Book excerpt: La Ley de Contratos del Sector Público, cuya entrada en vigor se produjo el 30 de abril de 2008, ha introducido profundas modificaciones en el ámbito de la contratación pública, no sólo desmaterializando los procedimientos de adjudicación (perfil de contratante, plataforma de contratación del Estado, factura electrónica, subasta electrónica...etc), sino también modificando profundamente los procedimientos a seguir por los Poderes adjudicadores para la adjudicación de los contratos públicos, obligando a los Poderes adjudicadores a seleccionar, como adjudicatario del contrato, al licitador que haya presentado la "oferta económicamente más ventajosa", y exigiéndoles, en todo caso, que den un tratamiento igualitario y no discriminatorio a licitadores y candidatos, a los que deberán garantizar libertad de acceso a las licitaciones, dando publicidad y observando una total transparencia en los procedimientos que han de seguir en la adjudicación de los contratos del Sector público. Este libro, aunque dedicado al "Contrato de obras públicas", recuerda que para ser Contratista hay que ser previamente licitador, lo que le lleva a realizar un obligado estudio de los complejos procesos administrativos que se han de seguir hasta llegar a la adjudicación definitiva del contrato, por lo que dedica todo un capítulo a analizar y describir secuencialmente, el tortuoso iter procedimental que los Poderes adjudicadores han de observar desde que se inicia la elaboración del expediente de contratación, que dará paso a su licitación, recursos, en su caso, siendo de especial trascendencia la actuación de la Mesa de Contratación, ya que ha de seleccionar al licitador que haya presentado la "oferta económicamente mas ventajosa", para finalizar con el acuerdo del Órgano de Contratación efectuando la adjudicación provisional y la adjudicación definitiva, sin perjuicio de la resolución que del recurso especial de contratación, en su caso, interpongan las personas físicas y jurídicas, así como los licitadores, cuyos derechos e intereses legítimos se hayan visto perjudicados o puedan resultar afectados por las decisiones objeto del recurso, debiendo terminar el iter procedimental con la formalización, en documento administrativo, del contrato, que dará paso, finalmente, al inicio y consiguiente ejecución del contrato, finalidad última y primordial de todo el proceso licitatorio. La ejecución del "Contrato de obras públicas" está sujeta al "principio de riesgo y ventura" que invade, aunque atenuado por los posibles casos de fuerza mayor, toda la actividad del Contratista, actividad que ha de estar dirigida a un solo fin: la ejecución, según el proyecto aprobado y vigente, de la obra contratada. El Contratista tiene derecho al abono de la obra ejecutada, en los términos establecidos en el contrato, con arreglo al precio convenido. Para ello, la Dirección facultativa ha de medir y valorar al origen, todos los meses, la obra ejecutada, expidiendo, con la periodicidad establecida en el "pliego cláusulas administrativas particulares", a efectos del pago, la correspondiente "certificación de obra". La "certificación de obra", documento administrativo, acredita la obra ejecutada por el Contratista que le debe ser abonada en el plazo innegociable de sesenta días naturales, siendo documento suficiente, no sólo para el reconocimiento de la obligación por las Administraciones Públicas sujetas a Presupuesto, sino también a efectos de la transmisión del derecho de cobro que lleva incorporado, así como, en su caso, de su compensación tributaria. El contrato concluye, normalmente con el acto de recepción de conformidad de la obra, extinguiéndose así la obligación principal del Contratista, y dando paso al plazo de garantía, durante cuyo período el Contratista sólo está obligado a reparar los defectos que en las obras puedan advertirse, pero no a ejecutar obra alguna, finalizando el mismo, normalmente, con el "Informe favorable sobre el estado de las obras" del Director facultativo, con lo que también se extingue esta obligación accesoria de la principal. Finalizado el plazo de garantía ya sólo le queda al Contratista responder por la "responsabilidad por vicios ocultos" que, por un período de quince años, habrá de soportar para que se extinga, de forma definitiva y total, la responsabilidad contraída por la obra ejecutada.. En fin, un libro, cuyo amplio contenido y riguroso tratamiento del "Contrato de obras públicas", lo convierte en imprescindible no sólo para el Contratista, sino también para todos los agentes que intervienen en la obra pública: Director facultativo, Responsable del contrato, Servicios de Contratación, despachos de abogados..., sin olvidar el ámbito universitario, en cuyas facultades y escuelas técnicas hoy se están formando los que mañana serán los ejecutores y responsables de las grandes obras públicas que, mejorando y modernizando, nuestras infraestructuras, nos proporcionan una mejor calidad de vida.

