Sono previste due procedure per le imprese che non superano i requisiti dimensionali previsti per l'applicazione della legge fallimentare (accordo di ristrutturazione dei debiti e di soddisfazione dei crediti, liquidazione dei beni del debitore), ed una procedura per i consumatori (Piano del consumatore). Queste procedure, che vedono il coinvolgimento del Tribunale, sono di interesse sia per le piccole imprese e le famiglie con un elevato indebitamento, sia per gli operatori economici, che potrebbero trovarsi coinvolti nella loro veste di creditori. Infine le procedure sono di interesse dei professionisti (avvocati, commercialisti, notai), che possono svolgere le funzioni che la legge ha attribuito agli Organismi di composizione della crisi da sovraindebitamento, su nomina del Tribunale.

La disciplina si articola in distinte procedure concorsuali concordatarie fondate sull'accordo tra debitore e creditori e omologate dal tribunale, ovvero su una proposta del consumatore sovraindebitato, omologata dal tribunale all'esito di un giudizio di meritevolezza e fattibilità. Alternativa a tali soluzioni è la liquidazione dei beni, che si apre di regola a domanda del debitore, ed è modellata sulla disciplina della liquidazione fallimentare. Il ricorso alle procedure per sovraindebitamento è condizione per l'esdebitazione del debitore o consumatore dai debiti contratti sino all'apertura della procedura.
