Among the conclusions is that the EU – and particularly the European Commission – has become a leading global regulator.

One way they do this is by blocking pre-eminent firms’ planned mergers and acquisitions and forcing them to provide access to the data they have gathered—to the benefit of European competitors. Europe’s hardening antitrust stance poses significant problems to U.S. business interests in Europe’s giant digital market. The Commission’s approach also risks digital protectionism and politicization of antitrust enforcement, which could have significant implications for trade relations between the United States and the European Union and for many emerging markets’ thinking about competition policy issues. This paper reviews the proposed changes to Europe’s competition policy and its implications and discusses how U.S. officials and other stakeholders can respond to them.
