Book Dayton and Beyond

Download or read book Dayton and Beyond written by Christophe Solioz and published by Nomos Verlagsgesellschaft. This book was released on 2004 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, recognized international and Bosnian experts and analysts address the future of Bosnia in the area of constitutional reform, economic development, culture and education. A provocative introductory section asks whether the Dayton agreement has failed to create stable institutions of government able to deal with the challenges the country faces on its way to Euro-Atlantic integration. Among the key issues debated in this volume are the primacy of individual over group rights, a recent court decision that all three ethnic groups are constituent throughout the country, the role of culture and education in reinforcing division rather than integration, and the abysmal economic record which is in large part due to policy failures. The book provides a differentiated picture of a complex situation and will be useful to those interested in Bosniaís triple transition process from war to peace, a one-party state to a liberal democracy, and a planned to a market economy. It goes beyond a simple snapshot of a countryís situation to suggest that a strategy focused on local ownership is now needed a point of direct relevance to peace missions elsewhere.

Available in PDF, EPUB and Kindle. Book excerpt: This book deals with what impact has the process of Europeanization had on Bosnia-Herzegovina's (BiH) constitutional development, political process, economic development and security sector reform and how much it has contributed to maintaining territorial integrity of BiH. It shows the obstacles and problems associated with existence of BiH, particularly hinting at historical often hatred and struggle among the main ethnics - Bosniaks (Muslims), Serbs (mainly of Orthodox faith) and Croats (mainly Catholics) and their lack of trust especially after the 1992-1995 war atrocities. It also deals with the possible threats that could endanger the territorial integrity of BiH and addresses the weaknesses of the current political arrangement. Nevertheless, it attempts to show that BiH is indeed capable of surviving as a single territory. This is attributed to the very process of Europeanization in the aforementioned three areas. This book is designed for students of political sciences who want to gain more insight into the region, be it history of the conflict and ways of resolving it but also to the general public who want to learn more about history and current happenings in BiH.

Book A Constitution of the People and How to Achieve It

Download or read book A Constitution of the People and How to Achieve It written by Aarif Abraham and published by BoD – Books on Demand. This book was released on 2021-04-30 with total page 382 pages. Available in PDF, EPUB and Kindle. Book excerpt: Britain does not have a written constitution. It has rather, over centuries, developed a set of miscellaneous conventions, rules, and norms that govern political behavior. By contrast, Bosnia’s constitution was written, quite literally, overnight in a military hanger in Dayton, USA, to conclude a devastating war. By most standards it does not work and is seen to have merely frozen a conflict and all development with it. What might these seemingly unrelated countries be able to teach each other? Britain, racked by recent crises from Brexit to national separatism, may be able to avert long-term political conflict by understanding the pitfalls of writing rigid constitutional rules without popular participation or the cultivation of good political culture. Bosnia, in turn, may be able to thaw its frozen conflict by subjecting parts of its written constitution to amendment, with civic involvement, on a fixed and regular basis; a ’revolving constitution’ to replicate some of that flexibility inherent in the British system. A book not just about Bosnia and Britain; a standard may be set for other plural, multi-ethnic polities to follow.

Book Bosnia as Civic State and Global Citizen

Download or read book Bosnia as Civic State and Global Citizen written by Philip C. Aka and published by Rowman & Littlefield. This book was released on 2021-11-22 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: For long, the narrative in constitutional law, public policy, and statecraft is that Bosnia must join the EU, as a matter of economic development and nation building. This book introduces another dimension to the narrative, oversighted, without which the story remains one-dimensional, rather than balanced. That missing element in the literature this study integrates is a reformed Bosnian state, along the lines proposed in this book, that operates outside the EU. The setting of the work within the fields of knowledge of comparative constitutional law, and public choice theory provides added value to the reader, including students, scholars, policy makers, and lay persons.

Book Courts Politics and Constitutional Law

Download or read book Courts Politics and Constitutional Law written by Martin Belov and published by Routledge. This book was released on 2019-10-16 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines how the judicialization of politics, and the politicization of courts, affect representative democracy, rule of law, and separation of powers. This volume critically assesses the phenomena of judicialization of politics and politicization of the judiciary. It explores the rising impact of courts on key constitutional principles, such as democracy and separation of powers, which is paralleled by increasing criticism of this influence from both liberal and illiberal perspectives. The book also addresses the challenges to rule of law as a principle, preconditioned on independent and powerful courts, which are triggered by both democratic backsliding and the mushrooming of populist constitutionalism and illiberal constitutional regimes. Presenting a wide range of case studies, the book will be a valuable resource for students and academics in constitutional law and political science seeking to understand the increasingly complex relationships between the judiciary, executive and legislature.
