Book excerpt: Le présent ouvrage propose une approche comparée entre les pratiques de délivrance de l'Office européen des brevets (OEB) et la jurisprudence judiciaire française. L'approche comparatiste a pour objectif de mettre en lumière les divergences et les convergences de pratiques et d'interprétation des textes légaux relatifs à la brevetabilité des inventions : exception, exclusions, conditions de brevetabilité (notion d'invention, nouveauté, activité inventive, application industrielle). Le point de vue adopté permet à la fois, d'un point de vue fondamental, d'analyser les méthodes d'interprétation adoptées par les différents acteurs, mais également, d'un point de vue plus concret, d'en tirer des conséquences en termes de "bonnes pratiques" pour les offices de brevet, les entreprises industrielles qui déposent des brevets, les conseils en propriété industrielle qui les accompagnent dans ce processus. Ainsi, au terme d'une démarche qui est à la fois scientifique et didactique, le lecteur bénéficiera d'une information complète et à jour sur l'ensemble des questions de brevetabilité. Pour ce faire, une coopération étroite entre les différents acteurs de la propriété industrielle est apparue nécessaire afin de mener l'analyse proposée. Car il va de soi que cette démarche ne peut pas se faire de manière isolée, mais doit être entreprise en parfaite synergie avec les principaux acteurs de la propriété intellectuelle : le monde socio-économique (ingénieurs brevet d'entreprises industrielles, décideurs, conseils en propriété industrielle, avocats), les membres institutionnels (membres de l'INPI, de l'Organisation mondiale de la propriété intellectuelle (OMPI), de l'Office européen des brevets (OEB), de l'Office communautaire des variétés végétales (OCVV), ainsi que des universitaires (étudiants, doctorants, enseignants-chercheurs). Sont ainsi développés différents axes d'interventions : la protection conférée par le brevet européen, les procédures européenne et française de délivrance, l'invention brevetable et non brevetable, les conditions de brevetabilité. L'ensemble des contributions sont issues d'une webconférence organisée le 13 avril 2021 par le Centre d'études internationales de la propriété intellectuelle (CEIPI).

Dans un second temps, sont examinées les évolutions, positives ou négatives, que l'économie mondialisée risque de produire ou a déjà commencé de produire sur le droit actuel, de même que les réactions qu'elle suscite, ou devrait susciter, à tort ou à raison. Pour mener ces réflexions, les Académies ont fait appel aussi bien à des intervenants issus du monde de l'industrie qu'à des chercheurs et universitaires, mais également à des représentants de cabinets de brevets, de l'Office européen des brevets et de la Commission européenne. D'élément d'une stratégie d'entreprise à une stratégie d'État, le droit des brevets, souvent encore national, est confronté à cette économie mondialisée. De celle-ci découle également la multiplication des acteurs intervenant dans ce champ d'action traditionnellement restreint aux relations entre inventeurs et employeurs d'une part, brevetés et licenciés d'autre part. Le monopole accordé par le brevet est-il à remettre en cause ou doit-il être modifié du fait de cette évolution ? Autant de questions auxquelles le présent ouvrage contribue à répondre.
