Download or read book Constitutional Law of Ireland written by Michael Forde and published by Bloomsbury Publishing. This book was released on 2016-10-14 with total page 1098 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally written for the fiftieth anniversary of the Constitution of Ireland, this book is an account of how the Constitution's requirements have been implemented by the legislature and interpreted by the courts. In this way it provides an integrated and contextual account of constitutional law in Ireland. It goes as far as to place it in context of some foreign constitutions, especially the Constitutions of the United States, France, Germany and the United Kingdom, as indeed the Irish courts refer frequently to other countries for guidance in interpreting the Constitution. The book largely falls into four parts. The first few chapters are introductory and cover the drafting and adoption of the Constitution, some features of the State and its citizens, and the judicial review of laws. The next few chapters deal with the various institutions of government and with the activities of the State in the international arena and in relation to fiscal matters. Then following on from this there are a number of chapters which consider what may be termed the various civil liberties and rights. There is a final brief section, towards the end of the book which deals with the various legal breaches of the Constitution. This new edition has been extensively rewritten to account for the enormous to take into account the tumultuous changes in Irish Constitutional Law in the intervening years. Challenges to articles, referenda, new legislation, and cases are all judicially considered. Michael Forde and David Leonard offer the reader everything they need to know on this complex subject.

Book Development of Dominion Status 1900 1936

Download or read book Development of Dominion Status 1900 1936 written by Robert MacGregor Dawson and published by Routledge. This book was released on 2013-02-01 with total page 485 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1965. The peculiar political condition which is now called Dominion status has had a long and varied history; but no part of its development has been so full of constitutional interest as the last twenty years. Yet those who have lived through this period are frequently very much at loss to recall the exact sequence of events and the manner in which Dominion autonomy has proceeded step by step to its present position. This book is an attempt to give the general reader a concise account of what Dominion status means, and how it has grown out of the political experience of the immediate past. To accomplish this, the book is arranged in two parts: first, a narrative of the development of Dominion status since 1900; and second, a very generous selection from the essential contemporary documents by means of which the reader may, if he so desires, study this development first-hand. These documents have not been limited to official reports and bluebooks (which are naturally indispensable in dealing with such a topic), but they also include other material from newspapers and periodicals, which supplement the formal papers and frequently bear additional information which is unobtainable elsewhere. The two parts have been linked together by footnotes and cross-references.

Book Lawless v Ireland 1957 1961 The First Case Before the European Court of Human Rights

Download or read book Lawless v Ireland 1957 1961 The First Case Before the European Court of Human Rights written by Brian Doolan and published by Routledge. This book was released on 2019-06-11 with total page 431 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2001. The case of Lawless v Ireland is a landmark in the development of human rights jurisprudence. Stemming from the introduction of detention without trial by the Irish government in response to the resurgence of political violence, much of the material relevant to the case brought before the European Court of Human Rights, has remained closed to public scrutiny. This book is the first to provide a detailed documentary of the case, assessing the adequacy of the investigatory processes provided under the European Convention and questioning whether the factual conclusions reached by the European Commission on Human Rights were correct. In what will be an essential reference for academics and students of human rights, the book raises doubts as to whether the Strasbourg institutions, established to rectify national breaches of human rights, might in fact have perpetrated an international miscarriage of justice.

It was a member of the League of Nations. Albania became independent on November 28, 1912, after centuries of Ottoman domination. Its existence was recognized internationally after the First Balkan War on July 28, 1913, and an international control commission drew up a constitution in 1914, providing for a monarchy with a National Assembly most of whose members were elected by the people. 4 Albania Although a neutral state, Albania became involved in the First World War, after which, in January 1920, the Albanian chiefs drew up a new constitution providing for a monarchy. In 1925, Albania was proclaimed a republic and a new constitution, based on the United States constitution, was promulgated. In 1928, the President became King and a new consti tution followed. On April 7, 1939, Italy occupied Albania and imposed a constitution providing that Albania was a monarchy under the House of Savoy. On April6, 1941, martial law was proclaimed throughout the country. After the Italian capitulation in 1943, Albania was occupied by Germany. The Albanian Communist Party was founded in November 1941, and the bases of the communist regime were laid at the second national confer ence in July 1943 of the Movement for National Liberation, created by the Party to unite and control all the forces opposing foreign occupation. This conference created Councils of National Liberation.

Book Drafting the Irish Constitution 1935 1937

Download or read book Drafting the Irish Constitution 1935 1937 written by Donal K. Coffey and published by Springer. This book was released on 2018-05-04 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: The second of two volumes, this book situates the drafting of the Irish Constitution within broader transnational constitutional currents. Donal K. Coffey pioneers a new method of draft sequencing in order to track early influences in the drafting process and demonstrate the importance of European influences such as the German, Polish, and Portuguese Constitutions to the Irish drafts. He also analyses the role that religion played in the drafting process, and considers the new institutions of state, such as the presidency and the senate, tracing the genesis of these institutions to other continental constitutions. Together with volume I, Constitutionalism in Ireland, 1932–1938, this book argues that the 1937 Constitution is only explicable within the context of the European and international trends which inspired it.
