Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. Book excerpt: This volume focuses on the integration and globalization of Romania, a prominent emerging market in South-Eastern Europe and one of the major players in the securitization of the Black Sea and the Eastern European border, as both a part of NATO since 2004 and a fully integrated EU Member State since 2007. It will examine the challenges the country has faced in its progression from totalitarianism to democracy through several waves of reform intended to update and streamline its political and economic processes for success in the free-market capitalist arena. Having learned the hard way about some of the key aspects of public administration, Romania has learned a place for itself among the diverse global players of Europe and beyond. The first section reviews current perspectives on globalization and its impact in the late 20th century. It has “flattened” the Earth, generating better communication and exchanges than ever before, but also gathering a fair amount of criticisms from commentators seeing it as little else than neo-colonialism. Cooperative-administrative strategies are being suggested instead, in order for new public administration patterns to smoothly run in coordination with the globalized world. In the second section, the European Union is described as a complex multi-level socio-political entity, itself historically in turmoil over its own style of rule – e.g. hierarchy vs. coordination, integration vs. centralization, etc. – or even its own existence, as the European dream seemed to be losing steam with the general population of Europe several times in the previous century. Powers and responsibilities of the European institutions and agencies are also discussed. Thirdly, the recent history of Romania is approached from the Europeanization context, starting from its post-1989 days of confusion and of attempting to jumpstart democracy. Eventually, it has to undergo a series of reforms and internalize some principles fundamental to the EU in order for the much-awaited accession to occur and its multiple effects to start taking place. A country with a rich cultural heritage and straddling multiple socio-political axes, Romania has plenty more to offer in the new geostrategic, security and development contexts of the 21st-century Europe. As such, this volume provides inspiration for further research and practical application opportunities on topics of local, European and global significance.

This book explores that question through a comparative study of contestations over language use in the heart of the post-Communist region. Zsuzsa Csergo notes that newly independent governments looked to "rejoin" the West, in particular the European Union, while at the same time asserting control over the institutions they considered key to the reproduction of national cultures. These national projects resulted in renewed salience for minority language rights and a complicated politics triggering EU concerns about the treatment of regional/cultural minorities. Csergo's field research in Romania, Hungary, and Slovakia leads her to make a bold claim about the primacy of domestic politics in the construction of democratic solutions to the conundrum of nation building and minority rights.Talk of the Nation breaks new ground by focusing on both majority and minority political elites and parties in interethnic relations. Csergo challenges arguments about the overwhelming importance of international influence. Her book demonstrates that the role of domestic political actors in interethnic reconciliation is not merely that of "compliance" with international requirements or "effectiveness" in responding to external pressure—they are largely guided by the internal democratic process.

Book excerpt: This book analyses unamendability in democratic constitutionalism and engages critically and systematically with its perils, offering a much-needed corrective to existing understandings of this phenomenon. Whether formalized in the constitutional text or developed as part of judicial doctrines of implicit unamendability, eternity clauses raise fundamental questions about the core democratic commitments underpinning any given constitution. The book takes seriously the democratic challenge eternity clauses pose and argues that this goes beyond the old tension between constitutionalism and democracy. Instead, eternity clauses reveal themselves to be a far more ambivalent constitutional mechanism, one with greater and more insidious potential for abuse than has been recognized. The 'dark side' of unamendability includes its propensity to insulate majoritarian, exclusionary, and internally incoherent values, as well as its sometimes purely pragmatic role in elite bargaining. The book adopts a contextual approach and brings to the fore a variety of case studies from non-traditional jurisdictions. These insights from the periphery illuminate the prospects of unamendability fulfilling its intended aims - protecting constitutional democracy foremost among them. With its promise most appealing in transitional, post-conflict, and fragile democracies, unamendability reveals itself, counterintuitively, to be both less potent and potentially more dangerous in precisely these contexts. The book also places the rise of eternity clauses in the context of other significant trends in recent constitutional practice: the transnational embeddedness of constitution-making and of constitutional adjudication; the rise of popular participation in constitutional reform processes; and the ongoing crisis of democratic backsliding in liberal democracies.
