Updated as of May 29, 2018 NMFS issues this final rule to implement the Comprehensive Annual Catch Limit Amendment (Comprehensive ACL Amendment) to the Fishery Management Plans (FMPs) for the Snapper-Grouper Fishery of the South Atlantic Region (Snapper-Grouper FMP), the Golden Crab Fishery of the South Atlantic Region (Golden Crab FMP), the Dolphin and Wahoo Fishery off the Atlantic States (Dolphin and Wahoo FMP), and the Pelagic Sargassum Habitat of the South Atlantic Region (Sargassum FMP) as prepared and submitted by the South Atlantic Fishery Management Council (Council). This final rule specifies annual catch limits (ACLs) and accountability measures (AMs) for species in the Snapper-Grouper, Dolphin and Wahoo, and Golden Crab FMPs. This final rule also describes the current terminology and measures in place in the Sargassum FMP that are equivalent to ACLs and AMs. For Sargassum, this final rule does not specifically set an ACL because there is currently a commercial quota in place which functions as an ACL, and there are commercial closure provisions in the event the quota is met or projected to be met which functions as an AM. To implement the Snapper-Grouper FMP, this final rule revises the snapper-grouper fishery management unit (FMU), including the removal of some species, designation of ecosystem component (EC) species, and the development of species groups. This final rule also establishes a daily vessel limit for the recreational possession of wreckfish and creates a closed season for the wreckfish recreational sector. To implement the Dolphin and Wahoo FMP, this final rule prohibits recreational bag limit sales of dolphin from for-hire vessels, and sets a minimum size limit for dolphin off South Carolina that complements the existing minimum size limit off Georgia and Florida. The intent of this final rule is to specify ACLs for species not undergoing overfishing while maintaining catch levels consistent with achieving optimum yield (OY) for the resource. Book excerpt: "A Southeast Data, Assessment, and Review (SEDAR) stock assessment for Gulf of Mexico (Gulf) and Atlantic Spanish mackerel and cobia was finalized in 2013. The South Atlantic Fishery Management Council (South Atlantic Council)’s Scientific and Statistical Committee (SSC) reviewed the result of the stock assessment in April 2013 and requested projections from the Southeast Fisheries Science Center (SEFSC). In June 2013, the South Atlantic Council received the SSC’s recommendations for the Atlantic Spanish mackerel acceptable biological catch (ABC), but the South Atlantic Council requested that the SSC review the Spanish mackerel projections and revisit recommendations for the overfishing limit (OFL) and the ABC. In October 2013, the SSC reviewed the projections again and recommended an OFL value of 7.03 million pounds (mp) in 2014/2015, 6.62 mp in 2015/2016, and 6.519 mp in 2016/2017. The SSC also recommended a revised ABC value of 6.063 mp for 2014/2015-2016/2017. The Gulf of Mexico Fishery Management Council (Gulf Council)’s SSC reviewed the results of the Gulf Spanish mackerel stock assessment in May 2013 and requested projections from the SEFSC. In August 2013, the Gulf Council received and accepted the SSC recommendations for the Gulf Spanish mackerel OFL and ABC for 2013/2014-2016/2017. OFL was set at 14.4 mp for 2013/2014, 12.9 mp for 2014/2015, 12.0 mp for 2015/2016, and 11.5 mp for 2016/2017. The Gulf SSC recommended ABCs at 14.2 mp for 2013/2014, 12.7 mp for 2014/2015, 11.8 mp for 2015/2016, and 11.3 mp for 2016/2017. In accordance with the provisions set forth in the Magnuson-Stevens Fishery Conservation and Management Act and regulations found at 50 CFR 622.389 (Adjustment of Management Measures), the intent of Framework Amendment 1 to the Fishery Management Plan for Coastal Migratory Pelagic Resources in the Gulf of Mexico and South Atlantic Region (Framework Amendment 1) is to revise the annual catch limit (ACL), optimum yield (OY) and recreational annual catch target (ACT) for Atlantic migratory group Spanish mackerel, and revise the ACL for Gulf migratory group Spanish mackerel based on both Council’s SSC recommendations. Framework Amendment 1 with the integrated Environmental Assessment was available for public review before and during each Gulf Council and South Atlantic Council meeting when actions were discussed, public hearings held in January 2014, during the proposed rule phase of the rulemaking process, and online at www.safmc.net and www.gulfcouncil.org"-- Summary (page iv).

