Book excerpt: The book discusses how labour law and welfare systems will be affected by the ongoing transformation of work. The first section considers demography from two different perspectives. On the one hand, it focuses on chronic diseases and their impact on work, emphasising the role and the regulation of welfare systems. On the other, attention is given to youth unemployment and to those forms of employment which might have an impact on young people. Section II touches upon the relationship between the environment and industrial relations, while the third part broaches the topic of the impact of technology in the context of the Fourth Industrial Revolution, also known as Industry 4.0. Download or read book The Lisbon Treaty and Social Europe written by Niklas Bruun and published by Bloomsbury Publishing. This book was released on 2012-05-08 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: On 1 December 2009 the Treaty of Lisbon entered into force. Although often described as primarily technical, it significantly amended the Treaty on the European Union (TEU) and the old EC Treaty (now the Treaty on the Functioning of the European Union, TFEU). The authors' aim in this book is to explore what the Treaty means for social law and social policy at the European level. The first part of the book on the general framework looks - at a time of financial crisis - for new foundations for Europe's Social market economy, questions the balance between fundamental social rights and economic freedoms, analyses the role of the now binding Charter of Fundamental Rights, maps the potential impact of the horizontal clauses on social policy and addresses the possibilities for social partners to enlarge their role in labour law and industrial relations. The second part, on the social framework of the Treaty, focuses on the development of the Union's competences. In it the authors evaluate the consequences of the new general framework on social competences, analyse the evolution of the principle of subsidiarity and its impact in the new Treaty, look at the coordination of economic policies in the light of fundamental rights, and analyse the adoption in the Treaty of a new architecture for services of general interest.

Book excerpt: `Everyone concerned over the construction of a truly social Europe will learn much from this thoughtful and probing study." - Professor Colin Crouch, Istituto Universitario Europeo In this comprehensive overview of trade unionism in Europe and beyond, Richard Hyman offers a fresh perspective on trade union identity, ideology and strategy. He shows how the varied forms and impact of different national movements reflect historical choices on whether to emphasize a role as market bargainers, mobilizers of class opposition or partners in social integration. The book demonstrates how these inherited traditions can serve as both resources and constraints in responding to the challenges which confront trade unions in

Download or read book The Transformation of Labour Law in Europe written by Bob Hepple and published by Bloomsbury Publishing. This book was released on 2009-09-02 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: The labour laws of European democracies all underwent major transformations in the seven decades after the Second World War. Following reconstruction, these laws became an essential element in the building of welfare states; in the 1980s and 1990s they were the target of neo-liberal deregulation; and at the beginning of the 21st century new 'flexible' labour laws have attempted to integrate economic and social policy. This book, a sequel to 'The Making of Labour Law in Europe- A Comparative Study of Nine Countries up to 1945' (ed. B Hepple), compares the similarities and differences in the ways in which EU Member States reflected and shaped these general developments, in the context of economic, social and political changes over the period 1945-2004. Note: the Publishers are issuing a reprint of the first volume, 'The Making of Labour Law in Europe - A Comparative Study of Nine Countries up to 1945' to coincide with publication of the sequel. The great strength of the collection is on the focus on context, with chapters looking at developments in labour market trends and structures of worker represntation.
Download or read book The Economic and Financial Crisis and Collective Labour Law in Europe written by Niklas Bruun and published by Bloomsbury Publishing. This book was released on 2014-09-18 with total page 521 pages. Available in PDF, EPUB and Kindle. Book excerpt: The current economic and financial crisis erupted several years ago. Its effects impacted deeply upon society, in which legal rules and social patterns have developed to enable the establishment of civilisation, justice and peace. Over time it has become more and more obvious that policy, financial and economic actors have adopted austerity measures as a main tool to solve the ensuing problems, and that these measures have hit social policy standards sometimes dramatically. Recent analyses have dealt with several aspects of this issue. This book focuses on one important element: the impact on collective labour law. It seeks to add to the debate by presenting mainly legal arguments derived from different sources and backgrounds, examining the EU and 'Troika' measures, the economic and political background and the sometimes dramatic consequences of austerity measures on democracy, collective bargaining and the right to strike. Against the framework of EU law, the relevant ILO Conventions, (Revised) European Social Charter and European Convention on Human Rights provisions, the non-compliance of these measures is analysed and demonstrated. The book is also dedicated to procedural questions, and in particular, how legal approaches may be used to challenge austerity measures.

