Para dar una respuesta a la pregunta es esencial ahondar en la naturaleza jurídica, definición conceptual, y el alcance de la protección internacional del derecho al medio ambiente sano en el SIDH, para (i) reiterar la conexión existente entre este derecho y otros derechos humanos que los hace indivisibles, (ii) abordar la distinción problemática entre la categorización de derechos económicos, sociales y culturales, y los derechos civiles y políticos, por la diferenciación de los mismos a la hora de ser judicializados ante la Corte IDH, y (iii) abrir la discusión de que la Corte IDH falle de manera contenciosa casos en torno al derecho al medio ambiente sano. La investigación se divide en (i) la construcción de las clasificaciones de derechos humanos; (ii) el corpus iuris del derecho internacional de los derechos humanos y del SIDH; (iii) el origen de la protección al derecho al medio ambiente sano como derecho humano; (iv) la competencia de la Corte IDH; y (v) el contenido de la Opinión Consultiva OC-23/17 sobre el derecho al medio ambiente sano como derecho "humano" justiciable ante la Corte IDH."--Tomado del Formato de Documento de Grado.

La hipótesis inicial es que el Estado mexicano esta internacionalmente obligado a cumplir cabalmente con las sentencias del Sistema Interamericano. Estas sentencias, entre otros derechos, protegen también el Derecho Humano a un medio ambiente sano. El país ha asumido, además, un compromiso reciente en cuanto a la interpretación conforme que debe haber con los tratados internacionales que protegen Derechos Fundamentales; sin embargo, tiene estructuras jurídicas e institucionales sumamente deficientes para cumplir con dichas obligaciones. Además, después de hacer un análisis sobre las consecuencias de algunos casos ambientales relevantes y el papel del Estado respecto a las víctimas ambientales, claramente no tardarán en llegar sentencias internacionales condenatorias en la materia. En México, resulta preciso, entonces, fortalecer el marco jurídico y la estructura orgánica del Estado para lograr a cabalidad la protección al derecho a un medio ambiente sano.
