Book excerpt: La regulación de la concurrencia delictiva en el Código Penal se ha ido volviendo inestable a lo largo de los años, lo que no sólo ha generado numerosos problemas de aplicación práctica, sino que ha puesto de manifiesto inconsistencias ya preexistentes. Entre los factores que han dado lugar a esa inestabilidad destaca, por un lado, la modificación introducida por la L.O. 1/2015, de 30 de marzo, en relación con el concurso medial, que ha suprimido la tradicional equiparación con el concurso ideal, generando un efecto paradójico: se pretendía endurecer el tratamiento del concurso medial, pero en la práctica puede conducir a una pena inferior a la prevista según la regla del concurso ideal. Por otro lado, algunas resoluciones y acuerdos adoptados por el Tribunal Supremo han puesto en tela de juicio la distinción de las diferentes clases de concursos de delitos o de sus respectivos regímenes jurídicos, lo que ha propiciado una mayor confusión en la materia. Adicionalmente, desde la redacción original del Código Penal de 1995 hasta la actualidad se ha observado una proliferación de cláusulas concursales específicas en la Parte Especial de este texto normativo, lo que supone la derogación para el caso concreto de la regulación de los concursos de normas y delitos prevista con alcance general, aproximando esta materia más a la tópica que a la sistemática. A lo anterior han de añadirse los problemas tradicionales que la regulación concursal plantea en relación con principios constitucionales como los de proporcionalidad y ne bis in idem, tanto en el ámbito de los concursos de leyes como en el de los concursos de delitos. The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept.