Book excerpt: Cuando un ente inversor precisa satisfacer una necesidad en relación con su actividad, ya sea la construcción o la explotación de infraestructuras, o la prestación de servicios públicos, suele confiar la realización de los correspondientes trabajos a una empresa especializada en relación con la fase en la que se encuentra esa actuación: la de elaboración de los estudios de viabilidad o anteproyectos; la de redacción del proyecto constructivo; la de ejecución de las obras e instalaciones; la de la explotación y conservación de la infraestructura o el servicio, y la de su desmantelamiento y reciclaje, finalizada su vida útil. La realización de esas actividades incide en aspectos técnicos y económicos, pero también de tipo social y ambiental. Para garantizar la correcta ejecución de dichas tareas, así como la contraprestación al empresario por la realización del trabajo, es preciso establecer entre las partes un vínculo contractual. Surge así el CONTRATO, figura jurídica imprescindible en cualquiera de las actividades enumeradas. Es evidente que el ingeniero tendrá una relación estrecha con esas figuras contractuales, tanto si desarrolla su profesión en el seno del ente inversor, como en el sector de la consultoría, o en una empresa constructora, o de servicios. El análisis de los distintos tipos de contratos, tan importantes para el ingeniero, constituye el objeto de la presente publicación. When an investing entity needs to satisfy a need in relation to its activity, be it the construction or operation of infrastructures or the provision of public services, it usually entrusts the performance of the corresponding work to a specialised company in relation to the phase in which the action is: the preparation of feasibility studies or preliminary projects; the drafting of the construction project; the execution of the works and installations; the operation and maintenance of the infrastructure or service, and its dismantling and recycling at the end of its useful life. The performance of these activities has an impact, not only on technical and economic aspects, but also on social and environmental aspects. In order to guarantee the correct execution of these tasks, as well as the consideration to the employer for the performance of the work, it is necessary to establish a contractual link between the parties. This gives rise to the CONTRACT, an essential legal figure in any of the activities listed above. lt is obvious that the engineer will have a close relationship with these contractual figures, whether they develop their profession within the investing entity, or in the consultancy sector, or in a construction or service company. The analysis of the different types of contracts, which are so important for the engineer, is the subject of this publication.

Angola is also the world's fourth largest producer of rough diamonds in terms of value, with the potential to become one of the leading global diamond producers. In addition to oil and diamonds, the country is well endowed with agricultural resources which remain mostly untapped. However, despite the country's significant natural wealth, a prolonged civil war, the rapid development of the oil sector, and the policies pursued after Independence in 1975 have left the Angolan economy in a unique situation, characterized by very uneven indicators of development. The Angolan economy is now experiencing massive oil windfall gains that are expected to last throughout the next decade. Since oil rents are to a large part concentrated in the public sector, the question of how the oil revenue should be spent and distributed across present and future generations becomes key to any economic development strategy. This study identifies six core areas where a strategic approach for the development of a broad-based growth strategy is required: (i) the incomplete transition to a market economy; (ii) macroeconomic management; (iii) governance and transparency in the management of the mineral wealth; (iv) the business environment; (v) agriculture; and (vi) public service delivery to the poor.

Marichal shows that the present debt crisis is only a part of an overall pattern in Latin American history--cycles of loan boom and subsequent debt crisis that are heavily influenced by fluctuations of international trade and capital flows. He also reveals the significant role played by those who implement debt policies. Examining the strategies of both lenders and borrowers, he makes it clear that foreign loan negotiations are not only financial tools but also political instruments with broad economic and social consequences. The book analyzes in detail the four major debt crises that took place in Latin America during the nineteenth and early twentieth centuries. Marichal's focus is comparative, since the contracting of foreign loans and their repayment were problems common to virtually all nations of the region. He devotes special attention to explaining the links of these debt crises to the international financial panics of 1825, 1873, 1890, and 1929. The epilogue compares the debt crises of the past with the contemporary Latin American debt crisis.
