The policies were meant originally to be transitional arrangements, the nation's ultimate goal being the establishment of a casteless and classless society. The way things turned out however, both caste and class have remained deeply entrenched as legal, administrative, political, and social realities. The book traces the pre - independence history of the developing concern for the 'depressed classes' in the first part of the twentieth century, the debates in the Constituent Assembly, and goes on to a critical analysis of the first thirty years of the constitutional regime of preferential treatment for identified beneficiaries - Scheduled Castes/ Scheduled Tribes/ other Backward Classes - in the fields of legislative representation, employment, education, and government service. The book's special emphasis is on the role of the higher judiciary and its interventions in the course of cases arising from the policy of reservation, as well as the constitutional context of fundamental rights. This edition includes a preface written by the author for the second (paperback) edition published in 1991, following the controversy over the proposal to implement the Mandal Commission Report. It also includes a new introduction summing up the current situation.

This included legislation and policies against discrimination and disadvantages suffered by religious minorities, especially Muslims, and a new framework for delivering substantive equality of opportunity. This work offers a new interpretation of the UPA's record. In critically re-evaluating the UPA's performance, it uses an institutional policy analysis approach which combines historical institutionalism (and path dependence) with policy analysis. It draws on official sources and extensive interviews with elite administrators and policy makers who were at the core of decision making during the UPA's tenure in office. Detailed case studies are provided of Muslims in public sector employment, the provision of service delivery for Muslim communities in India, and the efforts to create a new legislative framework against communal violence.

In academic and common parlance alike, caste has become a central symbol for India, marking it as fundamentally different from other places while expressing its essence. Nicholas Dirks argues that caste is, in fact, neither an unchanged survival of ancient India nor a single system that reflects a core cultural value. Rather than a basic expression of Indian tradition, caste is a modern phenomenon--the product of a concrete historical encounter between India and British colonial rule. Dirks does not contend that caste was invented by the British. But under British domination caste did become a single term capable of naming and above all subsuming India's diverse forms of social identity and organization. Dirks traces the career of caste from the medieval kingdoms of southern India to the textual traces of early colonial archives; from the commentaries of an eighteenth-century Jesuit to the enumerative obsessions of the late-nineteenth-century census; from the ethnographic writings of colonial administrators to those of twentieth-century Indian scholars seeking to rescue ethnography from its colonial legacy. The book also surveys the rise of caste politics in the twentieth century, focusing in particular on the emergence of caste-based movements that have threatened nationalist consensus. Castes of Mind is an ambitious book, written by an accomplished scholar with a rare mastery of centuries of Indian history and anthropology. It uses the idea of caste as the basis for a magisterial history of modern India. It also analyses state level policies towards backwardness recognition of upper-caste dominant groups through case studies of Maharashtra, Haryana, and Gujarat. It provides an analytical and descriptive account of the proliferation of reservation policy in India and critiques these interventions to assess their implication on constitutional jurisprudence. Further, it assesses the theoretical and empirical challenges such developments pose to the principle of substantive equality and scope of affirmative action policies in Indian constitutional law and general discrimination law theory. Book excerpt: In 1948, the United Nations General Assembly proclaimed the Universal Declaration of Human Rights, stating every human being’s right of equality in dignity and right. However, notwithstanding recognition by the international community of its importance and codification in numerous national and sub-national constitutions and legislation, reinforced by various multilateral and regional human rights treaties, the right of equality continues to be unable to take complete firm hold in all regions and countries. Evidence, as presented by the insightful papers in this collection, published initially as a Special Double Issue of The International Journal of Human Rights dedicated to exploring the place of equality in Asia-Pacific societies, suggests that although progress is being made the right of equality has not yet fully materialized, both in law and in reality, in the world’s most populous region. Many factors, particularly entrenched cultural heritage and practices, the lingering effects of colonialism and newly found independence, and, above all, pervasive ignorance and prejudices, continue to impede the recognition, development and protection of equality in this region. Of course, equality, a normative right and entitlement by virtue of our humanity, has neither been fully achieved in societies outside the region. Such neo-colonial thinking in fact perpetuates and assists in the subjugation of the right of equality in the Asia-Pacific Region as a matter of relevance and concern only to Western countries. Accordingly, we hope that our discussions will also be able to shed light and generate reflections on realities outside the region as interlinked with our aim. Another paper pursues the notion of proportionate equality to what he views as its ultimate reality: that of a purely formal logical concept, while another argues that "egalitarianism" has reference to human interests, which in fact give it content. Another viewpoint considers how far different kinds of equality are compatible with one another and with the enlargement of freedom and fraternity in industrial society. The final paper in this section talks widely over basic issues raised by the various interpretations of equality. Part II deals with sources of beliefs about equality. The final essay in this section surveys the treatment of and implications for egalitarianism in the thinking of the existentialists. Part III is concerned with the political and legal applications of equality. One of the papers suggests that Tocqueville's "providential fact of the gradual development of the principle of equality" might possibly be on the eve of a reversal, and concludes with justification of political equality. Another attacks the notion of equality of opportunity, contending that it is not an authentic expression of the democratic ideal and temper, which requires instead an "affirmation of being and belonging." Following that the highly topical problem of equality in the administration of justice is discussed as well as, the deals with many subtle distinctions involved in the application of the idea of equality to the rule of law. The book concludes with the topic of treatments of the problem of equality in the realm of international politics and organization.

The authors describe the Constitution's design for territorial acquisition and governance and examine the ways in which practice over the past two hundred years has diverged from that original vision. Noting that most of America's territorial acquisitions - including the Louisiana Purchase, the Alaska Purchase, and the territory acquired after the Mexican-American and Spanish-American Wars - resulted from treaties, the authors elaborate a Jeffersonian-based theory of the federal treaty power and assess American territorial acquisitions from this perspective. They find that at least one American acquisition of territory and many of the basic institutions of territorial governance have no constitutional foundation, and they explore the often strange paths that constitutional law has travelled to permit such deviations from the Constitution's original meaning.
