From the ‘militant young Australian’ Harry Bridges whose progressive unionism transformed the San Francisco waterfront, to Australia’s successful implementation of the Maritime Labour Convention 2006, this is a story of vision and leadership on the international stage. Unionists who saw themselves as internationalists were also operating within a national and imperial framework where conflicting interests and differences of race and ideology had to be overcome. Union activists in India, China and Japan struggled against indentured labour and ‘coolie’ standards. They linked with their fellow-unionists in pursuing an ideal of international labour rights against the power of shipowners and anti-union governments. In Sweatshops at Sea, historian Leon Fink examines the evolution of laws and labor relations governing ordinary seamen over the past two centuries. The merchant marine offers an ideal setting for examining the changing regulatory regimes applied to workers by the United States, Great Britain, and, ultimately, an organized world community. Fink explores both how political and economic ends are reflected in maritime labor regulations and how agents of reform--including governments, trade unions, and global standard-setting authorities--grappled with the problems of applying land-based, national principles and regulations of labor discipline and management to the sea-going labor force. With the rise of powerful nation-states in a global marketplace in the nineteenth century, recruitment and regulation of a mercantile labor force emerged as a high priority and as a vexing problem for Western powers. W ith this freedom comes a concomitant duty upon the flag State to effectively exercise its jurisdiction and control in administrative , technical , social (LOSC Article 94 (1)) and en vironmental protection (LOSC Article 217) matters over ships flying its flag. 1.2 Flag State Responsibility The absence of any authority over ships sailing the high seas would lead to chaos. One of the essential adjuncts to the principle of freedom of the seas is that a ship must fly the flag of a single State and that it is subject to the jurisdiction of that State. (Brown 1994 , p. 287) This opinion of the International Law Commission in 1956 on a draft article of the High Seas Convention (HSC) was a product of its time; a time of traditional maritime States and responsible long-established shipping companies operating for 3 the most part under the effective maritime administrations of their national flag .