Download or read book The Diversity of Democracy written by Colin Crouch and published by Edward Elgar Publishing. This book was released on 2006-01-01 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is an important volume by authoritative authors that raises important questions about democracy. It demands extended attention and will stimulate debate. Wyn Grant, Political Studies Review This timely book fills a void in the literature on interest group representation in democracies. Contributors address various topics in democratic development and interest group representation in a manner that is both broadly comparative and attentive to in-depth case studies. . . . Overall, this is a great addition to the literature on democratic consolidation with a neo-corporatistic focus. Highly recommended. B.A Yesilada, Choice At a time when democratization and the state of democracy are at the forefront of attention in many parts of the world, this book examines the state-of-the-art on this vital political issue. Revisiting the now classical literature on neo-corporatism in light of current research and theory, the contributors illustrate the enormous influence of the neo-corporatist debate on modern political science, political sociology, and political economy. Reflecting on a major part of the recent history of social science, they shed light on some of its current core concepts, such as governance, policy networks, and varieties of capitalism. The book traces the evolution of political conflicts concerning social order; from the class conflicts in Europe in the of 1970s Europe to the subsequent Latin American and Eastern European battles over democratization and democratic transition, to the debate on the democratic deficit of the European Union. Paying tribute to the work of Philippe Schmitter, which bridges the themes discussed in the book and which has provided inspiration to an entire generation of social scientists, The Diversity of Democracy will be invaluable to academics, students and researchers with an interest in political science, democratic theory, European integration and the study of democratic transitions as well as Latin American and Eastern European studies.
Download or read book Viking Laval and Beyond written by Mark R Freedland and published by Bloomsbury Publishing. This book was released on 2015-01-29 with total page 596 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU Law in the Member States is a new series dedicated to exploring the impact of landmark CJEU judgments and secondary legislation in legal systems across the European Union. Each book will be written by a team of generalist EU lawyers and experts in the relevant field, bringing together perspectives from a wide range of different Member States in order to compare and analyse the effect of EU law on domestic legal systems and practice. The first volume focuses on the uneasy relationship between the economic freedoms enshrined in Articles 49 and 56 TFEU and the right of workers to take collective action. This conflict has been at the forefront of EU labour law since the CJEU's much-discussed decisions in C-438/05 Viking and C-341/05 Laval, as well as the Commission's more recent attempts at legislative reforms in the failed Monti II Regulation. Viking, Laval and Beyond explores judicial and legislative responses to these measures in 10 Member States, and finds that the impact on domestic legal systems has been much more varied than traditional accounts of EU law would suggest.
Download or read book Capitalists Against Markets written by Peter A. Swenson and published by Oxford University Press. This book was released on 2002-09-26 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conventional wisdom argues that welfare state builders in the US and Sweden in the 1930s took their cues from labor and labor movements. Swenson makes the startling argument that pragmatic social reformers looked for support not only from below but also from above, taking into account capitalist interests and preferences. Juxtaposing two widely recognized extremes of welfare, the US and Sweden, Swenson shows that employer interests played a role in welfare state development in both countries.
Download or read book European Legal Method written by Ulla Boegh Neergaard and published by Djoef Publishing. This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the extent to which it is possible to identify a coherent legal method (a doctrine of the sources of law and their interpretation) that may be applied when analyzing EU law and the law of EU Member States. European Legal Method: Paradoxes and Revitalisation looks at what characterizes the sources of law and the interpretation methods that are actually used by European legal actors, especially judges and researchers. It examines the changes in the relative importance of various sources of law that occur in connection with the integration of EU law into national law.
