Book excerpt: The legal case for the American Revolution has seldom been presented as eloquently and as decisively as it was presented by James Wilson in 1774. Wilson was one of only six men to have signed both the Declaration of Independence and the Constitution, and he was one of our nation's first Supreme Court justices. In presenting his case for a revolution, Wilson argued that the American colonists had never been subject to the dictates of the British Parliament. The core of Wilson's argument revolves around three landmark cases in the British court. The first case was one from 1485 in which the British court ruled that the people of Ireland were not subject to the laws of the British legislature “because they do not send knights to parliament.” The second case was a dispute heard in 1694 regarding the question of whether the people of Jamaica were bound by the laws of Parliament, and once again, the British court ruled “That the acts of parliament or statutes of England were not in force in Jamaica.” Wilson then made reference to a third case in which the court held “that the laws of England did not extend to Virginia.” Armed with these three decisions, James Wilson completely obliterated the arguments of his opponents, and established the right of the American colonies to live according to their own laws.

Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.

Book The Nature of Legislative Intent

Download or read book The Nature of Legislative Intent written by Richard Ekins and published by OUP Oxford. This book was released on 2012-10-12 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are legislatures able to form and act on intentions? The question matters because the interpretation of statutes is often thought to centre on the intention of the legislature and because the way in which the legislature acts is relevant to the authority it does or should enjoy. Many scholars argue that legislative intent is a fiction: the legislative assembly is a large, diverse group rather than a single person and it seems a mystery how the intentions of the individual legislators might somehow add up to a coherent group intention. This book argues that in enacting a statute the well-formed legislature forms and acts on a detailed intention, which is the legislative intent. The foundation of the argument is an analysis of how the members of purposive groups act together by way of common plans, sometimes forming complex group agents. The book extends this analysis to the legislature, considering what it is to legislate and how members of the assembly cooperate to legislate. The book argues that to legislate is to choose to change the law for some reason: the well-formed legislature has the capacity to consider what should be done and to act to that end. This argument is supported by reflection on the centrality of intention to the nature of language use. The book then explains in detail how members of the assembly form and act on joint intentions, which do not reduce to the intentions of each member, before outlining some implications of this account for the practice of statutory interpretation. Developing a robust account of the nature and importance of legislative intention, the book represents a significant contribution to the literature on deliberative democracy that will be of interest to all those thinking about legal interpretation and constitutional theory.

Book Political Constitutionalism

Download or read book Political Constitutionalism written by Richard Bellamy and published by Cambridge University Press. This book was released on 2007-09-13 with total page 280 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judicial review by constitutional courts is often presented as a necessary supplement to democracy. This book questions its effectiveness and legitimacy. Drawing on the republican tradition, Richard Bellamy argues that the democratic mechanisms of open elections between competing parties and decision-making by majority rule offer superior and sufficient methods for upholding rights and the rule of law. The absence of popular accountability renders judicial review a form of arbitrary rule which lacks the incentive structure democracy provides to ensure rulers treat the ruled with equal concern and respect. Rights based judicial review undermines the constitutionality of democracy. Its counter-majoritarian bias promotes privileged against unprivileged minorities, while its legalism and focus on individual cases distort public debate. Rather than constraining democracy with written constitutions and greater judicial oversight, attention should be paid to improving democratic processes through such measures as reformed electoral systems and enhanced parliamentary scrutiny.

Book American Interpretations of Natural Law

Download or read book American Interpretations of Natural Law written by Benjamin Fletcher Wright and published by Routledge. This book was released on 2017-07-05 with total page 431 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book illustrates the deep roots of natural law doctrines in America's political culture. Originally published in 1931, the volume shows that American interpretations of natural law go to the philosophical heart of the American regime. The Declaration of Independence is the preeminent example of natural law in American political thought?it is the self-evident truth of American society.Benjamin Wright proposes that the decline of natural law as a guiding factor in American political behaviour is inevitable as America's democracy matures and broadens. What Wright also chronicled, inadvertently, was how the progressive critique of natural law has opened a rift between and among some of the ruling elites and large numbers of Americans who continue to accept it. Progressive elites who reject natural law do not share the same political culture as many of their fellow citizens.Wright's work is important because, as Leo Strauss and others have observed, the decline of natural law is a development that has not had a happy ending in other societies in the twentieth century. There is no reason to believe it will be different in the United States.

Book Political Thought and the Origins of the American Presidency

Download or read book Political Thought and the Origins of the American Presidency written by Ben Lowe and published by University Press of Florida. This book was released on 2021-06-08 with total page 343 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume examines the political ideas behind the construction of the presidency in the U.S. Constitution, as well as how these ideas were implemented by the nation’s early presidents. The framers of the Constitution disagreed about the scope of the new executive role they were creating, and this volume reveals the ways the duties and power of the office developed contrary to many expectations. Here, leading scholars of the early republic examine principles from European thought and culture that were key to establishing the conceptual language and institutional parameters for the American executive office. Unpacking the debates at the 1787 Constitutional Convention, these essays describe how the Constitution left room for the first presidents to set patterns of behavior and establish a range of duties to make the office functional within a governmental system of checks and balances. Contributors explore how these presidents understood their positions and fleshed out their full responsibilities according to the everyday operations required to succeed. As disputes continue to surround the limits of executive power today, this volume helps identify and explain the circumstances in which limits can be imposed on presidents who seem to dangerously exceed the constitutional parameters of their office. Political Thought and the Origins of the American Presidency demonstrates that this distinctive, time-tested role developed from a fraught, historically contingent, and contested process. Book The Ideological Origins of the American Revolution

Download or read book The Ideological Origins of the American Revolution written by Bernard Bailyn and published by Harvard University Press. This book was released on 2012-10-01 with total page 417 pages. Available in PDF, EPUB and Kindle. Book excerpt: To the original text of what has become a classic of American historical literature, Bernard Bailyn adds a substantial essay, ”Fulfillment,” as a Postscript. Here he discusses the intense, nation-wide debate on the ratification of the Constitution, stressing the continuities between that struggle over the foundations of the national government and the original principles of the Revolution. This detailed study of the persistence of the nation’s ideological origins adds a new dimension to the book and projects its meaning forward into vital present concerns.

Book The Law of Nations in Early American Foreign Policy

Download or read book The Law of Nations in Early American Foreign Policy written by Willem Theo Oosterveld and published by BRILL. This book was released on 2016-01-12 with total page 373 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Law of Nations in Early American Foreign Policy, Willem Theo Oosterveld provides the first general study of international law as interpreted and applied by the generation of the Founding Fathers. A mostly neglected aspect in the historiography of the early republic, this study argues that international law was in fact an integral part of the Revolutionary creed. Taking the reader from colonial debates about the law of nations to the discussions about slavery in the early 19th century, this study shows the zest of the Founders to conduct foreign policy on the basis of treatises such as Vattel’s The Law of Nations. But it also highlights the deep ambiguities and sometimes personal struggles that arose when applying international law.
