It analyses several principles of procedural fairness in order to develop practical policy measures for fair decision-making in the UNFCCC. This includes measures that determine who should have a right to participate in its decisions, how these decisions should take place and what level of equality should exist between these actors. In doing so, it proposes that procedural fairness is a fundamental feature of a multilateral response to address climate change. By showing that procedural fairness is most likely to be achieved through the inclusive process of the UNFCCC, it also shows that global efforts to address climate change should continue in this forum.

Book excerpt: The climate change problem can only be effectively dealt with if global anthropogenic greenhouse gas (GHG) emissions can be reduced substantially. Since the emission of such gases is closely related to the economic growth of countries, a critical problem to be addressed by the United Nations Framework Convention on Climate Change (FCCC) is: how will the permissible emission levels be shared between industrialised (ICs) and developing countries (DCs)? The thesis of this book is that the long-term effectiveness of the FCCC runs the risk of a horizontal negotiation deadlock between countries and the risk of vertical standstill within countries if there is little domestic support for the domestic implementation of measures being announced in international negotiations. The research question is: Can one observe trends towards horizontal deadlock and vertical standstill and if yes, how can the treaty design be improved so as to avoid such potential future bottlenecks? The research focuses on the perspectives of domestic actors on the climate convention and related issues in four developing countries: India, Indonesia, Kenya and Brazil. The following key findings emerge from the research: 1. Handicapped negotiating power: The common theme of the foreign policy of DCs is that ICs are responsible for the bulk of the GHG emissions and need to take appropriate domestic action.

The Paris Agreement will replace the 1997 Kyoto Protocol which expires in 2020, and it creates legally binding obligations on the parties, based on their own bottom-up voluntary commitments to implement Nationally Determined Contributions (NDCs). The codification of the climate change regime has advanced well, but the implementation of it remains uncertain. This book focuses on the implementation prospects of the Agreement, which is a challenge for all and will require a fully comprehensive burden- sharing framework. Some say it is the gravest calamity our species has ever encountered. Others deny its existence altogether. As with most caseS of human decision making, the truth is most likely somewhere in the middle. The challenge of this particular set of decisions is the overwhelming sense of uncertainty. Science cannot fully attribute the climatic catastrophes occurring before our eyes to increasing levels of greenhouse gas concentrations. Neither can Science prove that extreme events and warming trends are unrelated to human behavior. Economic models, sophisticated as they are, cannot agree on the costs of reducing carbon dioxide (C~) emissions in industrialized countries. International negotiations are thus mired in the morass of scientific and economic uncertainty. The are only two elements of certainty in the whole debate. The frrst is the need for precaution. The potential impacts are such, that the risk of inaction is unaffordable to the human race. Under the current state of knowledge, mankind must take cautious but unequivocal steps to reverse current patterns.

But the two objectives cannot be considered in isolation: they need to be jointly tackled through an integrated strategy. This report brings together those two objectives and explores how they can more easily be achieved if considered together. It examines the potential impact of climate change and climate policies on poverty reduction. It also provides guidance on how to create a “win-win†? situation so that climate change policies contribute to poverty reduction and poverty-reduction policies contribute to climate change mitigation and resilience building. The key finding of the report is that climate change represents a significant obstacle to the sustained eradication of poverty, but future impacts on poverty are determined by policy choices: rapid, inclusive, and climate-informed development can prevent most short-term impacts whereas immediate pro-poor, emissions-reduction policies can drastically limit long-term ones.
