Ils passent aux royaumes chrétiens de la Péninsule, en partie, grâce au rôle de relais pour l'Occident que jouent, dès le XIe siècle, les centres monacaux du nord de l'Espagne. L'adab rencontre en al-Andalus la tradition sapientielle juive de la littérature midrashique. Des recueils sont composés, des oeuvres originales produites aux Xe et XIe siècles et, à partir du XIIe siècle, les recueils d'exempla et de dits des philosophes sont traduits en hébreu (Provence), en latin, en langues romanes. Cet héritage complexe se retrouve en bonne part dans la littérature espagnole des XVIe et XVIIe siècles et dans les proverbiers espagnols, judéo-espagnols et maghrébins contemporains. Si les grandes lignes de ces échanges sont connues, on ne sait rien de précis de la circulation effective de ces énoncés sapientiels brefs (notre unité de travail), des choix successifs faits par les traducteurs, des réinterprétations culturelles, ni du poids d'un emprunt par rapport à un autre. Les filiations des textes de sagesse et l'ordre des traductions sont sujets à caution, a fortiori celui des énoncés sapientiels brefs qu'ils contiennent. Ces énoncés sapientiels brefs n'ont pas fait l'objet d'une étude d'ensemble qui retrace leur circulation à travers les différentes langues (savantes et vernaculaires) de la Péninsule Ibérique, qui reconstruise les cheminements des textes et des traductions, les transformations des unités sapientielles qui en résultent, et qui rende compte, enfin, de leurs sources et de leur postérité. Le projet ALIENTO entend répondre à ces questions : il vise donc à calculer les concordances partielles ou totales des textes, leurs connections proches et éloignées afin de réévaluer les relations intertextuelles, en confrontant une ;t'aride quantité d'unités et en croisant des textes écrits dans des langues différentes. Le projet repose sur une collaboration interdisciplinaire étroite entre les chercheurs informaticiens (ATILF) et les spécialistes des textes et linguistes (Université de Lorraine, MSH Lorraine, INALCO et leur réseau international de collaborateurs). La collection ALIENTO met à la disposition des chercheurs les travaux effectués lors des rencontres annuelles et les Chient au courant de l'avancée du projet à travers la publication régulière des résultats obtenus. Ce numéro est consacré à une réflexion sur l'interprétation/réinterprétation, circulation, formulation/reformulation, traduction des concepts éthiques et moraux et leur utilisation dans la littérature sapientielle. In the course of five days, nearly 150 papers were read in three (and sometimes four) parallel sessions. Many of them were delivered within the framework of nine thematic workshops. The publication of most of these panels is underway, in separate volumes. As is usually the case, the academic sessions were accompanied by many opportunities for social interaction among the participants, and there was time to enjoy the historical and cultural benefits of Warsaw. Special honor was accorded to two American Assyriologists whose origins can be traced to Warsaw, Piotr Michalowski and Piotr Steinkeller, and a special session to recognize their contributions to the study of ancient Mesopotamia was organized. In this book are presented papers on the main theme of the meeting, “Fortune and Misfortune in the Ancient Near East.” The 31 essays are organized into 5 sections: (1) plenary presenations on “What Is Fortune? What Is Misfortune?” ; (2) humanity and fortune/misfortune and luck, with discussion of specific examples; (3) additional papers on definitions of fortune and misfortune; (4) the effects on city and state; and (5) God and temple.

Book excerpt: Problèmes de Conflits de Lois en Matière de Filiation, Jacques Foyer Jacques Foyer, Professor at the University of Paris II, notes in introduction of his course that it can be enlightening to compare the different modern methods of solution of the conflict of laws regarding filiation. The study of the different systems shows that there exist at least three methods to contradict the classic choice-of-law rule. The course is structured around the analysis of these three methods. Firstly, it is the criticism of the rigid character and the unpredictability of the traditional rule that triggers the temptation of a manipulation of the choice of law rule. The author then points out that one could question its abstract and arbitrary character, which leads on the one hand to an attempt to hierarchization, and on the other hand, to a diversification of the choice-of-law rules. Lastly, it is the principle of the foreign law's purpose to govern legal relationships in the same way as the lex fori that is questioned, which leads to its partial elimination to the profit of a more or less systematic application of the territorial law or of the one of the court hearing the action. General Course on Private International Law, Friedrich K. Juenger According to Friedrich Juenger, Professor at the University of California in Davis, the outstanding characteristic of the conflict of laws is the lack of consensus on the discipline's goals and methods. He proposes to put the accent in his course on the events for which public international law must find a solution in order to avoid the constant danger that threatens the discipline: that is, to become a simple academic game. Three examples of reported cases and the kinds of issues they raise are given in the Introduction. Professor Juenger next gives a detailed historical overview of the conflict of laws, from Antiquity to Mancini. In addition, the author presents the emergence of new orthodoxies, or rather proposes to re-examine the traditional doctrines, and points out the advantages of a teleological approach. That allows him to revisit the three cases mentioned in the Introduction. Lawyers as well as scientists, adds the author, must mobilize their immense resources, bearing in mind that the rule of law should never disregard moral appreciation.

Book excerpt: Experiencing ethics not only refers to being confronted with a situation in which one must choose a course of action; it also makes reference to giving a narrative account of the circumstances and chain of events leading to such crossroads. Between both there is a chasm, a space of indeterminacy into which R. Musil and L. Sterne delve with aesthetic means. Their poetics move in opposite directions, but by following them to their last critical consequences this study reveals a kindred ethical stance. This interpretation sheds light on the ethics revolving around character construction by examining the constraints thwarting any attempt to complete a biographical account or convey a protagonist that led his or her life. Neither Musil nor Sterne posit a narrative agenda that could reach a last chapter or lead to a groundwork determining their ethics. A closer look into their tight-knit prose reveals that both rely on the narrating, on a skill that must be incessantly cultivated through a digressive or essayistic style. Equipped with a vast theoretical repertoire, this approach makes a strong case for a new constellation in comparative literature.
