Book excerpt: In the last 35 years, governments around the globe have increasingly contracted with nonprofit and for-profit entities designed to provide a portion of the public sector’s portfolio of goods and services. This trend can be traced to a variety of factors, including perceived or actual economic efficiencies in outsourcing goods and services, values concerning the role and size of government in society, and the financial and organizational constraints of many government entities. In the United States, child welfare services adopted a pro-contracting approach early, and a variety of other human services have followed suit, including mental health care, job training, homeless services and others. Although there is strong evidence to suggest that human service contracting is growing over time, scholarship continues to lag on topics related to human service contract management, policy implementation and innovation, performance-based contracting and evaluation. This new volume in the Public Solutions Handbook series is the first volume-length treatment of human services contracting issues, integrating both policy and practice, and exploring a broad range of issues that includes the fields of history, growth, innovations, results and outcomes, best practices and the future of government human service contracting. Chapters in this book examine specific human service contracts, both in the U.S. and abroad, geared to practitioners in the public sector—from local government service contractors to municipal employees—as well as MPA students and those enrolled in courses on intergovernmental relations and nonprofit management.

Yet seldom has the practice been examined from any but the public choice approach. This book explores contracting out in the important area of human services, covering the critical conditions of contracting and the vital points of politics, procedures, service quality, and effectiveness. In doing so, DeHoog uses three theoretical perspectives drawn from social science traditions: the economic perspective of market imperfections, the political perspective of cooptation, and the interdisciplinary perspective of organizational decision-making. To evaluate the perspectives and their predictions in the human services, DeHoog has examined contracting in social services (Title XX) and employment and training programs, (CETA), primarily through in-depth interviews with participants.

By focusing on four jurisdictions that hired private firms to handle welfare-to-work services, The Welfare Marketplace reveals the ways in which increased contracting with the private and nonprofit sectors is changing the role and capacity of government, threatening accountability and responsiveness to groups with special needs. Encouraging improved performance through market mechanisms creates particular challenges for the nonprofits who must balance their missions with the bottom line. The organization of service delivery to welfare clients has undergone significant restructuring as a result of the 1996 Welfare Reform Act, which encouraged states to contract with outside companies and for the first time allowed them to determine eligibility for welfare benefits. Seeking to assess the impact of this development, M. Bryna Sanger studied the competitive contract environment in San Diego, Milwaukee, New York, and Houston. Interviewing contracters, public officials, opinion leaders, and researchers revealed the comparative advantages of a variety of key players in the multi-sector service industry. Sanger's conclusions paint a complex picture of how competitive contracting arrangements have changed the ways vendors and government agencies serve their clients. While performance and innovation have improved in some cases, all the players are finding that adequate accountability and contract monitoring are more difficult and expensive than anticipated. Both for profits and nonprofits are quickly draining talent and capacity as they compete for experienced executives from government and from each other. Sanger argues that competitive contracting is here to stay, but it will require more—not less—government management and oversight. Book excerpt: The Western welfare states are under reform (Pierson 1996; Gilbert 2002; Taylor-Gooby 2004; Henman and Fenger 2006). An important part of those reforms is the introduction of forms of privatization. Over the last decade, in most Western countries private elements have been introduced in (former) public sectors such as health care, home care, public transport, and social security. One of the components of the welfare state that has been subjected to privatization is the provision of public services. Over the years, many countries have chosen to contract out public service delivery (Domberger and Jensen 1997; Majone 1997; Scott 2000). The contracting out of public services is a specific form of privatization. In the case of contracting out, the production or the provision of public services is commissioned to the market. As a result, the role of the state changes from public provider to buyer of public services. Underlying the notion of contracting out is the belief that the introduction of market elements in the production of public services increases effectiveness and efficiency (Raad voor Werk en Inkomen 2003; Van Berkel and Van der Aa 2005). However, as we will explain in section two, this expectation only holds under specific circumstances. When contracting out public services, the agency that is outsourcing is faced with several challenges, such as opportunistic behavior on the part of the supplier. It may turn out to be difficult and costly to have the contractor supply according to the agency's preferences and policies. More specifically, the question arises whether contracts are sufficient for the safeguarding of public interests or whether supplementary government intervention is required. By analyzing the contracting practices of reintegration services in the Dutch reintegration market, we hope to gain a better understanding of the mechanisms of public private contract relations and the extend to which it is possible to safeguard public interests within the contract relation.

Book excerpt: This article conducts an analysis into long term contractual practices for the outsourcing of social services. Until recently social services in Scandinavia have been provided by public entities on an administrative basis. With the primary aim to increase efficiency and reduce public budgets these tasks are however today to a large extend undertaken by private companies on the basis of long term contracts entered into with local governments (municipalities). This Nordic model for privatization of public welfare is not unconditionally successful. Municipalities seem to hesitate in giving effect to the rising private market for welfare services. They insist on an almost complete control with the performances of the private service providers in the full length of the contracting period. In the legal literature it has been suggested that there are public law limits to privatization. The analysis of contractual strategies and practices for contracting out public welfare in this article shows that there are limits in private law for the “publicization” of contracts and markets as well.
