Sin embargo, en la mayoría de ordenamientos, el avance de ésta y otras técnicas no ha ido acompañado de una regulación precisa del acceso y consentimiento a las mismas. Este fenómeno, más acusado en países que se caracterizan por la cuasidesregulación de la reproducción asistida, como los Estados Unidos de América, se constata también en ordenamientos que cuentan con regulación específica, como España. Casos como Davis v. Davis (1992), Evans v. the U.K. (2007) o P., A. v. S., A.C. (2011) ponen de relieve las implicaciones genéticas y de género que pueden llegar a tener los conflictos sobre los embriones con motivo de la ruptura de la pareja. Las elevadas tasas de divorcio, la cada vez mayor acumulación de embriones crioconservados en los centros de reproducción asistida y el retraso de la maternidad exigen tomar en consideración estos conflictos. La presente monografía da cuenta de la disparidad de criterios utilizados por los tribunales que han tenido que resolverlos -tales como el derecho a no ser forzado a procrear, la última oportunidad razonable de tener un hijo genético o el carácter irrevocable del consentimiento a la procreación-, al tiempo que plantea si cabe el recurso a los esquemas propios del derecho de contratos para otorgarles una respuesta jurídica. La propia naturaleza de los intereses enfrentados y de su objeto, su vinculación con el discurso de los derechos reproductivos, así como sus consecuencias en materia de filiación y en la concepción de la familia, son elementos que a tener en cuenta en la búsqueda de esta respuesta.

From affirmative action to protection against sexual harassment, from indigenous peoples’ rights to gay marriage, the struggle to eliminate subordination or exclusion and to achieve substantive equality has been waged through courts and legislation. At the same time, critiques of legalism have generally come to be regarded by liberal and left reformers as politically irrelevant at best, politically disunifying and disorienting at worst. This conjunction of a turn toward left legalism with a turn away from critique has hardened an intellectually defensive, brittle, and unreflective left sensibility at a moment when precisely the opposite is needed. Certainly, the left can engage strategically with the law, but if it does not also track the effects of this engagement—effects that often exceed or even redound against its explicit aims—it will unwittingly foster political institutions and doctrines strikingly at odds with its own values. Brown and Halley have assembled essays from diverse contributors—law professors, philosophers, political theorists, and literary critics—united chiefly by their willingness to think critically from the left about left legal projects. The essays themselves vary by topic, by theoretical approach, and by conclusion. While some contributors attempt to rework particular left legal projects, others insist upon abandoning or replacing those projects. Still others leave open the question of what is to be done as they devote their critical attention to understanding what we are doing.