Book excerpt: "This Comprehensive Ecosystem-Based Amendment 2 (CE-BA 2) consists of actions related to management of the octocoral fishery, modification of management of Special Management Zones (SMZs) off South Carolina, modification of sea turtle and smalltooth sawfish release gear requirements for the snapper grouper fishery and non-regulatory actions that designate new essential fish habitat (EFH) and EFH-habitat areas of particular concern (EFH-HAPCs). The South Atlantic Fishery Management Council (South Atlantic Council) developed the actions in the amendment consistent with the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act). CE-BA 2 proposes to specify the annual catch limit (ACL) for octocorals in the South Atlantic region. The South Atlantic Council is considering modifying the fishery management unit (FMU) for octocorals under the Fishery Management Plan for Coral, Coral Reefs, Live/Hardbottom Habitats of the South Atlantic Region (Coral FMP) to specify that octocorals are included in the exclusive economic zone off of North Carolina, South Carolina, and Georgia. As a result of potentially reducing the management unit for octocorals, the South Atlantic Council is also considering an action to set the ACL at zero. CE-BA 2 would amend the Snapper Grouper FMP and FMP for the Coastal Migratory Pelagic Resources in the Atlantic and Gulf of Mexico to require that harvest (with the use of all non-prohibited fishing gear) and possession of snapper grouper and coastal migratory pelagic managed species in the SMZs off South Carolina be limited to the recreational bag limit. This action responds to concern from fishermen about potential user conflicts in the SMZs off South Carolina. An action to modify sea turtle and smalltooth sawfish release gear requirements for the snapper grouper fishery is also included in CE-BA 2. Fishermen have expressed concern that the current sea turtle and smalltooth sawfish handling and release gear requirements are intended for "heavier duty" gear used in longline fisheries and are unwieldy and less effective when used with the lighter tackle employed in the non-longline, hook-and-line component of the fishery"--Abstract, page iv.

The stock assessment update indicates black sea bass is no longer undergoing overfishing, is not overfished, and the stock is rebuilt. Based on the outcome of the stock assessment update for black sea bass, the SSC applied the approved ABC control rule to black sea bass, revised P* to be 40%, and recommended new ABC values for 2013-2015. At their December 2012 meeting, the South Atlantic Council determined it would be appropriate to modify certain management measures that are currently in place for black sea bass including changes to the commercial and recreational fishing years. The South Atlantic Council is considering modification to black sea bass management measures in Regulatory Amendment 14 to the Fishery Management Plan for the Snapper Grouper Fishery of the South Atlantic Region (Snapper Grouper FMP), which is currently being developed. The South Atlantic Council stated in Section 1.4 of the Comprehensive ACL Amendment that necessary changes to the ABCs, ACLs, annual catch targets (ACT), and accountability measures for snapper grouper species would be made through the framework procedure modified in Amendment 17B to the Snapper Grouper FMP, which is a more rapid process than a plan amendment. In Regulatory Amendment 19 to the Snapper Grouper FMP (Regulatory Amendment 19), the South Atlantic Council is proposing: adjustments to the ACLs (including sector ACLs), recreational ACT, and optimum yield for black sea bass based on the ABC recommendation of the SSC, which is supported by the recent stock assessment update; and an annual prohibition on the use of black sea bass pots from November 1 through April 30 to minimize the probability of interactions between black sea bass pot gear and Endangered Species Act-listed whales during large whale migrations and right whale calving season off the southeastern coast"--Summary (page iii).

Book excerpt: "Framework Amendment 2 would modify the system of commercial trip limits for Atlantic migratory group Spanish mackerel in the Southern Zone (federal waters off South Carolina, Georgia, and eastern Florida), a new Spanish mackerel fishing area established by Amendment 20B to the FMP in 2015. The current commercial trip limit for Atlantic migratory group Spanish mackerel in federal waters off the east coast of Florida is 3,500 pounds (lbs) from March 1 through November 30; from December 1 through the end of February the trip limit is 1,500 lbs on weekends and is unlimited on weekdays. The weekday commercial trip limit remains unlimited until 75 percent of the adjusted quota, set at 250,000 lbs below the commercial ACL, is landed; after which, the trip limit is 1,500 lbs every day. When 100 percent of the adjusted quota is reached, the commercial trip limit is reduced to 500 lbs until the end of the fishing year or until the full commercial quota is met or projected to be met. The adjusted quota provides a buffer to help prevent the commercial sector from exceeding the commercial ACL. The current commercial ACL is lower than the total allowable catch that was in place when the trip limit system was implemented. The lack of a commercial trip limit for Atlantic migratory group Spanish mackerel in federal waters off the eastern coast of Florida on weekdays beginning December 1 could contribute to early harvest closures in some years. Therefore, this final rule would remove the current weekday and weekend commercial trip limits and replace them with a 3,500 lbs trip limit for the Spanish mackerel Southern Zone (federal waters off South Carolina, Georgia, and eastern Florida). When 75 percent of the adjusted Southern Zone quota (2,417,330 lbs) is met or projected to be met, the commercial trip limit would be reduced to 1,500 lbs. When 100 percent of the adjusted Southern Zone quota is met or projected to be met, the commercial trip limit would be reduced to 500 lbs until the end of the fishing year or until the Southern Zone commercial quota is met or projected to be met, at which time the commercial sector in the Southern Zone would be closed to harvest of Spanish mackerel. Under this amendment, the year-round commercial trip limit of 3,500 lbs north of the South Carolina/North Carolina boundary would not change. The modified system of trip limits described above would remove the unlimited weekday trip limit in federal waters off the east coast of Florida to control harvest of the species in the Southern Zone more effectively"--Cover letter summary.

