Book Animal Sacrifice Religion and Law in South Asia

Download or read book Animal Sacrifice Religion and Law in South Asia written by Daniela Berti and published by Taylor & Francis. This book was released on 2023-07-13 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents original research on the controversies surrounding animal sacrifice in South Asia through the lens of court cases. It focuses on the parties involved in these cases: on their discourses, motivations, and contrasting points of view. Through an examination of judicial files, court decisions and newspaper articles, and interviews with protagonists, the book explores how the question of animal sacrifice is dealt with through administrative, legislative, and judicial practice. It outlines how, although animal sacrifice has over the ages been contested by various religious reform movements, the practice has remained widespread at all levels of society, especially in certain regions. It reveals that far from merely being a religious and ritual question, animal sacrifice has become a focus of broader public debate, and it discusses how the controversies highlight the contrast between ‘traditional’ and ‘reformist’ understandings of Hinduism; the conflict between the core legal and moral principles of religious freedom and social progress; and the growing concern with environmental issues and animal rights. Book India s Living Constitution

Download or read book India s Living Constitution written by Zoya Hasan and published by Anthem Press. This book was released on 2005 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: India became independent in 1947 and, after nearly three years of debate in the Constituent Assembly, adopted a Constitution that came into effect on 26 January 1950. This Constitution has lasted until the present, with its basic structure unaltered, a remarkable achievement given that the generally accepted prerequisites for democratic stability did not exist, and do not exist even today. Half a century of constitutional democracy is something that political scientists and legal scholars need to analyze and explain. This volume examines the career of constitutional-political ideas (implicitly of Western origin) in the text of the Indian Constitution or implicit within it, as well as in actual political practice in the country over the past half-century.

Book Democracy and Transparency in the Indian State

Download or read book Democracy and Transparency in the Indian State written by Prashant Sharma and published by Routledge. This book was released on 2015-03-24 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: The enactment of the national Right to Information (RTI) Act in 2005 has been produced, consumed, and celebrated as an important event of democratic deepening in India both in terms of the process that led to its enactment (arising from a grassroots movement) and its outcome (fundamentally altering the citizen--state relationship). This book proposes that the explanatory factors underlying this event may be more complex than imagined thus far. The book discusses how the leadership of the grassroots movement was embedded within the ruling elite and possessed the necessary resources as well as unparalleled access to spaces of power for the movement to be successful. It shows how the democratisation of the higher bureaucracy along with the launch of the economic liberalisation project meant that the urban, educated, high-caste, upper-middle class elite that provided critical support to the demand for an RTI Act was no longer vested in the state and had moved to the private sector. Mirroring this shift, the framing of the RTI Act during the 1990s saw its ambit reduced to the government, even as there was a concomitant push to privatise public goods and services. It goes on to investigate the Indian RTI Act within the global explosion of freedom of information laws over the last two decades, and shows how international pressures had a direct and causal impact both on its content and the timing of its enactment. Taking the production of the RTI Act as a lens, the book argues that while there is much to celebrate in the consolidation of procedural democracy in India over the last six decades, existing social and political structures may limit the extent and forms of democratic deepening occurring in the near future. It will be of interest to those working in the fields of South Asian Law, Asian Politics, and Civil Society.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a vantage point of comparison, of the actual reality of decentralisation in India with Gandhi’s vision of decentralised democracy, or what he referred to as Gram Swaraj. It looks at the historical evolution of panchayats from ancient times to India’s independence, and critically discusses the developments after. It examines the functioning of the present Panchayati Raj Institutions (PRIs) and the performances of urban local bodies. The basic thrust of this work is the need for constitutional reforms meant to strengthen and deepen democracy. The book will be useful to those in political studies, policy studies, public administration and development studies.

Book The Constitution of India

Download or read book The Constitution of India written by Arun K Thiruvengadam and published by Bloomsbury Publishing. This book was released on 2017-12-28 with total page 291 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides an overview of the content and functioning of the Indian Constitution, with an emphasis on the broader socio-political context. It focuses on the overarching principles and the main institutions of constitutional governance that the world's longest written constitution inaugurated in 1950. The nine chapters of the book deal with specific aspects of the Indian constitutional tradition as it has evolved across seven decades of India's existence as an independent nation. Beginning with the pre-history of the Constitution and its making, the book moves onto an examination of the structural features and actual operation of the Constitution's principal governance institutions. These include the executive and the parliament, the institutions of federalism and local government, and the judiciary. An unusual feature of Indian constitutionalism that is highlighted here is the role played by technocratic institutions such as the Election Commission, the Comptroller and Auditor General, and a set of new regulatory institutions, most of which were created during the 1990s. A considerable portion of the book evaluates issues relating to constitutional rights, directive principles and the constitutional regulation of multiple forms of identity in India. The important issue of constitutional change in India is approached from an atypical perspective. The book employs a narrative form to describe the twists, turns and challenges confronted across nearly seven decades of the working of the constitutional order. It departs from conventional Indian constitutional scholarship in placing less emphasis on constitutional doctrine (as evolved in judicial decisions delivered by the High Courts and the Supreme Court). Instead, the book turns the spotlight on the political bargains and extra-legal developments that have influenced constitutional evolution. Written in accessible prose that avoids undue legal jargon, the book aims at a general audience that is interested in understanding the complex yet fascinating challenges posed by constitutionalism in India. Its unconventional approach to some classic issues will stimulate the more seasoned student of constitutional law and politics.
