di riferimento. Su questa scia, quindi, per il diritto civile l’attenzione viene focalizzata sui contratti tipici, come il contratto di vendita e le questioni relative ai vizi del bene, sul leasing, di cui è ancora dubbia l’avvenuta tipizzazione, sulle nullità selettive nei contratti di intermediazione finanziaria, o, con riguardo allo specifico settore delle successioni, sulla natura della divisione ereditaria. Sul versante del diritto penale sono state approfondite specifiche questioni relative a reati di parte speciale o di recente conio, con particolare riferimento alle novità giurisprudenziali in materia di stupefacenti (si pensi al tema della commercializzazione della cannabis sativa o alla configurabilità della fattispecie di lieve entità), di misure di prevenzione, con le ripercussioni sul principio di legalità, di continuazione, di confisca e lottizzazione abusiva, oltre che di pedopornografia e “revenge porn”. Su quello del diritto amministrativo, si è cercato di approfondire lo specifico tema dei contratti pubblici, crocevia di molteplici problematiche, dell’espropriazione e della dismissione del diritto di proprietà implicita nella richiesta di risarcimento del danno da perdita del bene, del potere discrezionale della p.a. di localizzazione degli edifici di culto, nonché il tema sempre più attuale della tutela dell’ambiente, dell’obbligo di bonifica e del risarcimento del danno ambientale, oltre a specifici aspetti del processo amministrativo (l’annosa questione del ricorso incidentale e del rapporto con il ricorso principale alla luce della recente giurisprudenza della corte di giustizia, nonché il tema dell’eccesso di potere giurisdizionale).

Nonetheless, the evolving complexity of criminal skills and networks; the increasingly global dimension of crime; the financial crisis; and the alleged unsatisfactory results of the efforts hitherto undertaken cause us to re-pose and re-discuss some questions. This book addresses several issues concerning the reasons, objectives and scope of national and supranational strategies targeting criminal money, as well as the concrete modalities to overcome its obstacles. The main objective is to explore where the EU stands and where it ought to go, providing useful input for policy-makers and further research. Nevertheless, the problems are not limited to the EU area, and assets – particularly money – cross EU borders much more easily than people do. The reflections developed in the chapters, therefore, aim at going beyond these EU borders. The book is divided into two parts. The first one focuses on the core of asset recovery policies, namely confiscation or forfeiture laws, and explores in particular some issues concerning the respect of fundamental rights.
