Book excerpt: South Africa's Truth and Reconciliation Commission (TRC) and its widely publicized hearings on amnesty and human rights challenge us to understand the nature of the TRC's process, its effects, and outcomes in ways that relate to current critical inquiries in the social sciences and humanities. Using the texts and transcripts of the commission's East London hearings, I have examined how different groups and stakeholders at the truth commission of South Africa have come into conflict over traditional notions of truth, justice, rights, and reconciliation on one hand, and their legal or official definitions on the other. My conclusion is that much of intergroup conflict over these issues in post-apartheid South Africa is influenced by, and can be explained through, the ways local groups and political entrepreneurs interpret the recent South African past. This study shows that ordinary South Africans attach different meanings to the past and invoke competing interpretations of their common predicament. Contrary to the commission's assumptions and expectations, ordinary folks in post-Apartheid South Africa, who have lived all their lives under the law, are interested not in legal fictions of formal equality but in simpler ideals of social justice. This exploratory study makes no attempt to over-explain human action and communication as outcomes of interaction between variables in a causal sequence. Instead, it attempts to construct better accounts of agency in performance and the dynamics of situated will in human communication. Further, this study demonstrates how law and society interact, each shaping the other, in today's so-called globalized world; why people choose to use or avoid law; and how new elites in South Africa have appropriated and used folklore, tradition, and memory in order to form strategic alliances in international relations and build rapport with the new actors in the human rights regime.

However, a groping democracy of full hope is pointing ahead. So that freedom and democracy gain more room the author suggests the establishment of federalism based on ethnic groups. To speak of democracy and freedom without a substantial economic support seems illusive. In order to improve the lot of the least advantaged the author proposes betterment of education and health.

Organised survivors of apartheid violations have long maintained that we cannot adequately address violence in the country, let alone achieve full democracy, without addressing inequality. This book is built around extensive quotes from members of Khulumani Support Group, the apartheid survivors' social movement, and young people growing up in Khulumani families. It shows how these survivors, who bridge the past and the present through their activism, understand and respond to socioeconomic drivers of violence. Pointing to the continuities between apartheid oppression and post-apartheid marginalisation in everyday life, the narratives detail ways in which the democratic dispensation has strengthened barriers to social transformation and helped enable violence. They also present strategies for effecting change through collaboration, dialogue and mutual training and through partnerships with diverse stakeholders that build on local-level knowledge and community-based initiatives. The lens of violence offers new and manageable ways to think about reducing inequality, while the lens of inequality shows that violence is a complex web of causes, pathways and effects that requires a big-picture approach to unravel. The survivors' narratives suggest innovative strategies for promoting a just transition through people-driven transformation that go well beyond the constraints of South Africa's transitional justice practice to date. A result of participatory research conducted in collaboration with and by Khulumani members, this book will be of interest to activists, students, researchers and policy makers working on issues of transitional justice, inequality and violence.

For over forty years, Charles Villa-Vicencio has been on the front lines of Africa's battle for racial equality. In Walk with Us and Listen, he argues that reconciliation needs honest talk to promote trust building and enable former enemies and adversaries to explore joint solutions to the cause of their conflicts. He offers a critical assessment of the South African experiment in transitional justice as captured in the Truth and Reconciliation Commission and considers the influence of ubuntu, in which individuals are defined by their relationships, and other traditional African models of reconciliation. Political reconciliation is offered as a cautious model against which transitional politics needs to be measured. Villa-Vicencio challenges those who stress the obligation to prosecute those allegedly guilty of gross violation of human rights, replacing this call with the need for more complementarity between the International Criminal Court and African mechanisms to achieve the greater goals of justice and peace building.
