Book Confusion Over the Telephone Consumer Protection Act

Download or read book Confusion Over the Telephone Consumer Protection Act written by Linda S. Mullenix and published by . This book was released on 2013 with total page 4 pages. Available in PDF, EPUB and Kindle. Book excerpt: Commentary and analysis of the oral arguments in Mims v. Arrow Financial Services, on the Supreme Court's 2011-12 appellate docket. The Telephone Consumer Protection Act was enacted by Congress in 1991 to fill a gap in state consumer protection statutes relating to auto-dialing technology, unsolicited “robo-calls”, and abusive telemarketing practices. The appeal in Mims focuses on language in the statute that provides: “A person or entity may, if otherwise permitted by the laws of rules of a State, bring an action in an appropriate state court.” The Court will decide whether the statutory language requires private TCPA lawsuits to be brought in state court only, divesting federal courts of jurisdiction, or whether the statutory language permits individuals to bypass state courts and pursue TCPA violations in federal court.Although the Mims appeal does not involve a class action but rather an individual lawsuit, the Court's decision may have implications for TCPA class action litigation. During the past decade, federal and state courts have entertained a wave of so-called “blast fax” class actions for alleged violations of the TCPA. While some states have allowed certification of TCPA claims, other states have rejected this. Federal courts that have entertained TCPA class actions in their diversity jurisdiction have split regarding whether such cases can be certified under Federal Rule 23.At oral argument on November 28, 2011, Chief Justice Roberts Jr. characterized the TCPA as “the strangest statute I have ever seen,” and Justice Samuel Alito deemed it “the oddest creature.”

This book was released on 2018-10-15 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: Telephone Consumer Protection Act of 1991 (US Federal Communications Commission Regulation) (FCC) (2018 Edition) The Law Library presents the complete text of the Telephone Consumer Protection Act of 1991 (US Federal Communications Commission Regulation) (FCC) (2018 Edition). Updated as of May 29, 2018 In this document, the Federal Communications Commission ("FCC" or "Commission") revises its rules to: require prior express written consent for all autodialed or prerecorded telemarketing calls to wireless numbers and for prerecorded calls to residential lines and, accordingly, eliminate the established business relationship exemption for such calls to residential lines while maintaining flexibility in the form of consent needed for purely informational calls; require all prerecorded telemarketing calls to allow consumers to opt out of future prerecorded telemarketing calls using an interactive, automated opt-out mechanism; and limit permissible abandoned calls on a per-calling campaign basis, in order to discourage intrusive calling campaigns. The Commision also exempts from its telemarketing requirements prerecorded calls to residential lines made by health care-related entities governed by the Health Insurance Portability and Accountability Act of 1996. Taken together, today's actions offer consumers greater protection from intrusive telemarketing calls and protect consumers from unwanted autodialed or prerecorded telemarketing calls to wireless numbers and from unwanted prerecorded telemarketing calls to residential lines, also known as "telemarketing robocalls," and maximize consistency with the analogous Telemarketing Sales Rule ("TSR") of the Federal Trade Commission ("FTC"), as contemplated by the Do-Not-Call Implementation Act ("DNCIA") in a way that reduces industry confusion about telemarketers' obligations and does not increase compliance burdens for most telemarketers. Book excerpt: Nearly thirty years ago, an angry senator cursed the wave of automated telemarketing that was invading homes from coast to coast. "Computerized calls are the scourge of modern civilization," he declared. "It is telephone terrorism, and it has got to stop." Congress responded by passing the Telephone Consumer Protection Act. Americans were now able to sue the annoying robocallers, and they rejoiced. Soon, however, junk debt collectors and questionable charities found loopholes in the new law. Next came an onslaught of unstoppable scams that clogged the phone lines beyond belief. Meanwhile, some people were profiteering from confusion over the rules, sometimes at the expense of legitimate businesses. With stinging humor, this book tells how the fight against robocalls went awry. Crazy court cases, devious schemes, and outrageous behavior combine to make an epic story of greed and governmental incompetence. "Telephone Terrorism" is recommended for anyone who has been harassed over the phone by a clueless collection agency or persistent telemarketer, or who simply wants to know more about an unusual law that impacts their life.

Book Ambush Marketing the Mega Event Monopoly

Download or read book Ambush Marketing the Mega Event Monopoly written by Andre M. Louw and published by Springer Science & Business Media. This book was released on 2012-06-06 with total page 771 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book undertakes a critical examination of commercial rights to sports mega-events (focusing on sponsorship), the exclusivity of such rights and the legal implications of the modern mega-event sponsorship model. It examines ambush marketing of events and the law’s treatment of ambushing (specifically in the form of sui generis event legislation) in a review of 10 major jurisdictions selected on the basis of the importance of the events they are to host in the near future or have hosted recently, and the relevant domestic legislation. It critically examines the legitimacy of such commercial rights protection by means of the use of laws in the context of accepted principles of intellectual property law, competition law and human rights law. Specifically, it questions the legitimacy of the creation of statutory ‘association rights’ to mega-events, and considers potential future developments in respect of the law’s treatment of mega-event commercialisation. Valuable for practitioners and academics (in the fields of sportslaw/sponsorship/marketing/intellectual property law); sports administrators (sports governing bodies); corporate sponsors of sports and other events; potential mega-event host governments and law-makers; civil rights organisations.
