This translation of her celebrated work L'Etat et les esclaves makes available for English-speaking readers her impassioned defense of the state. Published in France in 1979 and republished in 1989, this work challenged not only the anti-statism of the 1960s but also generations of romanticism in politics that, in Kriegel's view, inadvertently threatened the cause of liberty by refusing to distinguish between the despotic and the lawful state. In a work that addresses the urgent concerns of Europe and the contemporary world as a whole, Kriegel examines the background of modern liberal democracy in the late seventeenth and eighteenth centuries and argues cogently for the future of constitutional social-democracy. She maintains, among other positions, that European liberal democracies would have been impossible without the political basis provided by the lawful state first developed by monarchies. She also shows that early modern centralized states became liberal insofar as they developed a centralized legal system, rather than a centralized administration. In developing these ideas, she presents a picture of the state as a major force for human liberty.

In Reason and Fairness Ulrike Müßig reveals the combination of ordinary judicial competences with procedural rationality, together with the complementarity of procedural and substantive justice, as the foundation for the ‘rule of law’ in court constitution, far earlier than the advent of liberal constitutionalism. The ECHR fair trial guarantee reads as the historically-grown consensus of the functional judicial independence. Both before historical and contemporary courts, justice is done and seen to be done by means of judgements, whose legal requirements combine the equation of ‘fair’ and ‘legal’ with that of ‘legal’ and ‘rational.’ This legal determinability of the judge’s fair attitude amounts to the specific (rational) European idea of justice.

''Ritual?'' asks Philippe Buc. In The Dangers of Ritual he boldly argues that the concept shouldn't be so central after all. Modern-day scholars, gently seduced by twentieth-century theories of ritual, often misinterpret medieval documents that ostensibly describe such events, in part because they fail to appreciate the intentions behind them. The book begins with four case studies whose arrangement--backward from texts on tenth-century kingship to fourth-century representations of Christian martyrdom--allows for the line of development to be peeled back layer by layer. It then turns to an analysis of the formation of the intellectual traditions that contemporary historians have employed to interpret medieval documents. Tracing the emergence of the concept of ritual from the Reformation to the mid-twentieth century, Buc highlights the continuities yet also the profound transformations between the early medieval understandings and our own, social-scientific models. Medieval historians will find this book an indispensable resource for its insights into methodological issues crucial to their discipline. As Buc demonstrates, only rigorous attention to the contexts within which authors worked can allow us to reconstruct from medieval documents how ''rituals'' might have functioned. Ultimately, he argues, too swift an application of contemporary models to highly complex textual artifacts blinds us to the specificities of early medieval European political culture.
