This book analyses the historical antecedents, establishment and subsequent evolution of the political regime created in 1958. For most of this period, the country was governed by a National Front power-sharing system between the Conservatives and the Liberals, the country's two major parties. This system was initially established to prevent a return to the intense violence between the parties that had earlier led to a political breakdown and military rule. In crucial respects, the Colombian governing arrangement was similar to a number of other cases of coalition governments (termed consociational democracies), to which it is compared in the book.

Southeastern Latin Americanist Venezuela and Columbia both have two-sided structures of democracy. They combine the Liberal Democratic/Anglo-American model and the Latin American model. The first includes the procedural norms of free elections, citizen participation, individual rights, and multi-interest groups. The second comprises the substantive norms of economic development and social justice. The contributors address the following questions: Is one or the other model more significant? How much of a blending or overlap, if any, exists between these two models? Is there a third model that is more significant? In answering these questions, the contributors examine such principal components as national structures and societal evolution, political parties, economic development, the state and the military, guerilla movements, international relations and foreign policy, and the drug trade. Editor Donald L. Herman concludes this study by offering a prognosis for the two respective regimes for the rest of the twentieth century.

The committee's main goal is to advance the practice of conflict resolution by using the methods and critical attitude of science to examine the effectiveness of various techniques and concepts that have been advanced for preventing, managing, and resolving international conflicts. The committee's research agenda has been designed to supplement the work of other groups, particularly the Carnegie Corporation of New York's Commission on Preventing Deadly Conflict, which issued its final report in December 1997. The committee has identified a number of specific techniques and concepts of current interest to policy practitioners and has asked leading specialists on each one to carefully review and analyze available knowledge and to summarize what is known about the conditions under which each is or is not effective. Current examples include Belgium, Bosnia, Northern Ireland, Burundi, and Iraq. Despite their growing popularity, they have begun to be challenged before human rights courts as being incompatible with human rights norms, particularly equality and non-discrimination. Courts and Consociations examines the use of power-sharing agreements, their legitimacy, and their compatibility with human rights law. Key questions include to what extent, if any, consociations conflict with the liberal individualist preferences of international human rights institutions, and to what extent consociational power-sharing may be justified to preserve peace and the integrity of political settlements. In three critical cases, the European Court of Human Rights has considered equality challenges to important consociational practices, twice in Belgium and then in Sejdic and Finci v Bosnia regarding the constitution established for Bosnia Herzegovina under the Dayton Agreement. The Court's decision in Sejdic and Finci has significantly altered the approach it previously took to judicial review of consociational arrangements in Belgium. This book accounts for this change and assess its implications. The problematic aspects of the current state of law are demonstrated. Future negotiators in places riven by potential or actual bloody ethnic conflicts may now have less flexibility in reaching a workable settlement, which may unintentionally contribute to sustaining such conflicts and make it more likely that negotiators will consider excluding regional and international courts from reviewing these political settlements. Providing a clear, accessible introduction to both the political use of power-sharing settlements and the human rights law on the issue, this book is an invaluable guide to all academics, students, and professionals engaged with transitional justice, peace agreements, and contemporary human rights law.

Soon after Arend Lijphart and Gerhard Lehmbruch had depicted consociational democracy as a viable alternative to majoritarian forms of democracy, a fierce debate about its wider applicability took root. Lijphart and Lehmbruch had presented the Netherlands, Belgium, Austria and Switzerland as cases of consociational democracies - but would the concept work in countries that are divided more deeply? For a good reason, the issue regained relevance and interest of scholars during the 1990s: Intra-state wars now took their tolls on an unprecedented scale - many of which had an ethnic dimension. It requires no statistical analysis to acknowledge ethnic divisions as one of the most serious sources of today's violent conflicts. In this context, it has been asked whether consociational democracy is a suitable and appropriate model to accommodate the diverse interests and cultures of groups in a multiethnic society. Is it a sustainable model able to prevent conflicts from turning violent? Should it be part of peacebuilding efforts in a post-conflict society? If applied, how should a consociational design look like?
