The project is based on the idea that contemporary examples of regionalism should be evaluated against several propositions of multiple integration theories rather than against a single theory. In order to systematically explain why and how integration outcomes in MERCOSUR differ from those in the EU, the author develops an analytical framework for the comparison of the two blocs. MERCOSUR is compared with the EU by the use of the various criteria of economic interdependence, economic convergence, intra-bloc size and interest asymmetries, cultural diversity and geostrategic motivations, which are identified as the salient parameters of integration theories.

Book excerpt: The focus of this book is the judicial institutionalization of integration processes through the development of dispute settlement mechanisms, more especifically in the Common Market of the South (MERCOSUR), to date, the most important regional bloc in Latin America. The bloc has been in existence since 1991 and has positioned itself as one of the potential regional blocs for trade and investment, while becoming one of the important actors in the international community. However, its achievements have been tainted by the gaps and problems attached to the core foundation of the regional bloc. MERCOSUR has been suffering or experiencing internal disputes and disunity due to its complex and low institutionalization, a situation which can be seen as being paradoxical. Its current Dispute Settlement Mechanism is subject to uncertainty and doubt, since its own framework is also under internal and external criticism. There has been a series of protocols made in order to tackle the problems of the DSM and to further fix the problems that hinder the cooperation as well as the productivity of MERCOSUR's intra-organisation, all guided by intergovernmental decision-making. As such, this book seeks to tackle the concept of regionalism and the possible models which have been used or have influenced the establishment of MERCOSUR, while discussing the different aspects and developments of each intra-organisation. This is done in order to evaluate the nature of the problem, and future developments that could take place. The book also focuses on the prevalence of politicization in MERCOSUR and the pre-eminence of Presidential Diplomacy over the path of regional integration, which influence the DSM of MERCOSUR and possible developments that might occur in the near future.

In recent years, the economic and political projects of Latin American States have become increasingly dependent on the extractive industries. This has resulted in conflicts when governments and international firms have made considerable investments in those lands that have been traditionally inhabited and used by Indigenous Peoples, who seek to defend their rights against exploitative practices. After decades of intense mobilisation, important gains have been made at international level regarding the opportunity for Indigenous Peoples to have a say on these matters. Notwithstanding this, the right to prior consultation and the FPIC of Indigenous Peoples on the ground are far from being fully applied and guaranteed. And, even when prior consultation processes are carried out, the outcomes remain uncertain. This volume rigorously investigates the causes of this implementation gap and its consequences for the protection of Indigenous Peoples’ rights, lands, identities and ways of life in the Latin American region. The national reports focus on the interaction of tax rules in non-tax agreements with the corresponding tax treaty rules.
