The mandates and powers of the NHRIs vary from country to country, as does their ability to deliver on these mandates. Indeed, the rapid increase in the number of NHRIs in Africa has come with a variety of substantive and operational challenges. In the face of such challenges, those who work in NHRIs need to understand the broader regional and global context in which the institutions operate and the changing nature of human rights issues. This compendium provides an overview of NHRIs in eastern and southern Africa. It is guided to a large extent by the internationally agreed-upon Principles Relating to the Status of National Institutions, referred to as the Paris Principles. These Principles are broadly accepted as the benchmark against which the legitimacy and credibility of NHRIs can be assessed. Endorsed by the United Nations General Assembly in 1993, the Paris Principles provide NHRIs with guidelines as to their competence and responsibilities, their composition and guarantees of independence and pluralism, and their methods of operation; additional principles relate to the status of commissions with quasi-jurisdictional competence. Book excerpt: Twenty-first-century constitutions now typically include a new 'fourth branch' of government, a group of institutions charged with protecting constitutional democracy, including electoral management bodies, anticorruption agencies, and ombuds offices. This book offers the first general theory of the fourth branch; in a world where governance is exercised through political parties, we cannot be confident that the traditional three branches are enough to preserve constitutional democracy. The fourth branch institutions can, by concentrating within themselves distinctive forms of expertise, deploy that expertise more effectively than the traditional branches are capable of doing. However, several case studies of anticorruption efforts, electoral management bodies, and audit bureaus show that the fourth branch institutions do not always succeed in protecting constitutional democracy, and indeed sometimes undermine it. The book concludes with some cautionary notes about placing too much hope in these – or, indeed, in any – institutions as the guarantors of constitutional democracy.

Book excerpt: This book investigates the role of ethnic federalism in Ethiopian politics, reflecting on a long history of division amongst the country’s political elites. The book argues that these patterns have enabled the resilience and survival of authoritarianism in the country, and have led to the failure of democratization. Ethnic conflict in Ethiopia stretches back to the country’s imperial history. Competing nationalisms begin to emerge towards the end of the imperial era, but were formalized by the Ethiopian People’s Revolutionary Democratic Front (EPRDF) from the 1990s onwards. Under the EPRDF, ethnicity and language classifications formed the main organizing principles for political parties and organizations, and the country’s new federal arrangement was also designed along ethnic fault lines. This book argues that this ethnic federal arrangement, and the continuation of an elite political culture are major factors in explaining the continuation of authoritarianism in Ethiopia. Focusing largely on the last 27 years under the EPRDF and on the political changes of the last few years, but also stretching back to historical narratives of ethnic grievances and division, this book is an important guide to the ethnic politics of Ethiopia and will be of interest to researchers of African politics, authoritarianism and ethnic conflict.
