These selected paragraphs distill the contents and give you a quick look inside: Thus a people may prefer a free government; but if, from indolence, or carelessness, or cowardice, or want of public spirit, they are unequal to the exertions necessary for preserving it; if they will not fight for it when it is directly attacked; if they can be deluded by the artifices used to cheat them out of it; if, by momentary discouragement, or temporary panic, or a fit of enthusiasm for an individual, they can be induced to lay their liberties at the feet even of a great man, or trust him with powers which enable him to subvert their institutions-in all these cases they are more or less unfit for liberty; and though it may be for their good to have had it even for a short time, they are unlikely long to enjoy it. ... A people who are more disposed to shelter a criminal than to apprehend him; who, like the Hindoos, will perjure themselves to screen the man who has robbed them, rather than take trouble or expose themselves to vindictiveness by giving evidence against him; who, like some nations of Europe down to a recent date, if a man poniards another in the public street, pass by on the other side, because it is the business of the police to look to the matter, and it is safer not to interfere in what does not concern them; a people who are revolted by an execution, but not shocked at an assassination-require that the public authorities should be armed with much sterner powers of repression than elsewhere, since the first indispensable requisites of civilized life have nothing else to rest on. ...Government consists of acts done by human beings; and if the agents, or those who choose the agents, or those to whom the agents are responsible, or the lookers-on whose opinion ought to influence and check all these, are mere masses of ignorance, stupidity, and baleful prejudice, every operation of government will go wrong; while, in proportion as the men rise above this standard, so will the government improve in quality up to the point of excellence, attainable but nowhere attained, where the officers of government, themselves persons of superior virtue and intellect, are surrounded by the atmosphere of a virtuous and enlightened public opinion. ...The arrangements for rendering the choice of the judges such as to obtain the highest average of virtue and intelligence; the salutary forms of procedure; the publicity which allows observation and criticism of whatever is amiss; the liberty of discussion and cinsure through the press; the mode of taking evidence, according as it is well or ill adapted to elicit truth; the facilities, whatever be their amount, for obtaining access to the tribunals; the arrangements for detecting crimes and apprehending offenders-all these things are not the power, but the machinery for bringing the power into contact with the obstacle; and the machinery has no action of itself, but without it the power, let it be ever so ample, would be wasted and of no effect. ...A representative constitution is a means of bringing the general standard of intelligence and honesty existing in the community, and the individual intellect and virtue of its wisest members, more directly to bear upon the government, and investing them with greater influence in it than they would have under any other mode of organization; though, under any, such influence as they do have is the source of all good that there is in the government, and the hindrance of every evil that there is not.

Where do we stand to-day? When I entered political life it was the latter part of the epoch of the establishment of democratic representative government. We have lived on to-day into an epoch which regards democratic representative government as on its trial. Its merits and efficiency are questioned as they were not questioned when we were engaged in establishing it. In some countries democratic representative government is no longer regarded as an ideal at all. I do not take what has happened in Russia as an instance, because Russia has never had representative government, and what has never had a trial cannot be said to be superseded or discarded by what has taken place in Russia. But what has happened in Italy lately is very significant. Italy had democratic representative government, but it has now been superseded by something which presumably must have much popular support behind it, but which is not based upon parliamentary election, but on organized force. For the present, at any rate, that system of government which we have regarded as the ideal in this country has been suspended in Italy and it is possible that under the shock of confusion and chaos that still exists in Europe you may see democratic representative government in some other countries go down, at any rate for a time, in favour of some other system. The precise question here proposed for investigation was no doubt in uenced by the situation. I asked myself what this democracy, now so plainly absent, really was, and how far it was or might have been realized in the forms of government established in this country before the war. Later, after my release from military service, I had the advantage Of submitting my attempt at an answer to these questions, in the form Of lectures, to a Summer School of the Workers Educational Association at Oxford. The Colonial State papers, 'the Resolves of Congress, the Articles of Confedera tion and the State Constitutions contained many excellent provisions which were inserted in the greater instrument, while precedents for other provisions were found in the British Constitution. In the manner of arrangement I have followed the divi sion of the Constitution into articles, sections and clauses instead of considering similar provisions together. No attempt has been made to discuss collateral issues, or to criticise the Constitution because it contains too much or too little. Book excerpt: It is usually held that representative government is not strictly democratic, since it does not allow the people themselves to directly make decisions. But here, taking as her guide Thomas Paine’s subversive view that “Athens, by representation, would have surpassed her own democracy,” Nadia Urbinati challenges this accepted wisdom, arguing that political representation deserves to be regarded as a fully legitimate mode of democratic decision making—and not just a pragmatic second choice when direct democracy is not possible. As Urbinati shows, the idea that representation is incompatible with democracy stems from our modern concept of sovereignty, which identifies politics with a decision maker’s direct physical presence and the immediate act of the will. She goes on to contend that a democratic theory of representation can and should go beyond these identifications. Political representation, she demonstrates, is ultimately grounded in a continuum of influence and power created by political judgment, as well as the way presence through ideas and speech links society with representative institutions. Deftly integrating the ideas of such thinkers as Rousseau, Kant, Emmanuel Joseph Sieyès, Paine, and the Marquis de Condorcet with her own, Urbinati constructs a thought-provoking alternative vision of democracy.
