Available in PDF, EPUB and Kindle. Book excerpt: The Cayman Islands is one of the world's leading jurisdictions for the establishment of offshore trusts. However, it is not easy for a practitioner to approach the drafting of a Cayman Islands trust instrument with confidence. This eminently practical book solves that problem to near perfection. Arranged as a collection of precedents, with each provision of every precedent explained in detail, Drafting Cayman Islands Trusts, could hardly make the drafting process easier. The drafter learns the advantages and potential pitfalls associated with each provision as he or she prepares to draft it. The authors provide specific language, although individual variations (based on the authors' expert guidance) are encouraged. The precedents covered including the following: Discretionary trusts (with and without protectors) Interest in possession trust Reserved powers trust Charitable trust STAR trusts Appointments and retirements of trustees For additional convenience, the precedents are also provided in Word format on a CD-ROM that comes with the book. The detailed annotation answers such key questions as the following: Are hostile beneficiaries clauses valid? Do automatic flee clauses work? What powers can a settlor reserve? How can STAR trusts be used to protect trustees holding high-risk assets? Would STAR trusts be recognised in other jurisdictions? How can one restrict a beneficiary's right to information and trust documents? Can the appointment of a foreign trustee discharge a retiring Cayman trustee? What indemnities should retiring trustees request from successors? As a systematic approach to drafting Cayman Islands trusts, this book will be of immeasurable day-to-day value to practitioners and administrators alike. Book The American Law Relating to Income and Principal Classic Reprint

Download or read book The American Law Relating to Income and Principal Classic Reprint written by Edwin A. Howes and published by Forgotten Books. This book was released on 2017-09-15 with total page 130 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The American Law Relating to Income and Principal The corpus or principal of a trust is not the cash of which it may have originally consisted, or the cash value at the time of appraisal, but the actual property in which it may be invested for the time being. When trust funds are invested in the pur chase of Shares of stock in a railroad company, the principal is, not the cash paid for the stock, but the stock itself, and if that is later sold for more than the trustee paid for it, the increase is not income but belongs to principal. The owner of a mine is likely to consider the product of a mine as income. It is not real income, but is part of the property itself. Although timber is a real product of the land, the production of it covers so long a period that a life tenant or a trustee for a life beneficiary cannot ordinarily treat it as income, because the taking of it strips the land of something which cannot be replaced while the life interest lasts. Other kinds of property, usu ally to a less degree, naturally waste away by being used in the ordinary manner, and the entire product cannot be treated as real income in the strict mean ing of the word. There must be deductions from the product from time to time to replace the waste in the principal property. This book was released on 2015-07-01 with total page 546 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Principles and Practical Influence of Taxation and the Funding System The second edition of this work was published ten years ago. During the intervening period, the theory of taxation has been farther inquired into; the income-tax has been the theme of numerous and lengthened discussions and investigations; and great changes have been effected in our commercial policy, and in that of surrounding countries. In endeavouring to profit by the additional information which has been thus afforded, we have subjected every part of our work to a careful revision: and being to a great extent rewritten it has, in its present form, more of the character of a new treatise than of a revised edition of an old one. The doctrines embodied in it continue, indeed, to be nearly the same as formerly; but we would fain hope that they have been set in a clearer light; that the groundlessness of the objections made against them has been rendered more obvious; and that the principles and practical operation of the more important taxes and schemes of taxation have been better elucidated.
