L’objet de cette recherche est de scruter les questions juridiques soulevées par cette pratique, qui a d’abord un objectif économique et financier. Il s’agit, pour certains opérateurs, d’utiliser les contrats leur confiant une activité principale pour développer une activité accessoire à celle-ci et ce, dans le but de générer des recettes supplémentaires. Longtemps cette activité accessoire est apparue comme un phénomène marginal, d’où sa large ignorance par la doctrine qui ne lui a jusqu'ici consacré aucune étude spécifique. Au contraire, la recherche a révélé, dans l’activité accessoire, une situation fréquente et de grande ampleur. La présente étude met donc en lumière cette activité et fournit désormais aux parties cocontractantes les moyens de l’identifier mais aussi de l’appréhender tant dans son environnement contractuel que dans son environnement normatif. La diversité des situations étudiées crée un véritable régime juridique de l'activité accessoire du cocontractant de l'administration et constitue par la même une invitation à rompre avec une conception traditionnelle du contrat, essentiellement focalisée sur son objet principal. L'activité accessoire du cocontractant n'est pas aussi accessoire qu'il y paraît. Elle peut même, à l'occasion, constituer un contrat caché dont ni le juriste, ni l'administration ne peuvent se désintéresser plus longtemps, spécialement en ces temps de pénurie budgétaire.

The rule of law in international affairs is a question of perennial concern but it is of greater moment these days for a number of reasons. The active agenda of the Security Council and its relative solidarity creates a paradox. Its increased political power is a source of hope but the modalities of the exercise of power present problems of principle and of legal concern. Another area of concern is the International Court, which has had a successful record since the early eighties and provides one of the guarantees of the maintenance of legality. Recent successes of the Court include the effective resolution of the territorial dispute between Chad and Libya. The general level of compliance with its decisions by States is impressive. Yet its success is matched not by encouragement and enhancement of its facilities but by United Nations financial constraints which hinder its work and, ultimately, may threaten its independence in relation to the political organs of the United Nations.
