Book excerpt: Debates about military influence on civilian government tend to be partisan and rarely pay sufficient attention to specific contexts. This paper analyses, without condemnation or justification, why and how the military exercises such influence in Turkey and whether it is likely to continue to do so. It argues that the role of the military in Turkey grows out of a specific Turkish context and is more a symptom than a cause of the country's flawed democracy. It examines the Turkish officer ethos, particularly the role of the indigenous ideology of Kemalism, and the broad, though not universal, public mandate for an interventionist role in politics. It contends that the military's influence is neither uniform nor total and that it is more effective at blocking than initiating policy; thus creating a system in which civilian authority is primary rather than supreme. It analyses the mechanisms through which the military attempts to shape policy, and demonstrates how its influence depends more on its informal authority than legislated rights or responsibilities. The paper suggests that fears of threats to national security resulting from the reforms required for EU accession have made the military more, not less, reluctant to withdraw from the political arena. It concludes that, regardless of the future of Turkey's candidacy, such a withdrawal will be a slow and gradual process, dependent more on changes in Turkish social and political culture and the perceived security environment than in the military itself.

Book excerpt: The main objective of this book is to propose an alternative criminal opportunity theory. The authors build upon social control and routine activities to develop a dynamic, multi-contextual criminal opportunity theory. Emphasizing the importance of contextual explanations of criminal acts, they propose two levels of analysis: individual and environmental. At each level, the theory pivots on three broad organizing constructs--offenders motivated to commit criminal acts, targets such as persons or property suitable as objects of criminal acts, and the presence or absence of individuals or other defensive mechanisms capable of serving as guardians against criminal acts. Crime is profoundly real, possessing qualities that make its occurrence and prevention pressing and persistent matters for individuals and societies. Theory, in contrast, is seen as highly abstract and removed from the seriousness of "real life." Theory almost seems to be a peculiar sport of an academic class. The practically minded, even some academic criminologists, are often perplexed by the seeming obsession some scholars have with theory, which, after all, is nothing more than an explanation of facts. The practically minded, seeing a compelling need to identify the crucial factors that could be used to predict and prevent crime, wonder why anyone would invest precious time and energy into speculating about the abstract, underlying details of why crime occurs when and where it does.The authors contend that every intervention, prevention, and policy is based on some theoretical explanation of the causes of human behavior. The improvement of interventions, preventions, and policies is thus directly related to the improvement of theoretical understandings of the abstract, underlying details of the causes of crime. The development of explanations of events, when properly done, is a crucial component to understanding and possibly improving the "real world." This work does just that.

The science, some argue, recommends a view of conscious agency as merely epiphenomenal: an impotent accompaniment to the whirring unconscious machinery (the inner zombie) that prepares, decides and causes our behavior. The new essays in this volume display and explore this radical claim, revisiting the folk concept of the responsible agent after abandoning the image of a central executive, and "decomposing" the notion of the conscious will into multiple interlocking aspects and functions. Part 1 of this volume provides an overview of the scientific research that has been taken to support "the zombie challenge." In part 2, contributors explore the phenomenology of agency and what it is like to be the author of one's own actions. That feature is the abstract nature of law's judgement and its three components show that, when law judges us, it often does so in ignorance of our particular characters and abilities, on the one hand, and in ignorance of our context and circumstances, on the other. Law's judgement is thus insensitive to all or much that makes us the particular people we are. The book explores various connections between this mode of judgement and some of our most important legal and political values. It shows that law's abstract judgement is closely related to important juristic conceptions of personhood, responsibility and impartiality, and that these notions are not without moral significance. The book also examines the connections between modern law's judgement and three of our most important political values, namely, dignity, equality and community. It argues that, if we value particular conceptions of dignity, equality and community, then we must also value law's judgement. Illuminating these connections therefore serves a double purpose: first, it makes a case against those who counsel liberation from law's abstract judgement and, second, it redirects attention to the task of morally evaluating law's abstract judgement in its own terms.