Book excerpt: "The South Atlantic Fishery Management Council (Council) submitted the subject amendment for review and implementation by the Secretary of Commerce on December 19, 2011. Amendment 20A addresses the commercial sector of the wreckfish component of the snapper-grouper fishery, which is managed under individual transferable quota program. The current total allowable catch for wreckfish for the commercial sector is 2 million pounds. In November 2011, the Council's Scientific and Statistical Committee (SSC) reviewed new data analysis regarding wreckfish, and revised their acceptable biological catch (ABC) recommendation from 250,000 pounds whole weight (ww) to 235,000 pounds ww. The Council reviewed the recommended ABC in December 2011, and passed a motion to concur with the process of adjusting the wreckfish annual catch limit (ACL) to reflect the revised ABC. NOAA Fisheries Service approved the Comprehensive ACL Amendment on January 18, 2012. This revised ACL for wreckfish will be implemented through the final rule for the Comprehensive ACL Amendment on April 16, 2012. Furthermore, 95 percent of the ACL (223,250 pounds ww) will be allocated to the commercial sector for wreckfish. With this reduction in the commercial sector's allowable catch, the annual allocation each wreckfish shareholder will receive under the revised ACL will also be reduced by approximately 89 percent. Thus, active shareholders, captains, crew, and dealers who depend on a certain level of wreckfish production to maintain their operations will be particularly affected by the reduction in the amount of wreckfish the sector may harvest. The actions contained in Amendment 20A would: (1) Define and revoke inactive wreckfish shares; (2) redistribute revoked shares to "active shareholders; (3) define a cap on the number of shares one entity may own; and (4) establish an appeals process for determinations of share status and redistribution. The intended effects of this rule are to end overfishing of South Atlantic red snapper and rebuild the stock. As mandated by Magnuson-Stevens Fishery Conservation and Management Act, NMFS and the Council must prepare and implement a plan amendment and regulations to rebuild the stock and end overfishing immediately by December 6, 2015. At its December 2013 meeting, the Council initiated the development of Amendment 32 to the Fishery Management Plan for the Snapper-Grouper Fishery of the South Atlantic Region (Amendment 32) to address this issue. The council and NMFS, through actions in Amendment 32, plan to develop and propose management actions that would end overfishing immediately and rebuild the blueline tilefish stock. However, Amendment 32 and associated rulemaking is not likely to be effective until 2015. Therefore, at its December 2013 meeting, the Council requested emergency action to reduce overfishing of blueline tilefish while permanent management measures and regulations are being developed through Amendment 32. The need for this emergency action is to minimize adverse biological effects to the blueline tilefish stock and adverse socio-economic effects to fishermen and fishing communities that utilize the blueline tilefish portion of the snapper-grouper fishery. Although the actions in this temporary rule would likely have adverse, socio-economic effects beginning in 2014, the Council and NMFS have determined that the short-term effects would be justified to minimize long-term reductions in harvest that may be required if the current levels of unsustainable harvest continue to reduce the biomass of the blueline tilefish stock. Blueline tilefish is in the deep-water complex, which has a total ACL of 711,025 pounds whole weight (lbs ww). The blueline tilefish portion of the deep-water ACL is 631,341 lbs ww. The blueline tilefish landings in 2012 (477,126 pounds whole weight (lbs ww)), were significantly greater than the maximum sustainable yield at equilibrium (226,500 lbs ww) as determined by the stock assessment. Continued exploitation at levels similar to the 2012 landings would continue to negatively affect the health of the blueline tilefish stock. The temporary rule will implement regulations as per the Council's request. As outlined in their letter to NMFS, the Council's request is centered on the following items (1) set blueline tilefish ACL equal to the equilibrium yield at 75%Fmsy(224,100 lbs ww); (2) set blueline tilefish ACLs equal to 112,207 lbs ww and 111,893 lbs ww for the commercial and recreational sectors, respectively, as determined by the application of the blueline tilefish allocations; (3) remove blueline tilefish from the deep-water complex (currently composed of blueline tilefish, yellowedge grouper, silk snapper, misty grouper, queen snapper, sand tilefish, black snapper, and blackfin snapper); and, (4) set deep-water complex ACLs equal to 60,371 lbs ww and 19,313 lbs ww for the commercial and recreational sectors, respectively. The deep-water complex ACL would remain at current levels, except with the current blueline tilefish 631,341 lbs ww portion removed. This temporary rule also establishes in-season commercial and recreational AMs for blueline tilefish to prevent the ACLs from being exceeded"--Cover letter summary.
